CITY OF STERLING HEIGHTS ORDINANCE BOARD OF APPEALS APRIL 9, 2012 LOCATION: City Council Chambers, 40555 Utica Road, Sterling Heights, Michigan Chairman Pitrone called the meeting to order at 7:00 pm PRESENT: John Pitrone, Chairman, Kenneth Cooper, Vice-Chairman, Joseph DiGaetano, Secretary, Robert Ervin, Jennifer Hartson, Horst Hrinciuc, Code Enforcement Officer, Michael Viazanko, Building Official ABSENT: None RECORDING SECRETARY: Kimberly Stulz APPROVAL OF AGENDA Motion by Commissioner Cooper, supported by Commissioner Hartson to approve the agenda after moving item #1 from old business to item #2 of considerations. Yes: All. Absent: None. Motion carried. ACCEPTANCE OF THOSE NOTIFIED BY MAIL Mr. Viazanko indicated that he is in receipt of a list of people notified by mail of tonight’s meeting. CORRESPONDENCES Mr. Viazanko indicated that he had three correspondences for tonight. They are as follows: G12-0042, G12-0048 and G12-0057; the nuisances have been abated and there is no further cause for action. CONSIDERATIONS G12-0038 Hostetler, Waynette B. 33751 Sano Court. Hearing on nuisance abatement at this location for blocking rear property drainage with corner flowerbed. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violation still exists: blocking rear property drainage with corner flowerbed. Pictures were shown at this time. Chairman Pitrone asked Mr. Hrinciuc if the grade of the garden is too high to allow the water to flow naturally. Mr. Hrinciuc said, yes. Ms. Hostetler didn’t agree and said all she did was use newspaper and couple of inches of dirt. She said she put a trench through the garden for water flow. She said that she is also trying to alleviate a water problem. Commissioner Cooper asked if engineering was out there. Mr. Viazanko said that Sal, the DPW Director, and Code Enforcement was out there and determined that the flower bed is creating an obstruction to the catch basin and it can not be corrected by digging a trench. Commissioner Cooper agreed and believed there were a number of yards of dirt that needed to be removed to resolve this problem. Ms Hostetler thought that the next door neighbor should raise his grade. Mr. Clarke showed pictures at this time. He indicated he told her 12 years ago that putting the garden there would create this type of problem. He said raising his grade would create more problems. Chairman Pitrone pointed out that the engineers said the problem was the blocking of the drainage by the garden and not Mr. Clarke’s grade. Mr. Viazanko said he was correct. Commissioner Cooper asked if she would be willing to remove the garden and if it can be done in the next two weeks. She said she would have to hire someone to do it but she can start working on it and wondered who would let her know it was okay. Mr. Viazanko said that an engineer could come out and inspect it. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 33751 Sano Court and to direct the Code Official to abate the violations identified in the attached staff report after April 24, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0030 Clarke, James & Cynthia 33768 Sano Court. Hearing on nuisance abatement at this location for broken basement window, improper drainage trenches in need of filling in, area of pool removal in need of restoration (soil, grade, seed/sod). Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, the window is fixed. The following violations still exist: improper drainage trenches in need of filling in, area of pool removal in need of restoration (soil, grade, seed/sod). Pictures were shown at this time. Mr. Clarke said he fixed the trenches going to her property and put a new one that goes to his front yard. As for the pool, he was waiting so see what the city was going to do. Though, another pump went out in the pool area, which he isn’t going to replace, so he intends to take care of that. Chairman Pitrone asked if the trench was filled in or relocated. Mr. Clarke said relocated to direct the water into his yard. Mr. Viazanko said that redoing his downspout extension by cutting and pitching it to the front yard would give him the same effect and that the trench needs to be filled in. Mr. Clarke said he was willing to try anything to help with the water problem. Mrs. Clarke told the Board that the Code Enforcement Officer walked the property and said that the trench to the front yard was okay. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 33768 Sano Court and to direct the Code Official to abate the violations identified in the attached staff report after April 24, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G12-0039 Fannie Mae 5050 Northlawn Drive. Hearing on nuisance abatement at this location for overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, improperly stored garbage cans, pool deck missing pool, outdoor storage – ladders, debris (through backyard, around garage & in creek) – logs, lumber, plywood, pallets, plastic table, concrete, wheelbarrow, branches and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. He said this property has been before the Board before for the addition but is now being handled in circuit court. There is also a neighbor’s fence that needs to be repaired because the debris has caused it to collapse. The following violations still exist: overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, improperly stored garbage cans, pool deck missing pool, outdoor storage – ladders, debris (through backyard, around garage & in creek) – logs, lumber, plywood, pallets, plastic table, concrete, wheelbarrow, branches and other miscellaneous items. Pictures were shown at this time. Chairman Pitrone asked if this was foreclosed now. Mr. Hrinciuc said, yes. Chairman Pitrone asked Mr. Lavoy if was here before the Board for an addition not being complete. He said, yes. Mr. Lavoy showed pictures of his property and the neighbor’s property at this time. He believed the neighbor was also in violation. He also said that the fence that the city is talking about is many years old