BOARD OF CODE APPEALS REGULAR MEETING June 11, 2015 SUBJECT: The minutes of the Board of Code Appeals meeting of June 11, 2015. The meeting was called to order by Chairman Stanek at 6:02 pm MEMBERS PRESENT: Douglas Harvey, Laurel Johnson, Terry Measel, Thaddeus Stanek ABSENT: Fred Berg Michael Viazanko, Building Official Michael Bauss, Fire Marshall RECORDING SECRETARY: Rene Rosni APPROVAL OF AGENDA Motion by Measel, supported by Johnson, to approve the agenda as presented. Yes: All Absent: Berg Motion carried. CONSIDERATIONS PG15-0048 – Brian Kern, J.D. Kern Enterprises, Inc Requesting Board Approval for relief from requirement of Michigan Building Code 2012, Section 507.3 requiring a 60 ft. open yard or public way; and Section 507.5 allowing reduction to 40 ft. from property line when the wall is constructed to a 3-hour fire rating. Property address: 44044 Merrill Road Present: Brian Kern, J.D. Kern Enterprises, Inc. Robert A. Williams, Architect Motion by Harvey, supported by Stanek, to approve PG15-0048 (Brian Kern, J.D. Kern Enterprises, Inc.) requesting a variance for relief from requirement of Michigan Building Code 2012, Section 507.3 from a 60 ft. open yard to 50 ft. and Section 507.5 allowing reduction to 40 ft. from the property line. Yes: All Absent: Berg Motion: Carried OLD BUSINESS Raad Cora came before us two months ago for Social Club Café on Fourteen Mile Road. The petitioner has now increased his cooler and will fall under the sprinkler requirements. We are awaiting a letter to withdrawal that case all together. NEW BUSINESS Kroger’s on Schoenherr and Canal is under construction. They are seeking to split the building. They want to separate from the strip mall. They are proposing a 6-hour fire rated assembly to separate the two. One building will be built with a 4-hour wall and the side of Kroger will be a 2-hour wall; combined it will be six hours.
