MINUTES Stroudsburg Borough Council Meeting Tuesday, February 19, 2019 at 7:00 P.M. 1. Call to Order/Roll Call - Present were: Council Member Anthony Lanfrank, Council Vice President Boyd Weiss, Mayor Tarah Probst, Solicitor Joseph McDonald, Council President James Smith, Borough Manager Maier, Council Member Matt Abell, Council Member Mark Connors and Council Member McCabe. A Quorum was present. Absent was Council Member Joanne Kochanski. 2. Pledge of Allegiance was recited. 3. Public Input for Agenda Items. No Public Input. 4. Approval of Council Meeting Minutes for Regular Meeting, February 5, 2019. Motion by Mr. Weiss to approve Council Meeting Minutes for Regular Meeting, February 5, 2019, second by Ms. McCabe. All in favor, Motion Carries. 5. Monthly Administrative Reports a. Permits Issued Report d. Fire Department Report b. Public Works Report e. Right-To-Know Report c. Parking Report f. Police Department Report (provided via email) Motion by Mr. Abell to Accept Monthly Administrative Reports, second by Mr. Connors. All in favor, Motion Carries. 6. Accept Unaudited January, 2019 Treasurer’s Report. a. Bank Account Balances b. Budget to Actual Report Motion by Mr. Weiss to Accept Unaudited January, 2019 Treasurer’s Report, second by Mr. Lanfrank. All in favor, Motion Carries. Old Business 7. Status of remaining Municipal Building Renovation Project Loan balance, re: Fire Alarm System, Upgrade Reception Area. Ms. Maier advises we are waiting for the Fire Alarm System drawings and one cabinet which is backordered. 8. Status of Bike Rack Project. Ms. Maier advises this needs to go out to bid. New Business 9. Consideration to schedule a public hearing for An Ordinance of the Stroudsburg Borough Council to Amend §15-315 1. B (6) of the Stroudsburg Borough Code entitled, “Parking Prohibited by Type of Vehicle”, Specifically to Authorize the Borough Council to Establish a Daily Rate for the Purchase of Meter Bags by Resolution. The current cost is $5.00 per meter bag, increasing to $10.00 per meter bag. Motion by Mr. Weiss to schedule a public hearing March 5, 2019 for An Ordinance of the Stroudsburg Borough Council to Amend §15-315 1. B (6) of the Stroudsburg Borough Code entitled, “Parking Prohibited by Type of Vehicle”, Specifically to Authorize the Borough Council to Establish a Daily Rate for the Purchase of Meter Bags by Resolution and to replace the wording “property owner” with “applicant”, second by Mr. Abell. All in favor, Motion Carries. 10. Consideration to schedule a public hearing for An Ordinance of the Stroudsburg Borough Council to Revise the Penalty for Violations of §15-701 Entitled, “Residential Parking Districts”. The current fine is $15, increasing to $50 with a late fee of $50. Motion by Mr. Weiss to schedule a public hearing March 5, 2019 for An Ordinance of the Stroudsburg Borough Council to Revise the Penalty for Violations of §15-701 Entitled, “Residential Parking Districts”, second by Mr. Lanfrank. All in favor, Motion Carries. 11. Consideration to schedule a public hearing for An Ordinance of the Stroudsburg Borough Council to Amend §15-608 entitled, “Penalties” of the Stroudsburg Borough Code. The Ordinance will revise the penalties for violations of the Snow and Ice Emergency Ordinance. The current fine is $15, increasing to $100 with a late fee of $50. Motion by Mr. Weiss to schedule a public hearing March 5, 2019 for An Ordinance of the Stroudsburg Borough Council to Amend §15-608 entitled, “Penalties” of the Stroudsburg Borough Code. The Ordinance will revise the penalties for violations of the Snow and Ice Emergency Ordinance, second by Ms. McCabe. All in favor, Motion Carries. 12. Consideration to schedule a public hearing for An Ordinance of the Stroudsburg Borough Council to Revise §15-801 entitled, “Fire Lanes” of the Stroudsburg Borough Code. The Ordinance will revise the penalties for violations of the Fire Lane Ordinance. The current fine is $15, increasing to $50 with a late fee of $50. Motion by Mr. Weiss to schedule a public hearing March 5, 2019 for An Ordinance of the Stroudsburg Borough Council to Revise §15-801 entitled, “Fire Lanes” of the Stroudsburg Borough Code. The Ordinance will revise the penalties for violations of the Fire Lane Ordinance, second by Mr. Lanfrank. All in favor, Motion Carries. 