Council Member Milteer offered the Invocation and led the Pledge of Allegiance to the Flag. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of October 2, 2013, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Gardy, on a motion seconded by Council Member Duman, moved that the resolution be approved, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF OCTOBER 2, 2013, PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED APPROVAL OF THE MINUTES Council Member Gardy, on a motion seconded by Vice Mayor Brown, moved to approve the minutes from the September 4, 2013, Work Session and Regular Meeting, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer Parr, Ward, Brown and Johnson 8 NAYS: None 0 1 City Council Regular Meeting October 2, 2013 SPECIAL PRESENTATIONS Special Presentation – A proclamation in recognition of the 100th Anniversary of Planters in Suffolk Economic Development Director Kevin Hughes introduced the following individuals from Planters Peanuts – Dan Huss, Plant Manager; Greg Isbell, Human Resources Director; and Mr. Peanut. Mayor Johnson presented the proclamation to Mr. Huss and Mr. Isbell. Special Presentation - A proclamation in recognition of Fire Prevention Week Mayor Johnson presented the above referenced item to Fire Chief Cedric Scott, who offered remarks. Special Presentation - 36th Annual Suffolk Peanut Fest, October 10 – 13, 2013 Tourism Development Coordinator Theresa Earles introduced Butch Twiford, Chair, Peanut Festival. Mr. Brinkley reviewed the background information as printed in the official agenda. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson asked if any members of City Council wished to remove any of the Consent Agenda items for separate action. Hearing no requests for removal of any items, Mayor Johnson advised that a motion was in order at this time to adopt the agenda as presented. Council Member Gardy, on a motion seconded by Vice Mayor Brown, moved to adopt the agenda as presented. Council Member Duman advised that he would like to remove Consent Agenda Item # 7 for a separate vote. Council Member Duman, on a substitute motion seconded by Council Member Parr, moved to vote on Consent Agenda Item #7. City Clerk Dawley called for clarification about the inclusion of the adoption of the remaining agenda items. Council Member Duman, on an amended substitute motion seconded by Council Member Parr, moved to remove Consent Agenda Item #7 for a separate vote and adopt the remaining agenda as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer Parr, Ward, Brown and Johnson 8 NAYS: None 0 AGENDA SPEAKERS There were no speakers under this portion of the agenda. 2 City Council Regular Meeting October 2, 2013 CONSENT AGENDA City Clerk Dawley presented the following Consent Agenda items: Consent Agenda Item #8 - An ordinance to accept and appropriate proceeds from Cobham Composite Products as reimbursement for the Commonwealth of Virginia’s Governor’s Opportunity Fund Consent Agenda Item #9 - An ordinance to accept and appropriate funds from the Obici Healthcare Foundation for the Department of Parks and Recreation “Get Up and Get Out” After School and Summer Wellness Program for Low-income and Disadvantaged Youth Vice Mayor Brown called for an explanation of Consent Agenda Item #8 and Consent Agenda Item #9 - an ordinance to accept and appropriate proceeds from Cobham Composite Products as reimbursement for the Commonwealth of Virginia’s Governor’s Opportunity Fund and an ordinance to accept and appropriate funds from the Obici Healthcare Foundation for the Department of Parks and Recreation “Get Up and Get Out” After School and Summer Wellness Program for Low-income and Disadvantaged Youth. Council Member Gardy, on a motion seconded by Vice Mayor Brown, moved to approve the Consent Agenda, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer Parr, Ward, Brown and Johnson 8 NAYS: None 0 Mayor Johnson presented the following item: Consent Agenda Item #7 – A resolution approving an irrevocable election not to participate in the Virginia Local Disability Program Referring to Consent Agenda Item #7, Council Member Duman queried about the rate the City will receive and from whom the City will receive the rate from. Human Resources Director Nancy Olivo said that the rate will be .79%, and it will be administered by the Virginia Association of Counties. Referring to Consent Agenda Item #7, Council Member Duman asked about the term of the agreement. Human Resources Director Nancy Olivo replied the term is three years. City Clerk Dawley presented the following nominations for City Council’s consideration: Sister Cities Commission – Ninochaka Harris and Substance Abuse and Youth Council – Sylvia Douglas. Vice Mayor Brown, on a motion seconded by Council Member Duman, moved to appoint the above referenced individual to the aforementioned bodies, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer Parr, Ward, Brown and Johnson 8 NAYS: None 0 City Clerk Dawley presented the following item – a motion to submit the following names to the Office of the Governor for consideration for appointment to the Southeastern Public Service Authority Board of Directors – David Arnold, William Hutchins and Suzanne Teumer. 