Council Member Milteer offered the Invocation and led the Pledge of Allegiance to the Flag. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of December 4, 2013, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. CONSENT AGENDA City Clerk Dawley presented the following Consent Agenda items: Consent Agenda Item #7 - An ordinance to accept and appropriate funds from the Virginia Department of Motor Vehicles Animal Friendly License Plate Program for Animal Shelter Services Council Member Milteer asked for a report on Consent Agenda Item #7 - an ordinance to accept and appropriate funds from the Virginia Department of Motor Vehicles Animal Friendly License Plate Program for Animal Shelter Services. Referring to Consent Agenda Items #7, City Manager Cuffee-Glenn provided an overview of the background information as printed in the official agenda. 2 City Council Regular Meeting December 4, 2013 Council Member Parr, on a motion seconded by Council Member Duman, moved to approve the Consent Agenda, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 AN ORDINANCE TO ACCEPT AND APPROPRIATE FUNDS FROM THE VIRGINIA DEPARTMENT OF MOTOR VEHICLES ANIMAL FRIENDLY LICENSE PLATE PROGRAM FOR ANIMAL SHELTER SERVICES PUBLIC HEARINGS Public Hearing – An ordinance authorizing the issuance and sale of bonds by the City of Suffolk, Virginia, and establishing the terms, details, and provisions for the payment thereof Utilizing a PowerPoint presentation, Deputy City Manager Patrick Roberts and David Rose, Senior Vice President of Davenport and Company, the City’s financial advisors, offered a summary on the above referenced item. Donald Mills, 2122 Arizona Avenue, representing self, supported the ordinance as presented. William Harward, 3918 Manning Road, representing self, opined about the ordinance as presented. Emily Klohn, 141 Chappell Drive, representing self, supported the ordinance as presented. Hearing no additional speakers, the public hearing was closed. Council Member Gardy, on a motion seconded by Council Member Parr, moved to approve the ordinance, as presented. Referring to the presentation, Council Member Gardy asked for clarification on the proposed library’s inclusion in previous Capital Improvement Plans. Deputy City Manager Roberts affirmed that the proposed library has been in the Capital Improvement Plan for a number of years. Council Member Gardy, on a motion seconded by Council Member Parr, moved to approve the ordinance, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF BONDS BY THE CITY OF SUFFOLK, VIRGINIA, AND ESTABLISHING THE TERMS, DETAILS, AND PROVISIONS FOR THE PAYMENT THEREOF 3 City Council Regular Meeting December 4, 2013 ORDINANCES Ordinance – An ordinance to amend the Code of the City of Suffolk, Chapter 66, Personnel, concerning adding paid time off, revising the grievance panel composition, revising annual and sick leave provisions, and clarifying the term retiree health benefits Utilizing a PowerPoint presentation, Human Resources Director Nancy Olivo gave a summary of the above mentioned topic. Council Member Milteer moved to approve the ordinance as presented. The motion failed for lack of a second. Council Member Duman, on a motion seconded by Council Member Parr, moved to amend the ordinance to change the Annual Leave-Full Time Chart - Fire Suppression Personnel Chart of City Code Section 66-270 and the Paid Time Off (PTO) Chart of City Code Section 66-280.1 from years to months of service and approve the remainder of the ordinance, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 AN ORDINANCE TO AMEND THE CODE OF THE CITY OF SUFFOLK, CHAPTER 66, PERSONNEL, CONCERNING ADDING PAID TIME OFF, REVISING THE GRIEVANCE PANEL COMPOSITION, REVISING ANNUAL AND SICK LEAVE PROVISIONS, AND CLARIFYING THE TERM RETIREE HEALTH BENEFITS RESOLUTIONS Resolution – A resolution approving the issuance by the Suffolk Redevelopment and Housing Authority of its multifamily housing revenue bonds for the acquisition, construction, renovation, rehabilitation and equipping of the approximately 104 unit Wilson Pines Apartments housing facility located in the City of Suffolk, Virginia Michael W. Graff, Jr., McGuire Woods, bond counsel for Suffolk Redevelopment and Housing Authority, summarized the background information as printed in the official agenda. Council Member Gardy, on a motion seconded by Council Member Fawcett, moved to approve the resolution, as presented. Referring to the presentation, City Manager Cuffee-Glenn asked about the increase in the amount financed. Mr. Graff confirmed the new amount would be $7,500,000. Council Member Gardy, on a motion seconded by Council Member