and rotted. Chairman Pitrone stressed to Mr. Lavoy that this is about his property and asked if he had any intention of removing the pool deck and resolving the other violations. Mr. Lavoy said, yes. He said everything would be done in two weeks. Mr. Viazanko said this has been an ongoing problem and no matter if the fence was rotted the piled up debris caused it to collapse. He stressed that this matter needed to be addressed. Commissioner DiGaetano asked Mr. Hrinciuc why having a freestanding pool deck in your yard is a violation. Mr. Hrinciuc let him know that it is not being used for its intended purpose. Chairman Pitrone said that someone could fall off and hurt themselves since it’s intended to have a pool attached to it. Motion by Commissioner Hartson, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 5050 Northlawn Drive and to direct the Code Official to abate the violations identified in the attached staff report after April 23, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for improperly stored garbage in back of home around shed, debris – cardboard boxes, glass, plastic, storm door window, shelving unit, windows, wood and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, some debris was removed. The following violations still exist: improperly stored garbage in back of home around shed, debris – cardboard boxes, glass, plastic, storm door window, shelving unit, windows, wood and other miscellaneous items. Motion by Commissioner Ervin, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 4798 Fox Hill Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for house trim/wood in need of paint, graffiti on house and garage in need of removal, debris – bricks, cinder blocks, wood, tires, piles of branches/logs and leaves and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. He also added there a missing gutters on the home and the boarded windows need to be painted. The following violations still exist: house trim/wood in need of paint, graffiti on house and garage in need of removal, debris – bricks, cinder blocks, wood, tires, piles of branches/logs and leaves and other miscellaneous items. Pictures were shown at this time. Mr. Koja said he bought this property and it is in very bad condition. He is hiring someone to fix the inside and out. He was given an estimate of 6-10 weeks. But, he was told everything was taken care of in regards to the violations. Commissioner Cooper highly stressed that the outside be addressed before the inside. Commissioner Cooper asked if he could get the outside done in 2 weeks. Mr. Koja didn’t understand what items because he was told that everything was done. Commissioner Cooper went through the 5 items that needed to be corrected. Mr. Koja said he believed he could get it all done in 2 weeks. Chairman Pitrone asked if there was an inspection today. Mr. Hrinciuc said the code officer noted a dumpster on site but barely a dent in correcting the violations. Chairman Pitrone said if he wasn’t certain about the violations to call someone at the city and they will show him. Commissioner Cooper let him know that it is his responsibility to take care of this property and not to be an absentee owner. Chairman Pitrone let him know if it is not completed the city will complete it for him. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 37200 Ryan Road and to direct the Code Official to abate the violations identified in the attached staff report after April 24, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for improperly stored firewood on front porch and improperly stored garbage can and debris on side of home. Memo received from Plumbing Inspector/Code Enforcement Officer, David Bean stating that the nuisance has been abated and there is no further cause for action. G12-0043 Astemborski, Chester 38190 Van Dyke. Hearing on nuisance abatement at this location for obsolete ground sign. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violation still exists: obsolete ground sign. Pictures were shown at this time. Mr. Gelgel, who used lease the building, said he was here on behalf of the owner. He was there as a favor to the owner. Chairman Pitrone asked if he had permission to be there tonight. Mr. Glegel said, yes. He then continued by saying the building is up for sale and there are a couple of people interested in the property and they want the sign. He doesn’t know why the sign has to be taken down. He said if they tell him what to do he would do it if given a reasonable amount of time. Commissioner Cooper asked Mr. Viazanko what his options are. Mr. Viazanko told him that when a company leaves a building/space that the sign must be removed but we are not requiring the entire ground sign to be removed, just the sign itself and be replaced with a blank panel. Wall signs are different, they have to be removed. Mr. Gelgel asked if he could paint it. Mr. Viazanko said there is usually a problem with painting it and suggested a blank panel be placed into the sign itself. Mr. Gelgel was concerned about the cost to do that. He said the current sign cost $5,000. Mr. Viazanko said the other cases coming in front of the Board have sign contractors already and he might want to stick around to see. Chairman Pitrone doubted it would cost as much as the original sign. Mr. Gelgel again asked about the painting of the sign. Mr. Viazanko said there is a compatibility problem, where the paint will peel and would want to see a blank panel installed. Mr. Glegel said he would do what is needed. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 38190 Van Dyke and to direct the Code Official to abate the violations identified in the attached staff report after April 24, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Mr. Walvekar said he hired a sign contractor and they said it will be done by the end of the week, by Friday. Motion by Commissioner Hartson, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 37824 Van Dyke and to direct the Code Official to abate the violations identified in the attached staff report after April 16, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. As of today, there is one blank panel installed and he assumed the work was probably finished by now. The following violations still exist: obsolete wall sign and missing ground sign panel. