Special Presentation - Presentation of the Fiscal Year 2008 Comprehensive Annual Financial Report No City Council action was required. 5. Removal of Items from the Consent Agenda and Adoption of the Agenda A motion to adopt the agenda in its entirety with the exception of Consent Agenda Item #7 and Consent Agenda Item #10, which were considered by a separate vote. Approved 7-0 6. Agenda Speakers No City Council action was required. 7. Consent Agenda - An ordinance amending number 146-98 as it relates to the Code of the City of Suffolk, Virginia, Chapter 66, Personnel, in its entirety (This item was continued from the December 3, 2008, City Council Meeting) Approved 6-1 (Council Member Bennett voted in opposition.) 8. Consent Agenda - A resolution to accept and appropriate funds for the City of Suffolk HOME Investment Partnership Program Approved 7-0 9. Consent Agenda - A resolution to reappropriate designated funds to the 2008-2009 Operating and Capital Budget for completion of program projects Approved 7-0 1 10. Consent Agenda - Request for a one year extension of Conditional Use Permit Request C10-05, submitted by GLO Community Development Incorporated, applicant, on behalf of Eton Properties, Incorporated, property owner, to extend the expiration date of C10-05, which was approved on August 17, 2005 to permit the operation of a retirement home for individuals 62 years of age and older in accordance with Sections 31-306, 31-406 and 31-713 of the Unified Development Ordinance A motion to continue consideration of this item to the February 4, 2009, City Council meeting. Approved 7-0 11. Public Hearing - A public hearing to receive comments regarding an ordinance authorizing the lease of certain property owned by the City of Suffolk located at the Suffolk Museum Approved 7-0 12. Public Hearing - Street Vacation Request SV02-08, submitted by Jeff and Joella Barone and Tim and Deanna Davenport and Petro Ficare, property owners, for the vacation of an unimproved right of way off of Ronald Drive Approved 7-0 13. Public Hearing - Rezoning Request RZ-16A-06 (Conditional), submitted by W. David France, PE, of Kimley-Horn and Associates, Incorporated, on behalf of McDonald Ventures XXVII, LLC, property owner for a change in zoning from A, Agricultural to B-2, General Commercial District (Conditional), on parcels totaling 30.18 acres Approved with amendments 7-0 14. Public Hearing - Conditional Use Permit Request, C16-08, submitted by Arthur C. Bredemeyer of Ferguson, Rawls and Raines, PC on behalf of Boyette and Costello, LLC, property owners, for an indoor public assembly facility in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance Approved 6-0-1 (Council Member Parr abstained.) 15. Ordinances No City Council action was required. 16. Resolutions No City Council action was required. 17. Staff Report - Recycling Update No City Council action was required. 2 18. Motion - A motion to schedule a City Council Retreat for January 7 – 9, 2009 A motion to schedule a City Council Retreat for January 8-9, 2009. Approved 7-0 19. Motion - A motion to cancel the January 7, 2009, City Council Meeting Approved 7-0 20. Motion - A motion to schedule an Investiture Ceremony and Re-organizational Meeting for January 5, 2009, at 3:00 p.m., in City Council’s Chamber Approved 7-0 21. Motion - A motion to schedule a Work Session for January 21, 2009, at 4:00 p.m., unless canceled or called earlier by the mayor Approved 7-0 22.
