NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals II held a public hearing at 3:00 p.m. on Wednesday February 11, 2015 at the
Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers, 586-446-
2360. At this meeting the Board (1) considered variance requests of petitioners and (2) conducted hearings on
abatement of nuisances relating to the property and property owners itemized on the following agenda.

a. All petitioners were notified by first class mail about today’s meeting. Remove the following items
from the consent agenda and new business as they have been cleaned up prior to the meeting – G15-
0008, G15-0013, G15-0014 & G15-0015.

1. To approve the minutes of the regular meeting of January 14, 2015, as presented.
1. G15-0007 K. Janevsky Company – 4160 Fifteen Mile Road
RESOLVED, to declare that a public nuisance exists on the property commonly known as 4160
Fifteen Mile Road and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
2. G15-0010 Parrish, Paul & Tina & The Huntington National Bank – 2570 Maplecrest Road
RESOLVED, to declare that a public nuisance exists on the property commonly known as 2570
Maplecrest Road and to direct the Code Official to abate the violations identified in the attached
staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
3. G15-0011 The Bank of New York Mellon – 2610 Seventeen Mile Road
RESOLVED, to declare that a public nuisance exists on the property commonly known as 2610
Seventeen Mile Road and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
4. G15-0012 Wilson, Alaina – 33140 Mc Coy Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
33140 Mc Coy Drive to direct the Code Official to abate the violations identified in the attached
staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.

a. G15-0006 Terris, Robert – 12754 Denoter Drive
Code Enforcement Officer, Paul Geiger, stated as of today there have been no changes. There is
still debris in yard, outdoor storage, and an illegal garage addition. Also, there is a boat sitting
on the ground too. Pictures were shown at this time.
Moved by Sauger, supported by Kollmorgen, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 12754 Denoter Drive and to direct the Code Official
to abate the violations identified in the attached staff reports, which give rise to this finding
immediately. The Board also authorizes and approves the imposition of a lien against the
property, in the amount of the cost of abatement incurred by the City, as permitted by the
applicable city ordinance.

b. G15-0009 Reynolds, Kevin & Young, Fred – 2316 Purcell Drive
Code Enforcement Officer, Paul Geiger, stated as of today there have been some changes.
A lot of the debris and leaves have been cleared from the yard and the broken gates and open
shed are still there. The three gates were taken off and are leaning against the fence. Pictures
were shown at this time.
Kevin Reynolds, owner, was present. He stated that the minute he was notified on December
16, 2014 he called and gave his name and number and said he would get on this right away. Mr.
Reynolds explained that when the code enforcement officer came out this morning there were
two people working on the removal of the debris and gates that were leaning against the fence.
He stated that the previous people propped the gate up to keep it from swinging open because
the latch was broke. He explained he did not take care of the gates right away due to the
weather and that his intensions were to have the gates fixed and reattached, but since this all
came about they have been removed all together. Mr. Reynolds explained that the last thing to
be taken care of was what Mr. Geiger was referring to as a shed. He stated it is not a shed it is a
play structure that the previous people had built for their kids. He thought the weather, as well
as other issues going on with the home took precidents over removing the structure at this time.
Ms. Gerstenberg asked Mr. Reynolds how long he needed to have the structure removed and
Mr. Reynolds said it is dismantled now. Ms. Gerstenberg asked again how long Mr. Reynolds
needed to remove the structure, and also, asked if a week was enough time and Mr. Reynolds
responded he could have it all removed in a week.
Moved by Sauger, supported by Kollmorgen, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 2316 Purcell Drive and to direct the Code Official to
abate the violations identified in the attached staff reports, which give rise to this finding after
February 18, 2015. The Board also authorizes and approves the imposition of a lien against the
property, in the amount of the cost of abatement incurred by the City, as permitted by the
applicable city ordinance.

No: None. Absent: Kremhelmer. Motion carried.

All interested persons will be given an opportunity to be heard relating to the agenda items. With respect to
nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party may
present testimony at the hearing as to whether any condition located upon the property constitutes a nuisance
and whether the City should abate the nuisance. If the Board determines that the conditions constitute a
nuisance, the Board may order that the City abate the nuisance with the cost of abatement to become a lien
against the owner’s real property collectable in the same manner as real property taxes. Questions re: this
agenda can be directed to 586-446-2360.
The City will provide necessary reasonable auxiliary aids and services to individuals with disabilities at the
meeting upon 7 days notice to the Community Relations Office at 446-2470.