13. Consideration to schedule a public hearing for An Ordinance of the Stroudsburg Borough Council to Amend §15-407 entitled, “Unlawful to Park After Time on Meter has Elapsed; Evidence of Violation”. This Ordinance will permit a parking enforcement officer to issue an additional parking ticket for the owner or operator of a motor vehicle that was previously ticketed for an expired meter after two hours have elapsed. The current Ordinance allows ticketing every hour. Parking Enforcement currently tickets every two hours. Motion by Mr. Weiss to schedule a public hearing March 5, 2019 for An Ordinance of the Stroudsburg Borough Council to Amend §15-407 entitled, “Unlawful to Park After Time on Meter has Elapsed; Evidence of Violation”. Consideration to schedule a public hearing for An Ordinance to Amend Ordinance §15-401 of the Stroudsburg Borough Code entitled, “Metered Parking, Parking Meter Zones Established”. The Ordinance will revise the day during which parking is not permitted between 2:00 A.M. and 6:00 A.M in Parking Lot 5. This will allow the Borough to perform maintenance if needed. East side No Parking Monday 2-6am and the West side No Parking Thursday 2-6am. Motion by Mr. Weiss to approve a Budget Transfer Resolution-CY 2019, second by Mr. Lanfrank. All in favor, Motion Carries. 17. Consideration to approve a Resolution authorizing the purchase of a 2003 Peterbilt PB 330 Dump Truck with Snow Plow and Spreader from Stroud Township in the amount of $37,000.00. Motion by Mr. Weiss to approve a Resolution authorizing the purchase of a 2003 Peterbilt PB 330 Dump Truck with Snow Plow and Spreader from Stroud Township in the amount of $37,000.00, second by Ms. McCabe. Lengthy discussion ensued about the (2) Hino trucks budgeted for 2019 and this purchase putting the Borough overbudget by $37,000.00. Motion by Mr. Connors to vote to end the debate on this topic, second by Ms. McCabe. All in favor, Motion Carries. Motion by Mr. Weiss to approve a Resolution authorizing the purchase of a 2003 Peterbilt PB 330 Dump Truck with Snow Plow and Spreader from Stroud Township in the amount of $37,000.00, second by Ms. McCabe. All in favor, Motion Carries. 18. Consider the application of Mary Stuart, as recommended for approval and issuance by the Historic Architectural Review Board for the replacement of roofing at 724 Scott Street. Motion by Mr. Abell to approve the application of Mary Stuart, as recommended for approval and issuance by the Historic Architectural Review Board for the replacement of roofing at 724 Scott Street, second by Mr. Weiss. All in favor, Motion Carries. 19. Consider the application of Leo and Laurie Jackson, as recommended for approval and issuance by the Historic Architectural Review Board, for exterior alterations at 607 Monroe Street. Motion by Mr. Weiss to approve the application of Leo and Laurie Jackson, as recommended for approval and issuance by the Historic Architectural Review Board, for exterior alterations at 607 Monroe Street, second by Mr. Abell. All in favor, Motion Carries. 20. Consider the application of Oak Tree Properties Inc, as recommended for approval and issuance by the Historic Architectural Review Board, for exterior alterations at 28 North Seventh Street. Motion by Mr. Abell to approve the application of Oak Tree Properties Inc, as recommended for approval and issuance by the Historic Architectural Review Board, for exterior alterations at 28 North Seventh Street, second by Mr. Weiss. All in favor, Motion Carries. 