NOTICE OF PUBLIC HEARING
The Board of Ordinance Appeals II will hold a public hearing at 3:00 p.m. on Wednesday, August 18, 2021
at the Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI 48313 in City Hall -
Council Chambers. At this meeting the Board will (1) consider variance requests of petitioners and (2)
conduct hearings on abatement of nuisances relating to the property and property owners itemized on
the following agenda.
AGENDA
1. Mr. Stickney called the meeting to order at 3:17 p.m.

Regular Meeting June 9, 2021
2. G21-0146 Sieh, Larry 38769 Fairfield Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
38769 Fairfield Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes
and approves the imposition of a lien against the property, in the amount of the cost of
abatement incurred by the City, as permitted by the applicable city ordinance.
3. G21-0149 Yousif, Hani 2197 Pandora Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known as
2197 Pandora Drive and to direct the Code Official to abate the violations identified in the
attached staff reports which give rise to this finding immediately. The Board also authorizes
and approves the imposition of a lien against the property, in the amount of the cost of
abatement incurred by the City, as permitted by the applicable city ordinance.

a. G21-0144 Zhou, Zixuan 12298 Jode Pointe Drive
Code Enforcement, Patrick Willis, stated violation notices were sent and pictures were
shown at this time.
Robert Nieri, 11015 May Avenue, Warren, addressed the Board. He indicated he is a co-
worker of the owner and is representing him. He explained the owner of the home has
been stuck in China for over a year. He and other co-workers look after the home and he
came because of the notice posted. Mr. Stickney asked how long he would need for the
holiday lights to be taken down. Mr. Nieri indicated it could be done by the next day.
Mr. Stickney asked the Board for any questions. Being none, he asked for a motion.
Moved by Mr. Stojalowsky, supported by Mr. Bargowski, RESOLVED, to declare that a public
nuisance exists on the property commonly known as 12298 Jode Pointe Drive and to
direct the Code Official to abate the violations identified in the attached staff reports which
give rise to this finding by August 19th. The Board also authorizes and approves the
imposition of a lien against the property, in the amount of the cost of abatement incurred
by the City, as permitted by the applicable city ordinance.

b. G21-0147 Yalda, Hanz Younis & Potrus, Marea 37717 Agar Drive
Code Enforcement, Patrick Willis, stated violation notices were sent and pictures were
shown at this time.
Marea Potrus, 35698 Buxton Drive, addressed the Board. She indicated they are fixing up
the property to sell. Mr. Stickney asked if the property is occupied. Ms. Potrus answered no.
Mr. Stickney indicated no one had contacted the city and this has been going on since June.
He asked how much time she needed to complete the issues. Ms. Potrus asked for another
month.

indicated she would make calls to get it taken care of.
Mr. Stickney asked the Board for any questions. Being none, he asked for a motion.
Moved by Mr. Stojalowsky, supported by Mr. Bargowski, RESOLVED, to declare that a public
nuisance exists on the property commonly known as 37717 Agar Drive and to direct the
Code Official to abate the violations identified in the attached staff reports which give rise
to this finding by August 25th. The Board also authorizes and approves the imposition of a
lien against the property, in the amount of the cost of abatement incurred by the City, as
permitted by the applicable city ordinance.

nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party
may present testimony at the hearing as to whether any condition located upon the property constitutes a
nuisance and whether the City should abate the nuisance. If the Board determines that the conditions
constitute a nuisance, the Board may order that the City abate the nuisance with the cost of abatement to
