CITY OF STERLING HEIGHTS ORDINANCE BOARD OF APPEALS JUNE 10, 2013 LOCATION: City Council Chambers, 40555 Utica Road, Sterling Heights, Michigan Chairman Pitrone called the meeting to order at 7:00 pm PRESENT: John Pitrone, Chairman, Kenneth Cooper, Vice-Chairman, Joseph DiGaetano, Secretary, Robert Ervin, Jennifer Hartson, Denice Gerstenberg, City Development Manager, Paul Geiger, Code Enforcement Officer ABSENT: None RECORDING SECRETARY: Kelly Byrd APPROVAL OF AGENDA Motion by Commissioner Cooper supported by Commissioner Ervin to approve agenda as presented. Yes: All. Absent: None. Motion carried. ACCEPTANCE OF THOSE NOTIFIED BY MAIL Ms. Gerstenberg indicated that she is in receipt of a list of people notified by mail of tonight’s meeting. CORRESPONDENCES Ms. Gerstenberg indicated that she had correspondences for tonight. They are as follows: G13- 0103, G13-0104, G13-0105, G13-0107, G13-0108, G13-0111, G13-0113, G13-0115, G13-0117 – the nuisances have been abated and there is no further cause for action. CONSIDERATIONS G13-0095 Brooks, Kenneth 41755 Tetley Drive. Asking board approval to erect 6’ privacy fence in the secondary front yard setback of De Cook Drive. Homeowner Kenneth Brooks spoke regarding reasons for wanting privacy fence. Mr. Brooks brought many examples of privacy fences without adequate sight lines. Mr. Cooper suggested an alternate plan and asked if the proposed fence will match the section of white PVC fence already in the yard. Mr. Brooks said yes and the alternate plan was discussed. Mr. Pitrone, Mr. Ervin, and Mr. Cooper discussed various options with Mr. Brooks. All agreed to maintaining 3 concrete squares along the sidewalk with no fence to maintain a clear line of sight, that a 15’ triangular area of sight will exist extending from the corner of the driveway down De Cook Drive and from the corner of the driveway toward the garage. Moved by Ervin supported by Cooper, to approve case G13-0095 at 41755 Tetley Drive with the following conditions: 1 – that the petitioner agrees to abide by and comply with all applicable rules and regulations and orders of every lawful agency or governing authority having jurisdiction, 2 – that the decision of the board will remain valid and in force only as long as the facts and information presented to the board in public hearing are found to be correct and that the conditions upon which the motion is based are maintained as presented to the board, and 3 – that a 15’ triangular area of sight exist extending from the corner of the driveway down De Cook Drive and from the corner of the driveway toward the garage as discussed. Asking board approval to erect 6’ privacy fence in the secondary front yard setback of Beverly Drive. Ms. Foad explained what she wants to do with fence. Mr. Pitrone clarified whether Ms. Foad wanted 1’ or 2’ between sidewalk and fence. Mr. Cooper stated he sees no safety issues. Fence materials were discussed. Moved by Cooper supported by Ervin, to approve case G13-0096 at 36170 Almont Drive with the following conditions: 1 – that the petitioner agrees to abide by and comply with all applicable rules and regulations and orders of every lawful agency or governing authority having jurisdiction, 2 – that the decision of the board will remain valid and in force only as long as the facts and information presented to the board in public hearing are found to be correct and that the conditions upon which the motion is based are maintained as presented to the board. Hearing on nuisance abatement at this location for trees and landscape in need of trimming, outdoor storage and trash & debris – tarped items, plastic items, piles of bricks, PVC pipes, pallets, wood, cinder blocks, buckets, chairs, empty pots, damaged outdoor footage, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, weeds need to be removed and the back yard is about 80% cleaned up including wood stored on the ground. Pictures were shown at this time. Homeowner Xing Chun Ruan spoke – wanted to know what she has to do. Code Enforcement Officer Paul Geiger explained that outdoor storage is not allowed. Mr. Cooper asked in one week is enough time to clean up the remaining issues. Mr. Pitrone told Ms. Ruan that if she is not sure what to do, she should call Code Enforcement. Ms. Ruan’s son asked why things cannot be tarped. Mr. Pitrone explained why, stating that is what sheds and garages are for. Moved by Hartson supported by Cooper, to declare that a public nuisance exists on the property commonly known as 39340 Sturbridge Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after Monday June 17, 2013. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for exterior siding in disrepair due to vine damage, trim and soffits on house and trim on garage in need of repair and painting, attic and soffit vents in need of replacing, missing downspout and extension, open window in back of home in disrepair, bushes in need of trimming, weeds in landscape areas, cracks/cuts & perimeters. Code Enforcement Officer, Paul Geiger, stated violations notices were sent. As of today, there was no change other than the lawn was cut and some weeds were removed. He spoke with a contractor on site who said he would be doing work, but did not say when. Pictures were shown at this time. Moved by Ervin, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 13041 Concord Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately. Hearing on nuisance abatement at this location for roof in disrepair and weeds in landscape areas, cracks/cuts & perimeters. Code Enforcement Officer, Paul Geiger, stated violations notices were sent. As of today, one portion of roof shingles were removed and there is no permit on file. Work was just started on Friday June 7, 2013. Pictures were shown at this time. Mr. Pitrone stated it is unfortunate the property owners did not show up. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 11211 Dale Court and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for missing and disconnected downspout and downspout extensions in back of house, white Jeep in driveway, lawn in disrepair, overgrown bushes and trees, weeds and grass in landscape areas, crack/cuts & perimeters. Code Enforcement Officer, Paul Geiger, stated violations notices were sent. As of today, weeds remain in landscaping, shrubs are overgrown, a Jeep in the driveway may or may not be licensed, and an illegal fence painted red, white, and blue was erected with no permit and no supporting posts. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, branches were removed from the backyard and added that there are tree branches hanging over the public sidewalk – needs an 8’ clearance. Pictures were shown at this time. Moved by Ervin, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 14536 Island Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately and adding #6 tree branches that hang over public sidewalk. As of today, the illegal shed was removed, the missing gutter was replaced, and a tree is growing over the public sidewalk that needs to be trimmed – need 8’ clearance. Hearing on nuisance abatement at this location for rusted metal porch in need of paint, overgrown shrubs and vines, front gutter in disrepair, weeds and grass in landscape areas, crack/cuts & perimeters, and debris – branch pile. Memo received from Code Enforcement Officer, Paul Geiger, stating that the nuisance has been abated and there is no further cause for action. G13-0106 Federal Home Loan Mortgage Corp 2060 Koper Drive. Hearing on nuisance abatement at this location for rusted porch supports in need of paint, dilapidated structures behind garage in need of removal – wood deck and rusty satellite dish/pole, missing downspout & extensions, area behind garage in need of restoration after deck removal – fill rat holes and seed or sod, and debris around garage – brush pile, wood, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, there was no change. A representative called stating they put in a work order but had no time frame for work being done. Pictures were shown at this time. Mr. Cooper asked Mr. Geiger if it is possible to bait for rats before moving the fence. Mr. Geiger stated he could ask Mike Moore in DPW. Moved by Ervin, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 2060 Koper Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately adding #6 bait for rats prior to removing shed. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Memo received from Code Enforcement Officer, Tom Lieckfelt, stating that the nuisance has been abated and there is no further cause for action. G13-0108 Paraventi, Richard 4617 Franklin Park Drive. Hearing on nuisance abatement at this location for stagnant pond in front yard, improperly stored garbage cans, overgrown shrubs, tall weeds and grass in landscape areas, crack/cuts & perimeters, and trash, debris, and outdoor storage – tires, wood, buckets, topsoil, ladder, hubcaps, chairs, boxes, and other miscellaneous items. Memo received from Code Enforcement Officer, John Jacob, stating that the nuisance has been abated and there is no further cause for action. G13-0109 Anderson, Jeffery & Deborah 13171 Kinlock Drive. Hearing on nuisance