Department: Police Attachments: Attachment A - Stockton Ceasefire One Year Report 15.3 14-0103 2004 STOCKTON ARENA REVENUE BONDS SETTLEMENT AND REFUNDING RECOMMENDATION Successor Agency Action It is recommended that the Successor Agency to the former City of Stockton Page 8 Printed on 1/22/2014 City Council/Successor Agency to Meeting Agenda - Final January 28, 2014 the Redevelopment Agency/Public Financing Authority Concurrent Redevelopment Agency of the City of Stockton (“Successor Agency”) adopt a resolution authorizing the Successor Agency, subject to approval by the Oversight Board, to enter into an Amended and Restated Pledge Agreement with the City, and a Forbearance Agreement, with National Public Finance Guarantee Corporation (“NPFG”) and Wells Fargo, National Association as Trustee under the related indenture. Subject to Oversight Board Approval, such agreements will lower scheduled Pledge Payments relating to the Successor Agency’s Revenue Bonds, Series 2004 (Arena Project) (“2004 Revenue Bonds”), as authorized under Health and Safety Code Section 34177.5 (a)(1) and 34181 (e), and cause NPFG and the Trustee to forbear enforcement of certain of their rights relating to payment of the Bonds and related obligations. City Council Action It is recommended that the City Council adopt a resolution approving a settlement of the claims of the Trustee, on behalf of holders of the Bonds, and NPFG, with respect to the Bonds, which resolution authorizes the City to enter into the Amended and Restated Pledge Agreement, and the Forbearance Agreement and delegates to the City Manager, or designee, the authority to take appropriate actions to carry out the purpose and intent of the resolution.