4 City Council Regular Meeting October 2, 2013 Council Member Milteer, on a motion seconded by Council Member Parr, moved to submit the above referenced names to the Office of the Governor for consideration for appointment to the Southeastern Public Service Authority, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer Parr, Ward, Brown and Johnson 8 NAYS: None 0 ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint presentation, Media and Community Relations Manager Timothy Kelley reported on the following activities: the Veterans of Foreign Wars Awards to Suffolk public safety personnel; the ribbon cuttings for Applied Technical Systems, Dynamic Movements, the Salvation Army’s Robert W. Harrell, Jr. Physical Health and Education Center; the Whaleyville Community Center Construction Kick-off; the United States Navy Change of Command Ceremony for Rear Admiral Gretchen Herbert and Rear Admiral Diane E. H. Weber; the graduation of the Western Tidewater Mental Health Intervention Team class; the Mass Casualty Incident Exercise Drill; the promotion of James Dickens to Deputy Fire Chief; the open burn permits; the observance of Fire Prevention Week; Suffolk Farmers Market; Touch a Truck, Train and More event at the Seaboard Station Railroad Museum; the Peanut Festival Queen’s Luncheon; the Peanut Fest Parade; the Peanut Fest; the Swamp Roar Motorcycle Rally; the Suffolk Humane Society Adopt-A-Thon; the City’s observance of the Columbus Day holiday; and the upcoming November 5th election. Council Member Fawcett extended his congratulations to those members of Suffolk Public Safety honored by the Veterans of Foreign Wars Awards. Council Member Fawcett recognized James Dickens on his promotion to Deputy Fire Chief. Council Member Fawcett advised that he attended the following events: the Early Childhood Development Commission breakfast; the Whaleyville Community Center Construction Kick-off; the 100th anniversary of Planters Peanuts and the Dynamic Movements ribbon cutting. Council Member Fawcett extended his congratulations to those recent graduates of the Western Tidewater Mental Health Intervention Team Class. Council Member Ward announced that he attended the following events: the Whaleyville Community Center Construction Kick-off; a meeting of the Pilot Club; the Floor Trade ribbon cutting; the Social Services Department adoption event and the ATS ribbon cutting. Council Member Ward advised that Mack Benn Elementary School has been recognized by the National Space and Aeronautics Administration. Council Member Gardy congratulated City Treasurer Ronald Williams on the recent United Way Golf Tournament. Council Member Gardy reported that he attended the Floor Trade ribbon cutting. Council Member Duman thanked City Administration for their assistance with various constituent issues. 5 City Council Regular Meeting October 2, 2013 Council Member Duman announced that he attended the Early Childhood Development Commission breakfast and the Mass Casualty Incident Exercise Drill. Council Member Duman encouraged residents to attend the upcoming Shrimp Feast. Council Member Milteer advised that he attended the Whaleyville Community Center Construction Kick-off and the Kings Kids event. Council Member Milteer opined about the need for speeding enforcement on Battery Avenue. Council Member Parr announced that he attended the Whaleyville Community Center Construction Kick-off. Council Member Parr thanked the Obici Healthcare Foundation for its support of the City’s ongoing wellness efforts. Council Member Parr expressed his appreciation to Police Chief Thomas Bennett for attending a recent Suffolk Redevelopment and Housing Authority meeting. Council Member Parr acknowledged Planters Peanuts on their 100th anniversary and James Dickens on his promotion to Deputy Fire Chief. Council Member Parr advised that he attended the Social Services Department adoption event. Mayor Johnson congratulated the members of the Suffolk Peanut Fest Queens Court. Mayor Johnson reported that she attended the United States Navy Change of Command for Rear Admiral Gretchen Herbert and Rear Admiral Diane E. H. Weber. Mayor Johnson acknowledged the 100th anniversary of Planters Peanuts. Mayor Johnson encouraged residents to participate in the various Peanut Fest events. Mayor Johnson opined about the region’s economy. Council Member Fawcett advised that he attended the Suffolk Cultural Arts Center fundraiser, Art D’Vine.