Fawcett, moved to approve the resolution, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 4 City Council Regular Meeting December 4, 2013 A RESOLUTION APPROVING THE ISSUANCE BY THE SUFFOLK REDEVELOPMENT AND HOUSING AUTHORITY OF ITS MULTIFAMILY HOUSING REVENUE BONDS FOR THE ACQUISITION, CONSTRUCTION, RENOVATION, REHABILITATION AND EQUIPPING OF THE APPROXIMATELY 104 UNIT WILSON PINES APARTMENTS HOUSING FACILITY LOCATED IN THE CITY OF SUFFOLK, VIRGINIA Resolution – A resolution adopting the City of Suffolk Transit Development Plan Utilizing a PowerPoint presentation, Public Work Director Eric Nielsen offered a summary of the background information as presented in the official agenda. Council Member Gardy, on a motion seconded by Council Member Duman, moved to approve the resolution. Referring to the presentation, Council Member Milteer opined about the provision of Saturday service. Public Works Director Nielsen advised that Saturday service is a consideration for the future dependent on available funding, and staff will make a recommendation during the annual budget process. City Clerk Dawley presented the nomination of B.J. Willie to the Suffolk Redevelopment and Housing Authority Board of Commissioners for City Council’s consideration. Wille to the Suffolk Redevelopment and Housing Authority Board of Commissioners, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 Council Member Parr, on a motion seconded by Council Member Duman, moved to receive a report on the Fairgrounds Project at the January 15, 2014, Regular Meeting, was approved by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint presentation, Media and Community Relations Manager Timothy Kelley reported on the following activities: Grand Illumination at Market Park; 2013 Legislative Dinner; new Finance Director Leonora Reid; Grandwatt Electric ribbon cutting; Suffolk holiday’s website; Painting the Town holiday event; Holiday Artisan Gift Fair; Suffolk Humane Society and Suffolk Animal Care Adopt-a-thon; A Christmas Story showing; Suffolk Holiday Parade; Meet Santa at the Suffolk Visitor Center; Santa’s Calling; Holiday Tea; and holiday crime prevention tips. Vice Mayor Brown offered congratulations to Mayor Johnson on her selection to the Governor-elect’s Transition Council on Local Government and Delegate Chris Jones’ appointment as leader of the House Appropriations Committee. 6 City Council Regular Meeting December 4, 2013 Council Member Duman congratulated Lenora Reid on her selection as Suffolk’s new Finance Director. Council Member Duman thanked LeOtis Williams for his annual turkey give-away. Council Member Duman reported on his attendance at the Suffolk Public Schools Key Communicators meeting. Council Member Duman encouraged participation in the upcoming Suffolk Humane Society Holiday Adopt-a-thon. Council Member Milteer congratulated Lenora Reid on her selection as Suffolk’s new Finance Director. Council Member Milteer opined about the speed limit on Deer Road. Council Member Parr opined about the proposed library. Council Member Parr recognized LeOtis Williams and Impact Suffolk’s turkey giveaways. Council Member Parr reported on a recent meeting with Delegate John Cosgrove. Council Member Parr congratulated Lenora Reid, Mayor Johnson and Delegate Chris Jones on their respective aforementioned achievements. Council Member Fawcett expressed appreciation to staff for assistance in Driver with banners. Council Member Fawcett opined on the Grand Illumination. Council Member Fawcett congratulated Lenora Reid on her selection as Suffolk’s new Finance Director. Council Member Fawcett reported on his attendance the Suffolk Police Department Badge Pinning Ceremony. Council Member Fawcett opined about LeOtis Williams’ annual turkey give-away. Council Member Fawcett summarized his attendance at the Suffolk Public Schools Key Communicators meeting, Grandwatt Electric ribbon cutting, and the land blessing ceremony at Mattanock Town. Council Member Fawcett congratulated Delegate Chris Jones on his appointment as leader of the House Appropriations Committee. Council Member Ward opined about the funeral of Denisheya King. Council Member Ward recounted his attendance at reported on his attendance at LeOtis Williams’ annual turkey give-away. Council Member Ward advised of various concerns of the Pughsville Civic League, specifically ditches and bears. 7 City Council Regular Meeting December 4, 2013 Council Member Ward congratulated Lenora Reid, Mayor Johnson and Delegate Chris Jones on their respective aforementioned appointments. Council Member Ward recounted his attendance at the Suffolk Public Schools Key Communicators meeting.
