Star City Council Special Meeting Minutes The Star City Council held a Special Meeting on May 5, 2009 at 8:00 pm at the Star City Hall. Mayor Nathan Mitchell called the meeting to order. Roll Call: Council persons Tammy McDaniel, Dustin Christopherson, and Tom Erlebach were all present. Bell was absent from the meeting. New Business: Mayor Mitchell stated that the meeting was called to discuss the Settlement Agreement between the City of Star and Kuenzli. McDaniel is in favor of the agreement as it stands and felt it is a good compromise. She would like to see the entire parking lot paved, but knows it is expensive. Christopherson has an issue with the agreement. He doesn’t like the fact that we are allowing someone to not follow the Zoning Ordinance and believes it needs to go back to public hearing. The Mayor stated that from a process procedure, we are covered by Code as far as not having another public hearing. The mediation is valid. Erlebach stated that he is split between the two. As long as this agreement states they cannot go away from what is currently being used he is okay. The Mayor stated that anything going on beyond the present use is illegal and will have to come back before the Council for approval. A list has been attached to agreement of what is allowed and they cannot vary from the list without Council approval. Christopherson not sure he wants to have a zone change. It is designated in the Comp Plan as Central Business District. Erlebach asked about having them pave the ingress so they don’t kick gravel out on Star Road. McDaniel moved to approve the settlement agreement between the City and Kuenzli and have the Mayor sign the agreement, Erlebach seconded. Erlebach and McDaniel – aye: Christopherson – nay – motion carried. Adjournment: McDaniel moved to adjourn the meeting, Christopherson seconded the motion. All aye: motion carried.
