NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals held a public hearing at 7:00 p.m. on Monday November 9, 2015 at
the Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers,
586-446-2360. At this meeting the Board (1) considered variance requests of petitioners and (2)
conducted hearings on abatement of nuisances relating to the property and property owners itemized
on the following agenda.

a. All petitioners were notified by first class mail about tonight’s meeting. Remove the following
items from the consent agenda as they have been cleaned up prior to the meeting – G15-

Moved by Ervin, supported by Jiles, RESOLVED, to approve the Consent Agenda as amended:
1. To approve the minutes of the regular meeting of October 26, 2015, as presented.
2. G15-0322 Sochacki, Joseph – 38775 Warwickshire Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 38775 Warwickshire Drive and to direct the Code Official to abate the violations
identified in the attached staff reports which give rise to this finding immediately. The
Board also authorizes and approves the imposition of a lien against the property, in the
amount of the cost of abatement incurred by the City, as permitted by the applicable
city ordinance.
3. G15-0323 Omell, Timothy – 42282 Bobjean Street
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 42282 Bobjean Street and to direct the Code Official to abate the violations identified
in the attached staff reports which give rise to this finding immediately. The Board also
authorizes and approves the imposition of a lien against the property, in the amount of
the cost of abatement incurred by the City, as permitted by the applicable city
ordinance.
4. G15-0324 Garver, Idalene & Allegrina M. – 12970 Takoma Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 12970 Takoma Drive and to direct the Code Official to abate the violations identified
in the attached staff reports which give rise to this finding immediately. The Board also
authorizes and approves the imposition of a lien against the property, in the amount of
the cost of abatement incurred by the City, as permitted by the applicable city
ordinance.
5. G15-0329 Townsend, Barron – 38738 Bronson Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 38738 Bronson Drive and to direct the Code Official to abate the violations identified
in the attached staff reports which give rise to this finding immediately. The Board also
authorizes and approves the imposition of a lien against the property, in the amount of
the cost of abatement incurred by the City, as permitted by the applicable city
ordinance.

a. G15-0326 Weatherly, Susan – 40263 Diane Drive
Code Enforcement Officer, Paul Geiger, stated as of today there were some changes to
the property. The homeowner could not be present and sent a letter to the Board.
Pictures were shown at this time.
Ms. Weatherly, owner, was not present. She sent a letter to the Board asking for more
time. Ms. Weatherly was unable to attend the meeting due to a prior commitment. She
has cleaned up the landscaping issues and needs one or two weeks to remove all the
bricks. Mr. Pitrone stated that he was glad the Board heard the case and the resident
did a nice job cleaning the property up so far.
Moved by Ervin, supported by Jiles, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 40263 Diane Drive and to direct the Code
Official to abate the violations identified in the attached staff reports which give rise to
this finding after November 23, 2015. The Board also authorizes and approves the
imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.

b. G15-0327 Quayle, Dennis L. & Jacalyn - Trust – 15032 Rohan Drive
Code Enforcement Officer, Paul Geiger, stated as of today there were some changes to
the property. Pictures were soon at this time.
Jacalyn Quayle, owner, was present. Ms. Quayle stated as of today the property looks
different. She stated that the van has folded clothes and art work in it and she is proud
of how it looks. Mr. Pitrone stated that this property has been in front of the Board a lot
in the past. Mr. Ervin stated that he remembers this property from the past. It is the
same every time and we just keep going round and round. Ms. Quayle stated that she
will be selling the van and the pickup truck soon. Mr. Sala asked Ms. Quayle if she was
confident that all the issues have been resolved. Ms. Quayle stated, “Yes.” She stated
that she worked really hard on it today. Mr. Sala stated that the Board could move for
an immediate abatement since it is all done. Ms. Quayle asked the Board for two more
days to clean the van. Mr. Pitrone asked Ms. Quayle if the Board is going to see her
again next year. Ms. Quayle stated that she hopes not.
Moved by Jiles, supported by DiGaetano, RESOLVED, to declare that a public
nuisance exists on the property commonly known as 15032 Rohan Drive and to direct
the Code Official to abate the violations identified in the attached staff reports which
give rise to this finding after November 16, 2015. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of
abatement incurred by the City, as permitted by the applicable city ordinance.

11. Adjournment
All interested persons will be given an opportunity to be heard relating to the agenda items. With respect to
nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party may
present testimony at the hearing as to whether any condition located upon the property constitutes a nuisance
and whether the City should abate the nuisance. If the Board determines that the conditions constitute a
nuisance, the Board may order that the City abate the nuisance with the cost of abatement to become a lien
against the owner’s real property collectable in the same manner as real property taxes. Questions re: this
agenda can be directed to 586-446-2360.
The City will provide necessary reasonable auxiliary aids and services to individuals with disabilities at the
meeting upon 7 days notice to the Community Relations Office at 446-2470.