21. Committee Reports. A. Codes Committee – Mayor Probst advises the Committee met and discussed short term lease for Air B & B’s, the committee needs to verify the R-2 Zone was restricted. Solicitor McDonald has litigated for property owners for Air B & B’s, Council may want to seek alternate counsel for this matter. Solicitor McDonald also advises the Pennsylvania Supreme Court heard oral arguments on December 5, 2018, if Municipalities have the ability to regulate short term rentals. Lengthy discussion ensued. Staff will look up prior minutes to clarify. Mayor Probst is following up on the Dumpster Screening Ordinance which was previously approved but has not been written yet. The Committee also discussed was the Medical Marijuana Ordinance. Lengthy discussion ensued. B. Finance Committee – No Report C. Parking Committee - No Report D. Recycling Committee - No Report E. Sewer Committee - No Report F. Street Committee – Mr. Lanfrank advised the Committee met today. Mr. Jody Singer was in attendance to discuss ideas for the crosswalks and a possible contest, the committee is looking for businesses and costs. The committee also discussed paving equipment, roller, paver, renting a miller. We will provide a cost comparison between purchasing the equipment vs hiring a company. G. Personnel Committee - No Report H. Public Relations/Media Committee – Mayor Probst advises an email was sent out for the next newsletter which will be sent the end of March. Information needs to be sent to Ms. Maier no later by March 15th. Ms. McCabe advises Winterfest on Facebook was a huge success. Ms. McCabe received one complaint that the Borough was predatory in writing $10 parking tickets for expired meters. Ms. McCabe advised she is working on bands for Concerts in the Park. I. Redevelopment Committee - No Report as the meeting was snowed out J. I-80 Expansion Task Force Committee – Mr. Connors advises the next meeting is scheduled February 26th at 6:00pm, the Committee is in the action and lobbying phase. Mr. Connors advises no meetings have been scheduled yet with State Representatives. Mr. Connors advises we have received 170 responses to the mailer. Some results are:  Four to one against 6 lanes  Six to one against eliminating Dreher Avenue  Two to one to not configure West Main Street K. Stroud Region Open Space and Recreation Commission - No Report 22. Mayor’s Report – Mayor Probst wanted to confirm motorcycle parking spots were recently replaced with compact car parking. Mr. Ace confirms this was completed. Mayor Probst advised she attended a meeting with Mr. Connors at the YMCA. The YMCA is looking for a child care facility, Ramsey may be good for this. Mayor Probst thanks everyone as Winterfest was awesome. 23. Council Member Reports. No Report from any Council Members. 24. Solicitor’s Report – Solicitor McDonald advises the Zoning Hearing Board resumes the hearing tomorrow for Adams Outdoor which was continued from January. Solicitor McDonald does not expect the matter to conclude tomorrow; the Board may vote to grant a Variance or Special Exception relief; if not Adams Outdoor may ask for a 3rd continuance for next month to provide testimony to challenge the validity of the amended Section 8 of the Zoning Ordinance for signs. Solicitor McDonald advises we have 6 parking hearings scheduled for the next meeting. From a Public Notice standpoint, it may make sense to publish a combined notice since all from the same chapter. 25. Manager’s Report – Ms. Maier advises RKR Hess has sent a new map with the area to lease from the Stroudsburg Area School District and Ms. Maier will request to meet with the School Board to discuss the lease and the Lerta program. Ms. Maier advises the documents are complete for SARP’s roof. The letter was sent out to AECOM regarding the Broad Street Bridge. Ms. Maier needs clarification on the Hino truck which was previously budgeted for and approved as there is a 12-month lead time, we need approval to move forward with the order. Mr. Smith advises to add to the next agenda. Mr. Ace advises the lead time on the Hino trucks are 12 months with no delays, we have gone through several sales managers. Mr. Ace found through International, a single axle Dump truck, it’s more expensive ($16K more than budgeted) but more heavy duty than the Hino’s. We budgeted $137K plus the $2,600 extra. This truck is $155,900 and available now. Mr. Smith advises to add to the next agenda with a comparison. Ms. Maier called Charlie Garris from the County for the Lerta program and may have the wrong phone number, previously spoke to Greg Christine and the County was interested. 26. Code Enforcement Officer’s Report - No Report 27. Street Superintendent’s Report. Mr. Ace would like to thank Council for approving the truck. 28. Approval of Bills on Warrants 190219.
