REGULATIONS, TITLE 24 (INCLUDING BUILDING AND FIRE

RECOMMENDATION
It is recommended that the City Council adopt two ordinances:
1. Amending various sections of Title 15 of the Stockton Municipal
Code (SMC), specifically, Chapters 15.04, 15.08, 15.10, 15.16,
15.20, 15.36, and 15.40, to incorporate the 2013 Edition of the
California Code of Regulations, Title 24, Parts 1 (Building
Standard Administrative Code), 2 (Building Code) (vol. 1 & 2), 2.5
(Residential Building Code), 3 (Electrical Code), 4 (Mechanical
Code), 5 (Plumbing Code), 8 (Historical Building Code), 9 (Fire
Code), 10 (Existing Building Code), and 12 (Reference Standards
Code), as amended;
2. Repealing all of the existing Chapter 15.12 of the SMC and
replacing it with a new Chapter 15.12, adopting the 2013
California Model Fire Code; and

12.2 14-0180 AUTHORIZE THE PURCHASE OF COMPUTERIZED MAINTENANCE
MANAGEMENT SYSTEM SOFTWARE AND IMPLEMENTATION
SERVICES FROM AZTECA INC. AND RJN GROUP FOR MUNICIPAL
UTILITIES AND PUBLIC WORKS
RECOMMENDATION
It is recommended that the City Council approve by motion action
authorizing the City Manager to enter into agreements with Azteca Inc .
of Sandy, Utah and RJN Group of Wheaton, Illinois for the purchase
and implementation of a Computerized Maintenance Management
System (CMMS) for the Municipal Utilities and Public Works
Departments.
It is further recommended that the City Manager be authorized to take

12.3 14-0204 MOTION AUTHORIZING EXTENSION OF CONTRACT WITH PETER
JUAREZ TO OPERATE OAK PARK TENNIS COMPLEX
RECOMMENDATION
It is recommended that the City Council adopt a motion approving and
authorizing an extension for an additional year of the existing contract
with Peter Juarez for continued operation of the Oak Park Tennis
Complex through March 31, 2015; and authorizing the City Manager
take appropriate actions to carry out the purpose and intent of the
motion.

RECOMMENDATION
It is recommended that the City Council authorize by motion Kemper
Sports Management, Inc. to execute a two-year rental agreement with
YAMAHA Golf-Car Company for one-hundred and five (105) 2009
YAMAHA “The Drive” electric golf cars, for $50 per car, per month, and
authorize the City Manager to take appropriate actions to carry out the
purpose and intent of the motion.

RECOMMENDATION
It is recommended that the City Council authorize by motion the City
Manager to execute an Administrative Services Agreement and all
supporting documents with MassMutual Financial Services
(MassMutual) as the Plan Provider and Record Keeper for the City of
Stockton’s Internal Revenue Code (IRC) Section 457 and 401(a)
Deferred Compensation Plans effective April 1, 2014, with an initial term
of five (5) years, and allow the City the right to extend the Administrative
Services Agreement(s) for up to two (2) additional one-year periods. It
is further recommended that the City Council authorize by motion the
City Manager to amend the existing Administrative Services Agreements
with MassMutual and the International City/County Management
Association-Retirement Corporation (ICMA-RC) for a period of up to 120
days to provide time to transition the ICMA-RC assets and accounts and
finalize MassMutual’s new Administrative Services Agreement and
programs.

It is recommended that Council adopt a resolution authorizing the City
Manager to execute an addendum to the already existing agreement
with Hinderliter, deLamas and Associates (HdL), in the amount of
$1,200, for tax audit and information services related to the ¾-cent
general transactions and use tax (Measure A) approved by the voters on
November 5, 2013. As additional compensation for the transaction tax
information services provided pursuant to this agreement, HdL will also
receive a contingent fee of 25 percent (25%) of any additional
transaction and use tax revenue recovered for the City as a result of
HdL’s Measure A audit and follow-up activities.
It is also recommended that Council adopt a resolution appointing the
City Manager, or his designee, to represent the City with authority to
examine transactions and use tax records, and further designating HdL
as the City’s consultant representative with authority to examine
transactions and use tax records, receive allocation and/or registration
information, and identify uses of that data for specific governmental
functions of the City.

16.1 14-0173 PUBLIC HEARING: APPROVE THE ADOPTION OF A NEW
COMBINED COMMERCIAL FOOD SERVICE ESTABLISHMENT AND
WATER QUALITY CONTROL INSPECTION FEE
RECOMMENDATION
This public hearing is to consider public comment and testimony
regarding the approval of a resolution amending the Fiscal Year
2013-2014 Schedule of Fees by adding a new Commercial Food
Service and Water Quality Control combined inspection fee.
The new inspection fee will reimburse the City for staff time and
associated costs of conducting the annual inspection and will reduce
costs by $78 per inspection for commercial food service establishments
through consolidating and reducing the total number of required annual
inspections.
At the conclusion of the public hearing, it is recommended that the City
Council adopt a resolution and approving an amendment to the
2013-2014 Schedule of Fees by adding a Commercial Food Service
Establishment Water Quality Control Inspection Fee.

FORM 700
NOTIFICATION
This item is to serve as notification to department staff, board and commission
members, and elected and appointed officials, of the filing requirement and
approaching deadline for the annual Statement of Economic Interest
Statement (Form 700) filing. Completed statements are required to be filed
with the Office of the City Clerk by April 1, 2014, as set by the Fair Political
Practices Commission. The reporting period covered is January 1, 2013
through December 31, 2013.

*Citizens may comment on any subject within the jurisdiction of the City Council/ Successor Agency to the
Redevelopment Agency, including items on the Agenda. Each speaker is limited to three minutes. Speakers
must submit “Request to Speak” cards to the City Clerk, and be prepared to speak when called. No speaker
cards will be received after the close of the Citizen’s Comments portion of the meeting .
***Additions to the Agenda - Government Code Section 54954.2(b)(2), allows members of the City Council
present at the meeting to take immediate action, with either a two-thirds or unanimous vote, to place an item on
the agenda that action must be taken and that the item came to the attention of the City subsequent to the
agenda being posted.
**Speakers should hold comments on items listed as a Hearing until the Hearing is opened. If a large number of
people desire to speak at a Hearing, the Mayor/Chair may reduce the amount of time allocated to each speaker
to three (3) minutes.

Authority are conducted in English. The City of Stockton does not furnish interpreters and, if one is needed, it
shall be the responsibility of the person needing one. In compliance with the Americans with Disabilities Act, if

Redevelopment Agency/Public Financing Authority, please contact the Office of the City Clerk at (209) 937-8459
at least 48 hours prior to the meeting to enable the City/Agency to make reasonable arrangements to ensure
accessibility.
CHALLENGING CITY DECISIONS: The time limit within which to commence any lawsuit or legal challenge to
any quasi-adjudicative decision made by the City is governed by Section 1094.6 of the Code of Civil Procedure,
unless a shorter limitation period is specified by any other provision. Under Section 1094.6, any lawsuit or legal
challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following
the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that
90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may
be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in
written correspondence delivered to the City of Stockton, at or prior to the meeting. In addition, judicial challenge
may be limited or barred where the interested party has not sought and exhausted all available administrative
remedies.