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, most of the wood debris is gone. The following violations still exist: debris – scrap woodpiles throughout property, branches, logs, newspapers and other miscellaneous items. Pictures were shown at this time. Mrs. Gmurowski said that this is a rental property and showed pictures at this time. She said she believed everything was taken care of. She indicated that the house next door is being worked on and some of their debris is getting on her property. Chairman Pitrone asked if the stumps were still there. She said that they came from the next-door property. He let her know that even if it is from the next-door neighbor, it is on her property and she’s responsible for removing it. Commissioner Cooper asked if she was given one week, could she get everything done. She said, ok. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 11042 Grenada Drive and to direct the Code Official to abate the violations identified in the attached staff report after April 16, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for fence in disrepair, loose trash and debris around property. Memo received from Code Enforcement Officer, Patrick Willis stating that the nuisance has been abated and there is no further cause for action. G12-0049 38110 Van Dyke, LLC 38110 Van Dyke. Hearing on nuisance abatement at this location for obsolete ground sign, dumpster not enclosed, outdoor storage of portable signs and debris – wood pallets, wood and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, the only violation remains is that a new sign was installed but they have no certificate of occupancy. Pictures were shown at this time. Mr. Marrow, the owner, said he talked with Pat and Larry and they said he could turn the sign around to have a blank white panel. He has a new tenant and there obviously was some miscommunication about the sign and certificate of occupancy. He hired someone to put a wrap around the sign but now knows that is not allowable. Chairman Pitrone pointed out the he needs a certificate of occupancy real quick and asked if they applied. Mr. Kahn, a representative for the tenant, said he is working to get the certificate of occupancy from the city and state. He has been in contact with architect and he is meeting him tomorrow on site and then will be in contact with the Building Official. Commissioner Cooper instructed him to remove the wrap around the sign. Mr. Marrow was going to turn the sign around to the white panel, if acceptable. Mr. Viazanko said, yes. Commissioner Cooper asked if there was any electrical and wanted to make sure you couldn’t see the sign bleeding through. He asked if he could get done in a couple of weeks. Mr. Marrow said, yes. Chairman Pitrone stressed that it is very important that you can’t see the sign coming through if it is just turned around. Mr. Viazanko said they have been in contact with them and they are aware, once they turn the sign around, they will need a permit. He also understood there is a lot of unanswered questions with the new fireworks law. Motion by Commissioner Ervin, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 38110 Van Dyke and to direct the Code Official to abate the violations identified in the attached staff report after April 24, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: overgrown bushes/landscaping, broken overhead garage door, debris – paint cans. Pictures were shown at this time. Commissioner Cooper mentioned the long history on this property. Mr. Hrinciuc agreed and that no one really has been keeping up this property. Motion by Commissioner Hartson, supported by Commissioner Cooper to declare that a public nuisance exists on the property commonly known 40138 Harcourt Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for overgrown bushes and landscaping, house and garage trim in need of paint, missing gutters and downspouts, partial tree stumps in need of removal, debris – bricks, pavers, bags of landscaping material, wood, flower pots and other miscellaneous items. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there has been no change. The following violations still exist: overgrown bushes and landscaping, house and garage trim in need of paint, missing gutters and downspouts, partial tree stumps in need of removal, debris – bricks, pavers, bags of landscaping material, wood, flower pots and other miscellaneous items. Pictures were shown at this time. Mr. Pierce, from Real Estate One, said some of the debris was picked up and the grass was cut. The property is in the process of being sold. The bank wants to know if the gutters and paint need to be done since they have already lost so much money on this property. Mr. Viazanko indicated that it is still required by city ordinance. Mr. Pierce asked about the stumps. Mr. Viazanko said they could just be taken down to the ground. Commissioner Cooper asked how long they needed. Mr. Pierce said 30 days. Mr. Hrinciuc was worried about who would be held responsible if they sold the property in the meantime. Commissioner Cooper said it would be whoever owns it at the time and made sure that Mr. Pierce would inform the new owners of what is going on. Mr. Pierce said he has been doing this for a long time and would definitely let them know. Commissioner DiGaetano asked since they have taken care of a few things if they would be able to get everything done in 30 days. Mr. Pierce said absolutely. Motion by Commissioner Cooper, supported by Commissioner DiGaetano to declare that a public nuisance exists on the property commonly known 42935 Driftwood Drive and to direct the Code Official to abate the violations identified in the attached staff report after May 10, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance.
