NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals II held a public hearing at 3:00 p.m. on June 9, 2021 at the Sterling Heights
Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Community Room, 586-446-2360. At this
meeting the Board (1) considered variance requests of petitioners and (2) conducted hearings on
abatement of nuisances relating to the property and property owners itemized on the following agenda.

2. G21-0062 Berkey, Michael J. 3852 Burr Court
RESOLVED, to declare that a public nuisance exists on the property commonly known as 3852 Burr
Court and to direct the Code Official to abate the violations identified in the attached staff reports
which give rise to this finding immediately. The Board also authorizes and approves the imposition
of a lien against the property, in the amount of the cost of abatement incurred by the City, as
permitted by the applicable city ordinance.
3. G21-0065 BJ Retail Partners, LLC 13901 Metropolitan Parkway
RESOLVED, to declare that a public nuisance exists on the property commonly known as 13901
Metropolitan Parkway and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of abatement
incurred by the City, as permitted by the applicable city ordinance.
4. G21-0067 Shqutaj, Dode & Lumturie 13000 Plumbrook Road
RESOLVED, to declare that a public nuisance exists on the property commonly known as 13000
Plumbrook Road and to direct the Code Official to abate the violations identified in the attached
staff reports which give rise to this finding immediately. The Board also authorizes and approves the
imposition of a lien against the property, in the amount of the cost of abatement incurred by the
City, as permitted by the applicable city ordinance.

5. G21-0068 Foreman, Bryant 41312 North Central Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as 41312
North Central Drive and to direct the Code Official to abate the violations identified in the attached
staff reports which give rise to this finding immediately. The Board also authorizes and approves the
imposition of a lien against the property, in the amount of the cost of abatement incurred by the
City, as permitted by the applicable city ordinance.

Code Enforcement, Dana Vietto, stated as of today there has been no contact with the owner
but there have been some changes to the property. Pictures were shown at this time.

b. G21-0064 Dipalma, Teresa Donna 38317 Arcola Drive
Code Enforcement, Dana Vietto, stated as of today there has been contact with the owner and
there have been some changes to the property. Pictures were shown at this time.
Teresa Dipalma addressed the Board. She indicated she has been sick and trying to take care of
the home. She also indicated the neighbor is bothersome and on her case all the time. Mr.
Stickney asked how long she needs to take care of the problems. Ms. Dipalma indicated she is
trying to maintain the property; however, the neighbor is too picky. She said she will be moving
out. Mr. Stickney inquired about the open garage door and the trash cans outside of it. She
explained she puts charity goods in the cans for people to pick up and she keeps the garage
door open a little in the summer.
Mr. Stickney asked the Board for any questions.
Mr. Ujkic explained the garbage cans are all clumped together and if people are picking things
up from them, it would be better to have them in a line. He indicated they do not want this to
turn into a hoarding situation. Ms. Dipalma indicated again about providing for charities.

neighbor destroyed it.
Mr. Bargowski asked about the stuff on the porch. Ms. Dipalma said it is also for people to pick
things up. Mr. Bargowski indicated it would help to clean it up and every little bit she can do
would make it better.
Mr. Stickney asked for any further questions. Being none, he asked for a motion.

nuisance exists on the property commonly known as 38317 Arcola Drive and to direct the
Code Official to abate the violations identified in the attached staff reports which give rise to this
finding immediately. The Board also authorizes and approves the imposition of a lien against
the property, in the amount of the cost of abatement incurred by the City, as permitted by the
applicable city ordinance.

All interested persons will be given an opportunity to be heard relating to the agenda items. With respect to
nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party
may present testimony at the hearing as to whether any condition located upon the property constitutes a
nuisance and whether the City should abate the nuisance. If the Board determines that the conditions
constitute a nuisance, the Board may order that the City abate the nuisance with the cost of abatement to
