NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals held a public hearing at 7:00 p.m. on Monday September 28, 2015 at the Sterling
Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers, 586-446-2360. At
this meeting the Board (1) considered variance requests of petitioners and (2) conducted hearings on abatement of
nuisances relating to the property and property owners itemized on the following agenda.

2. G15-0265 Younan, Damon – 39638 Crystal Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
39638 Crystal Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
3. G15-0266 Dugan, Lynn Athena – 33700 Curcio Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
33700 Curcio Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
4. G15-0273 Martini, Lena – 11282 Regal Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
11282 Regal Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
5. G15-0274 Snitchler, Arthur – 39828 Valiant Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
39828 Valiant Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
6. G15-0275 F.R.Z. Properties, INC. – 8810 Kidley Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as 8810
Kidley Drive and to direct the Code Official to abate the violations identified in the attached
staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.

7. G15-0277 Margol, Amir & Raieda – 38825 Alcoy Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
38825 Alcoy Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
8. G15-0278 Nischalke, Steven J. – 13321 Roxbury Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
13321 Roxbury Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.

a. G15-0272 Ames, Michael J. II – 11625 Lancer Drive
Code Enforcement Officer, Paul Geiger, stated as of today there were no changes to the
property.
Michael Ames, owner, was present. Mr. Ames stated that the city won’t let him store his trailer
on the side of his house and that it needs to be stored on pavement. Inside the trailer there is a
three-wheeler and a dirt bike. Mr. Geiger stated that he can store the bikes on a registered
trailer as long as they are whole bikes and not in pieces. The tarp would need to be removed.
Mr. Pitrone asked if he can move it into the garage. Mr. Ames stated he can’t. Mr. Pitrone
stated that there is debris on the trailer and it can’t be stored like that in the driveway.
Arrangements need to be made. Mr. Ames asked if he could use car covers to put on the bikes.
Mr. Pitrone stated the he can use fitted covers on the bikes but it must look nice. Mr. Ames
stated that he could have it done by the weekend.
Moved by DiGaetano, supported by Jiles, RESOLVED, to declare that a public nuisance exists
on the property commonly known as 11625 Lancer Drive and to direct the Code Official to
abate the violations identified in the attached staff reports which give rise to this finding
immediately. The Board also authorizes and approves the imposition of a lien against the
property, in the amount of the cost of abatement incurred by the City, as permitted by the
applicable city ordinance.

All interested persons will be given an opportunity to be heard relating to the agenda items. With respect to
nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party may
present testimony at the hearing as to whether any condition located upon the property constitutes a nuisance
and whether the City should abate the nuisance. If the Board determines that the conditions constitute a
nuisance, the Board may order that the City abate the nuisance with the cost of abatement to become a lien
against the owner’s real property collectable in the same manner as real property taxes. Questions re: this
agenda can be directed to 586-446-2360.
The City will provide necessary reasonable auxiliary aids and services to individuals with disabilities at the
meeting upon 7 days notice to the Community Relations Office at 446-2470.
