CITY OF STERLING HEIGHTS ORDINANCE BOARD OF APPEALS MARCH 12, 2012 LOCATION: City Council Chambers, 40555 Utica Road, Sterling Heights, Michigan Chairman Pitrone called the meeting to order at 7:00 pm PRESENT: John Pitrone, Chairman, Kenneth Cooper, Vice-Chairman, Joseph DiGaetano, Secretary, Robert Ervin, Jennifer Hartson, Horst Hrinciuc, Code Enforcement Officer, Michael Viazanko, Building Official ABSENT: None RECORDING SECRETARY: Kimberly Stulz APPROVAL OF AGENDA Motion by Commissioner Cooper, supported by Commissioner Hartson to approve agenda as presented. Yes: All. Absent: None. Motion carried. ACCEPTANCE OF THOSE NOTIFIED BY MAIL Mr. Viazanko indicated that he is in receipt of a list of people notified by mail of tonight’s meeting. CORRESPONDENCES - None CONSIDERATIONS G12-0022 Youla, Lahib 38123 Yonkers Drive. Hearing on nuisance abatement at this location for graffiti painted on garage and pile of dirt in backyard. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: graffiti painted on garage and pile of dirt in backyard. Pictures were shown at this time. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 38123 Yonkers Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0023 U.S. Bank, National Association. 40637 Colony Drive. Hearing on nuisance abatement at this location for dirt area in backyard that needs fill and seed, outside storage – toys, flowerpots, garden hoses and bench and debris – broken glass, paper and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: dirt area in backyard that needs fill and seed, outside storage – toys, flowerpots, garden hoses and bench and debris – broken glass, paper and other miscellaneous items. Horst Hrinciuc stated that in addition to the above violations, there is grass between the cracks of the cement, weeds throughout the landscaped areas and backfill needs to be added after a bush was removed. Motion by Commissioner Hartson, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 40637 Colony Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0024 Conklin, Matthew/Huntington National Bank 40444 Diane Drive. Hearing on nuisance abatement at this location for broken garage window, garage door and house trim need to be painted, roof in disrepair and excess leaves and branches need to be removed. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. Motion by Commissioner Ervin, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 40444 Diane Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for gate that needs to be repaired or removed. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: gate that needs to be repaired or removed. Pictures were shown at this time. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 39158 Millington Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0026 Federal Home Loan Mortgage Corporation 2845 Serra Drive. Hearing on nuisance abatement at this location for gutter in disrepair, fence in disrepair, rusty garage door, improper garbage can storage, nuisance growth around fence and outside storage – television, shovel, toys and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: second story gutter in disrepair, fence in disrepair, rusty garage door, improper garbage can storage, nuisance growth around fence and outside storage – television, shovel, toys and other miscellaneous items. Pictures were shown at this time. Motion by Commissioner Hartson, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 2845 Serra Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0027 Federal National Mortgage Association 2535 Camel Drive. Hearing on nuisance abatement at this location for gutter in disrepair and debris – pool, shoes, logs, plastic, door wall screen and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: gutter in disrepair and debris – pool, shoes, logs, plastic, door wall screen and other miscellaneous items. Pictures were shown at this time. Motion by Commissioner Ervin, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 2535 Camel Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. OLD BUSINESS - None NEW BUSINESS – None PUBLIC PARTICIPATION Regarding G12-0022, Mr. Youla stated that he flattened the pile of dirt and that the graffiti was gone so he didn’t know what Horst Hrinciuc was referring to. Commissioner Pitrone told Mr. Youla to speak with Code Enforcement. APPROVAL OF MINUTES Motion by Commissioner Cooper, supported by Commissioner Hartson to approve Minutes of the February 27, 2012 regular meeting. Yes: All. Absent: None. Motion carried.