abatement at this location for debris in rear yard and on public right-of-way behind property – tree limbs, trunks, yard waste, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, problem was being corrected at the time he inspected property today. The homeowner came to the counter at 5pm on 06/10/13 and said that the work is done, but Mr. Geiger cannot verify. Pictures were shown at this time. Mr. Pitrone asked about the debris on the other side of the homeowner’s fence. Mr. Geiger stated it is public property. Homeowners Jeff and Debbie Anderson spoke. Mr. Anderson showed photos on his phone of the cleaned up property and stated he never got an answer when he asked what he needs to do in order to clean it up correctly. Mr. Pitrone listed the dates and timelines of violation notices and inspections that go back months. Mr. Cooper stated it seems like they should have visited the counter sooner. Ms. Anderson stated her husband went to City Hall and didn’t get clear answers. Mr. Geiger stated they need to clean up wood on the ground and clear a certain number of feet between the fence and where the grass gets cut. Mr. Pitrone asked if the Andersons put the tree debris there. They stated no, the debris was there when the moved. Mr. Geiger stated some of the wood in the public space was new. Mr. Geiger also stated that contact only occurred after the second violation notice was sent. Mr. Cooper asked if one week is enough time. Homeowners did not give a clear answer. Mr. DiGaetano asked why the homeowners are responsible for the public right-of-way. Mr. Geiger stated that they are only cleaning up what was thrown over the fence – it was clear the items were thrown over the fence. Moved by Hartson, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 13171 Kinlock Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after Monday June 17, 2013. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, the weeds and grass have been cleaned up and wood fence panels were moved to a different area of the yard – next to the shed. Pictures were shown at this time. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 38347 Monterey Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately and adding #3 a non-comforming chicken wire fence attached to the cyclone fence. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Memo received from Code Enforcement Officer, John Jacob, stating that the nuisance has been abated and there is no further cause for action. G13-0112 Vazquez, Victor & Deborah 8276 Tinkler Road. Hearing on nuisance abatement at this location for pool in need of maintenance – tree growing out of pool, outdoor storage – shovel, portable basketball pole, buckets, and other miscellaneous items, tall weeds and grass in landscape areas, crack/cuts & perimeters, and trash & debris – piles of branches and limbs and other yard waste, tires, wood, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, work was started after the OBA sign was posted - the pool has been removed but parts are scattered through the yard, and debris remains in the rear yard. Pictures were shown at this time. Homeowner Deborah Vazquez spoke – said this has been a difficult six months. Said everything is cleaned as of 2:30pm Monday 06/10/13 and showed pictures on her phone. Mr. Pitrone asked if the buckets were holding the shed doors closed. Ms. Vazquez said yes. Mr. Cooper asked Ms. Vazquez about her plans for the pool area. Ms. Vazquez stated she does not know what to do. Mr. Cooper stated she should level off the area and put down grass seed or sod to get the grass growing. Moved by Ervin, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 8276 Tinkler Road and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after June 17, 2013. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Memo received from Code Enforcement Officer, Alan Gross, stating that the nuisance has been abated and there is no further cause for action. G13-0114 Qarana, Steven & Shatha 43468 Hoptree Drive. Hearing on nuisance abatement at this location for dead bush in need of removal, borders around landscape areas in need of repair/removal, overgrown bushes, tall weeds and grass in landscape areas, crack/cuts & perimeters, improperly stored garbage cans, outdoor storage – lawn equipment, bags of soil, buckets, and other miscellaneous items, and trash & debris – piles of bricks, boards, wood, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, the dead bush and outdoor storage items have been removed. Pictures were shown at this time. Homeowner Steven Qarana spoke – said weeds on border are cut, he is making a garden and bricks and other materials are for the garden. Mr. Qarana asked for a week to complete tasks. Mr. Cooper noted that he was granted a two week extension to correct violations, but that was 7 weeks ago. Mr. Qarana said the weather and rain has prevented him from doing work. Mr. Cooper asked what he has been doing for the past several weeks. Mr. Qarana said he has been busy and that it will be done by Monday June 17, 2013. Mr. Qarana asked if the city can send him the bill instead of putting a lien on his house. Mr. Geiger stated that the bill first goes to the homeowner, then goes into taxes as a lien. