BOARD OF CODE APPEALS REGULAR MEETING September 10, 2015 SUBJECT: The minutes of the Board of Code Appeals meeting of September 10, 2015. The meeting was called to order by Chairman Measel at 6:01 pm MEMBERS PRESENT: Fred Berg, Douglas Harvey, Laurel Johnson, Terry Measel, Thaddeus Stanek Michael Viazanko, Building Official RECORDING SECRETARY: Rene Rosni APPROVAL OF AGENDA Motion by Stanek, supported by Harvey, to approve the agenda as presented. Yes: All Absent: None Motion carried. CONSIDERATIONS PG15-0218 – Nottingham Commercial, LLC Requesting Board Approval for a variance to Michigan Building Code 2012, Section 507.3. Property address: 43893 Schoenherr Road Present: Richard J. Sable, Nottingham Commercial, LLC Rick J. Cleve, Rogvoy Architects Mr. Sable indicated the reason for this variance is that Nottingham Commercial does not want to be involved if Kroger wants to contest the property taxes. Kroger wants the ability to maintain its own parcel and in order to accomplish this, we need to obtain a property split. In order to obtain a property split, we first need to obtain a variance from 507.3 of the Michigan Building Code 2012. Mr. Sable stated that the construction which is currently being completed, Kroger has installed two firewalls – a 12” fully grouted four-hour masonry wall on the Kroger side and a 8” fully grouted two-hour masonry wall on the remaining portion of the shopping center separated by an 8” gap, which they feel is appropriate mitigation for not having the code minimum 40 ft. to a property line or building. Mr. Sable also stated that the land division presents no safety issue and is actually an improvement from the previous condition. Motion by Stanek, supported by Johnson, to approve PG15-0218 (Nottingham Commercial, LLC, requesting a variance for relief from requirement of Michigan Building Code 2012, Section 507.3. The petitioner has pointed that there is going to be two firewalls with a super fire rating - one 12”, four-hour masonry wall and one an 8” fully grouted two-hour masonry wall for this new construction at Kroger’s.
