Mr. Gerstenberg indicated that she is in receipt of a list of people notified by mail of tonight’s
meeting.
CORRESPONDENCES
Ms. Gerstenberg indicated that she had correspondences for tonight. They are as follows:
G12-0383; correspondence from owner in regards to rental property litigation, G12-0386, G12-
0387, G12-0392, G12-0393, G12-0394, G12-0400, G12-0401, G12-0402 and G12-0407; the
nuisances have been abated and there is no further cause for action.
CONSIDERATIONS
G12-0381 Jabr, Nora – 42161 Schoenherr Road. Hearing on the determination that a
dangerous dog is harbored at this location.
Animal Control Officer, Jeff Randazzo and Police Officer Zeulch explained to the Board about
being dispatched to the petitioner’s house in response to a complaint of a dog bite and the dog
in question, Samson, barging out of house and charging Mr. Randazzo and then Officer Zeulch,
where the dog was peppered sprayed then tasered.
Mr. Jabr and his sister Ms. Jabr responded that the dog has never been aggressive before.
They said that they weren’t given any proof the dog bit anyone (no pictures). Ms. Jabr stated
she would do anything to get their dog back. Mr. Jabr did admit that the way the dog acted
towards the Animal Control Officer and Police Officer was aggressive.
Discussion ensued, while additional questions were asked about the circumstances of the dog
charging out of the house by Mr. Cooper.
Mr. Cooper believed the dog, by no means, was innocent but didn’t believe it fit the “Dangerous
Dog” description. Mr. Pitrone agreed.
Motion by Cooper, Supported by DiGaetano, to declare that the dog known as Samson and
owned or harbored by Nora Jabr at 42161 Schoenherr Road, Sterling Heights, Michigan, is a
potentially dangerous dog as defined by Chapter 8 of the Sterling Heights Code of Ordinances,
specifically Section 8-28(A), and that it is subject to all of the conditions set forth in Section 8-
28(D), as well as the following additional conditions: 1) All fees are to be paid to the City of
Sterling Heights; 2) a storm door is to be installed ( ½ metal); 3) a solid wood 6’ fence is to be
installed with latch and lock gate; 4) additional liability insurance be specific to the potentially
dangerous dog for $500,000 5) All 4 members of the family are required to be involved with the
dog training 6) Only the son and daughter can walk the dog 7) the dog can not be returned until
all the additional conditions are met; with good faith progress to be demonstrated to the Animal
Control Official within 10 days after this resolution has been adopted, and with completion of all
conditions to be demonstrated to the Animal Control Official within 10 days after this resolution
has been adopted. The owner shall pay an inspection fee of $52 per visit with the Animal
Control Official. Failure to comply with these conditions and timeframes shall result in
immediate confiscation as well as forfeiture and euthanization of the dog upon the expiration of
10 days after written notice of the confiscation has been provided to the owner or has been
prominently posted at the above address by the Animal Control Official.

G12-0382 Konopka, James S. & M. – 8620 Cologne Drive. Asking Board approval to erect
6’ privacy fence in the secondary yard setback of Clinton River Road.
Mr. Konopka stated he was asking for the variance for safety reasons. Mr. Cooper pointed out
the current fence looks like it is on city property. Mr. Konopka responded that the new fence
would be 1’ away from the sidewalk. Mr. Cooper asked what kind of fence. Mr. Konopka said it
would be vinyl, if they allowed him to wait until spring to erect it. Mr. Cooper and Ms. Hartson
believed it would be okay to wait until spring.
Motion by Cooper, Supported by Ervin to approve case G12-0382 at 8620 Cologne Drive
providing 1 – that the petitioner agrees to abide by and comply with all applicable rules and
regulations and orders of every lawful agency or governing authority having jurisdiction, 2 – that
the decision of the board will remain valid and in force only as long as the facts and information
presented to the board in public hearing are found to be correct and that the conditions upon
which the motion is based are maintained as presented to the board. 3- the fence is erected
according to the site plan within the property lines. 4 – that the new fence will be a wood/vinyl 6’
solid panel or shadow box design.

G12-0383 Tariq, Muhammad/Paszkowska, M. – 2626 Fox Hill Drive. Hearing on nuisance
abatement at this location for overgrown weeds, debris on rear patio, trailer full of construction
material and outdoor storage.
Code Enforcement Officer, Patrick Willis, stated a couple of violations notices were sent. As of
today, mostly landscaping issues remain. Pictures were shown at this time.
Mr. Tariq stated that this is a rental property where he is trying to evict the tenant. He will get
done what he can but because of personal property laws he can only do so much. Mr. Cooper
pointed out the property was still being claimed 100% homestead. Mr. Cooper let Mr. Tariq
know that even if he can’t do it, the city can.

property commonly known as 2626 Fox Hill Drive and to direct the Code Official to abate the
violations identified in the attached staff report which give rise to this finding immediately. The
Board also authorizes and approves the imposition of a lien against the property, in the amount
of the cost of abatement incurred by the City, as permitted by the applicable city ordinance.

today, progress has been made in the debris removal but all of the other violations still exist.

Mr. Mercurio stated he just got ownership and he pulled a permit today. Mr. Cooper asked if he
could get everything done within 2 weeks. Mr. Mercurio said, yes.

commonly known as 33895 King Richard Drive and to direct the Code Official to abate the
violations identified in the attached staff report which give rise to this finding after December 10,
2012. The Board also authorizes and approves the imposition of a lien against the property, in

Code Enforcement Officer, Patrick Willis, stated a couple of violations notices were sent. As of
today, a majority of the wood is removed and it’s unclear if the vehicle was moved because of
the sight line being blocked by another vehicle. Pictures were shown at this time.
Ms. Juncaj let the board know the junk vehicle was gone. She asked for more time. Mr. Cooper
asked if she could get it done in 2 weeks. Ms. Juncaj said she hoped so.

Memo received from Code Enforcement Officer, Horst Hrinciuc, stating that the nuisance has

Mr. Ervin asked Ms. Gerstenberg about the possibility of sharing laptops with other Board
members with the implementation of paperless packets. Mr. Cooper agreed with Mr. Ervin’s
recommendation.