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 43468 Hoptree Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after June 17, 2013 adding #8 wood around bay window and other house windows is rotting. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Memo received from Code Enforcement Officer, Alan Gross, stating that the nuisance has been abated and there is no further cause for action. G13-0116 Mortgage Center LLC 38650 Sutton Drive. Hearing on nuisance abatement at this location for dead tree in need of removal, fence in disrepair, pool cover – stagnant water in need of removal and cover needs to be secured, overgrown bushes, tall weeds and grass in landscape areas, crack/cuts & perimeters, and trash & debris – wood debris, boards, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, there was no change. Pictures were shown at this time. Moved by Hartson, supported by Ervin, to declare that a public nuisance exists on the property commonly known as 38650 Sutton Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately. Hearing on nuisance abatement at this location for trash & debris – storm door, wood, tiles, bundle of wooden stakes, bale of straw, and other miscellaneous items. Memo received from Code Enforcement Officer, Alan Gross, stating that the nuisance has been abated and there is no further cause for action. G13-0118 Kosto, Bassam 11191 Mandale Drive. Hearing on nuisance abatement at this location for fence in disrepair, improperly stored garbage cans, outdoor storage – bicycles, snow blower, and trash & debris – plastic containers, wood boards, and other miscellaneous items. Code Enforcement Officer, Paul Geiger, stated a couple of violations notices were sent. As of today, the only remaining item is the fence in disrepair – all other issues have been corrected. Pictures were shown at this time. Marsha Kosto speaking on behalf of her brother, homeowner Bassam Kosto. Her brother Bassam rents the home to another brother. Ms. Kosto asked if they need a new fence. Mr. Geiger stated the fence needs to either be removed or replaced. Ms. Kosto asked if her neighbors were responsible for fixing the fence. Mr. Pitrone stated that whoever owns the fence has to repair or replace it, or another option is to have the fence removed because no fence is actually needed. Ms. Kosto asked if the fence is fixable. Mr. Geiger stated that it probably needs new posts, maybe some new sections, and if they are replacing more that 16’ of fence, a permit is required. Ms. Kosto said the need more weeks to have somebody look at it. Mr. Pitrone said he doubts in could be done in a week. Mr. Cooper asked Mr. Geiger what the city contractor would do with the fence. Mr. Geiger stated they would remove and dispose of it. Mr. Cooper stated he thinks two weeks is a fair amount of time. Mr. Cooper also noted that if this house is a rental, Mr. Kosto is not paying enough money in taxes, as his home is listed as 100% homestead. Mr. Cooper asked Ms. Gerstenberg to look into the homestead issue. Ms. Hartson noted that the house next door has an in-ground pool and was concerned about the fence being removed. Mr. Pitrone stated that the property owner with the pool is responsible for their own fencing regarding the pool and safety issues. Moved by Cooper, supported by Ervin, to declare that a public nuisance exists on the property commonly known as 11191 Mandale Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after July 24, 2013. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. PUBLIC PARTICIPATION Mr. Joe Judnick spoke regarding several items: the property on Nineteen Mile Road that was scheduled for this meeting but was abated by owners prior to the meeting, the debris on the empty lot on the south side of Nineteen Mile Road east of Saal, the unfinished Polish Market on the Mound Road south of Eighteen Mile Road, and the vacant building that was formerly Marco Antonio’s Ristorante on Metropolitan Parkway.
