NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals II held a public hearing at 3:00 p.m. on Wednesday August 19, 2015 at the
Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers, 586-446-
2360. At this meeting the Board (1) considered variance requests of petitioners and (2) conducted hearings on
abatement of nuisances relating to the property and property owners itemized on the following agenda.

a. All petitioners were notified by first class mail about today’s meeting. Remove the following items
from the consent agenda as they have been cleaned up prior to the meeting – G15-0198, G15-0199
& G15-0201

amended:

1. To approve the minutes of the regular meeting of June 17, 2015, as presented.
2. G15-0196 Parsons, Michael & Michelle – 37445 Dodge Park Road
RESOLVED, to declare that a public nuisance exists on the property commonly known as
37445 Dodge Park Road and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
3. G15-0200 Wehmeyer, Josef A. & Wehmeyer, Adele – 11500 Farthing Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
11500 Farthing Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.

a. G15-0197 Shah, Rajendra – 39055 Ironstone Drive
Code Enforcement Officer, Horst Hrinciuc, stated as of today there have been some changes.
Pictures were shown at this time.
Rajendra, Shah, owner, was present. Mr. Shah stated that he is working with Wallside
Windows and the trim will be done in mid-September. Mr. Sauger asked if Wallside Windows
gave him an installation date. Mr. Shah stated September 15, 2015. Mr. Kollmorgen stated that
the first violation was in May and why has it taken so long. Mr. Shah stated that he took care of
previous issues and there was miscommunication with his brother.
Moved by Kollmorgen, supported by Palmeri, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 39055 Ironstone Drive and to direct the Code
Official to abate the violations identified in the attached staff reports, which give rise to this
finding after September 30, 2015. The Board also authorizes and approves the imposition of a
lien against the property, in the amount of the cost of abatement incurred by the City, as
permitted by the applicable city ordinance.

b. G15-0202 Boucher, Brendan & Kristen – 2002 Newell Drive
Code Enforcement Officer, Horst Hrinciuc, stated as of today there have been some changes.
Restore grass was added to agenda statement. Pictures were shown at this time.
Kristen, Boucher, owner, was present. Ms. Boucher stated that she laid grass seed in the bare
spots. She will be installing pavers in the front yard. It has been pushed back until September
because of the weather. She stated that they have been making repairs to the outside of the
house. Mr. Kollmorgen asked her how much time she needs. Ms. Boucher stated that she needs
until September 30, 2015.
Moved by Palmeri, supported by Kollmorgen, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 2002 Newell Drive and to direct the Code Official to
abate the violations identified in the attached staff reports, which give rise to this finding after
September 30, 2015. The Board also authorizes and approves the imposition of a lien against
the property, in the amount of the cost of abatement incurred by the City, as permitted by the
applicable city ordinance.

c. G15-0203 Yousif, Stephanie – 38703 Pinebrook Drive
Code Enforcement Officer, Horst Hrinciuc, stated as of today there have been some changes.
Pictures were shown at this time.
Stephanie Yousif, owner, was present. Peter Torres, attorney, was present. Mr. Torres stated
that the first time his client was aware of the violations was when she received a notice on the
door. Mr. Sauger asked how much time she needs. Ms. Yousif stated that she needs a week.
Mr. Torres stated everything will be done in a week.
Moved by Kollmorgen, supported by Palmeri, RESOLVED, to declare that a public nuisance
exists on the property commonly known as 38703 Pinebrook Drive and to direct the Code
Official to abate the violations identified in the attached staff reports, which give rise to this
finding after August 26, 2015. The Board also authorizes and approves the imposition of a lien
against the property, in the amount of the cost of abatement incurred by the City, as permitted
by the applicable city ordinance.

All interested persons will be given an opportunity to be heard relating to the agenda items. With respect to
nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party may
present testimony at the hearing as to whether any condition located upon the property constitutes a nuisance
and whether the City should abate the nuisance. If the Board determines that the conditions constitute a
nuisance, the Board may order that the City abate the nuisance with the cost of abatement to become a lien
against the owner’s real property collectable in the same manner as real property taxes. Questions re: this
agenda can be directed to 586-446-2360.
The City will provide necessary reasonable auxiliary aids and services to individuals with disabilities at the
meeting upon 7 days notice to the Community Relations Office at 446-2470.
