STROUDSBURG BOROUGH COUNCIL SPECIAL MEETING MINUTES, FEBRUARY 6, 2018 The Stroudsburg Borough Council held a special meeting on February 6, 2018 at 6:00 P.M. in the Council Chambers with the following members present: James Smith, Council President; Boyd Weiss, Vice-President of Council; Joanne Kochanski, Council President Pro-Tem; Anthony Lanfrank, Matt Abell, and Patrick Maurath. Councilman Mark Connors was absent. Tarah Probst, Mayor; Ron Kimes, Code Enforcement Officer; Joseph P. McDonald, Jr., Borough Solicitor; and Mary Pat Quinn, Interim Borough Manager were present. Donna Kenderdine, a court stenographer engaged by Stroudsburg Borough, was present to record the proceedings of the public hearing for an Application for Conditional Use, which was submitted by Joseph F. Fitzsimmons on behalf of Mobilitie, LLC. with offices at 3475 Piedmont Road NE, Suite 1000, Atlanta, GA 30305. The proposed site is near North 10th Street and North 9th Street in a public right-of-way. Attorney McDonald noted the following exhibits for Stroudsburg Borough: #1 Notice of Public Hearing; #2 Proof of Publication from the Pocono Record – notices published in the issues of January 22, 2018 and January 29, 2018; #3 Certification of Posting of the subject property on January 22, 2018 dated February 6, 2018 and signed by Ron Kimes; #4 Notice of Public Meeting served upon adjoining properties; and #5 Application for Conditional Use Hearing before the Stroudsburg Borough Council submitted for Mobilitie, LLC. A motion was made by Mr. Weiss, seconded by Mr. Maurath to accept the five (5) exhibits. The motion was carried with all present voting affirmatively. Mr. Fitzsimmons was sworn in by Ms. Kenderdine. He submitted, “Mobilitie, LLC. Conditional Use Package to Planning Commission, Borough of Stroudsburg”, which was marked as Applicant Exhibit #1. It was noted that Mobilitie, LLC. granted an extension of the sixty (60) day period to the Borough to hold the public hearing on this date. During Mr. Fitzsimmons’ testimony, Ms. Kochanski asked about the contents of the equipment box that would be affixed to the pole. She expressed concern if the pole should get knocked down. Would there be any health, safety or liability issue for the fire department. Mr. Fitzsimmons responded that there are electronics in the box, and that nothing would explode. He agreed to provide information about the contents to the Borough. Mr. Lanfrank asked about any health risks that would be associated with the antenna. Mr. Fitzsimmons noted that the antenna falls within the guidelines of the FCC and that there are no environmental risks. He will also provide this documentation to the Borough. The hearing was closed at 7:00 P.M. on a motion made by Mrs. Kochanski, seconded by Mr. Lanfrank. The motion was carried with all present voting affirmatively. A motion was made by Mr. Weiss, seconded by Mr. Maurath to table the decision on the application until the applicant submits the requested additional information to the Borough. The matter will carry to the next meeting of the Borough Council as old business. The motion was carried with all present voting affirmatively. The meeting was adjourned at 7:00 P.M. on a motion made by Mrs. Kochanski, seconded by Mr. Weiss. The motion was carried with all present voting affirmatively.
