Johnson, Mayor (excused) CALL TO ORDER/INVOCATION/PLEDGE OF ALLEGIANCE Vice Mayor Brown called the meeting to order and advised that Mayor Johnson was excused. Council Member Milteer offered the Invocation, and Josh Purham, Boy Scout Troop #1, led the Pledge of Allegiance to the Flag. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of September 3, 2014, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Fawcett, on a motion seconded by Council Member Parr, moved that the resolution be approved, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF SEPTEMBER 3, 2014, PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED 1 City Council Regular Meeting September 3, 2014 APPROVAL OF THE MINUTES Council Member Gardy, on a motion seconded by Council Member Milteer, moved to approve the minutes from the August 20, 2014, Work Session and Regular Meeting, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 SPECIAL PRESENTATIONS There were no items under this portion of the agenda. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Vice Mayor Brown asked if any members of City Council wished to remove any of the Consent Agenda items for separate action. Hearing no requests for removal of any items, Vice Mayor Brown advised that a motion was in order at this time to adopt the agenda as outlined. CONSENT AGENDA City Clerk Dawley presented the following items: Consent Agenda Item #7 - An ordinance conveying a 30 foot width permanent utility easement and two 10 foot wide temporary construction easements across City of Suffolk property located between Delaney Drive and the CSX Railroad Right of Way to the Hampton Roads Sanitation District Consent Agenda Item #8 - An ordinance approving new titles and job descriptions for existing positions in the City of Suffolk’s Classification and Compensation Plan 2 City Council Regular Meeting September 3, 2014 Council Member Gardy, on a motion seconded by Council Member Fawcett, moved to approve the Consent Agenda, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 PUBLIC HEARINGS Public Hearing – An ordinance to rezone and amend the official zoning map of the City of Suffolk to change the zoning from RLM, Residential Low Medium Density zoning district to B-2, General Commercial (Conditional) zoning district for property identified as a portion of Zoning Map 33A, Parcel H5, RZ03-14 (Conditional) Utilizing a PowerPoint presentation, Planning and Community Development Director D. Scott Mills summarized the background information as printed in the official agenda. Whitney Saunders, 705 West Washington Street, representing Allen Weaver of Area Development Group, Incorporated, applicant, and Bessie Boyce Gardner, property owner, spoke in support of the proposed ordinance. Hearing no additional speakers, the public hearing was closed. Council Member Gardy, on a motion seconded by Council Member Fawcett, moved to approve the conditional use permit. Referring to the presentation, Council Member Duman opined about the proposed ordinance as it relates to the next item on tonight’s agenda: an ordinance to rezone and amend the official zoning map of the City of Suffolk to change the zoning from B-2, General Commercial (Conditional) zoning district to B-2, General Commercial (Conditional) zoning district for property located at 102 Staley Drive and further identified as Zoning Map 33A, Parcel(s) AW*1, RZ04-14 (Conditional). City Attorney Holland advised that action on the two items are not dependent on one another. Referring to the presentation, Council Member Duman called for clarification about the methodology to vote on the proposed ordinance and the next item on the agenda. City Attorney Holland advised that the two items must be voted on separately. She added that the motion needed to be clarified since Council Member Gardy moved to approve a conditional use permit, but the proposed ordinance is for Rezoning Request RZ03-14. City Clerk Dawley presented the following nomination for consideration: Local Board of Building Code Appeals - Yok Kong Chiang; Parks and Recreation Advisory Board - Wayne White; and Suffolk Clean Communities Commission Keep Suffolk Beautiful Executive Board - Margaret Jones. Council Member Parr, on a motion seconded by Council Member Fawcett, moved to nominate and appoint the aforementioned individuals, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, and Brown 7 NAYS: None (Mayor Johnson was excused.) 0 5 City Council Regular Meeting September 3, 2014 ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint and video presentations, Media and Community Relations Manager Timothy Kelley reported on the following items: National Night Out Community Awards Ceremony; Suffolk Police Department Badge Pinning Ceremony; September 11th Remembrance Project Visit; Huntersville Rosenwald School Historical Marker Dedication Ceremony; enhanced customer changes in the Office of the City Assessor; Parks and Recreation Department Master Plan Community Meetings; 2014 Taste of Suffolk; and Farmer’s Market. Council Member Ward encouraged residents to attend the Huntersville Rosenwald School Historical Marker Dedication Ceremony. Council Member Ward opined about the start of the school year. Council Member Fawcett congratulated the new members of the Suffolk Police Department. Council Member Fawcett encouraged residents to attend the recycling event at Lowe’s. Council Member Fawcett congratulated those recognized at the National Night Out Community Awards. Council Member Fawcett opined about recent efforts of the Suffolk Fire and Police Departments. Council Member Fawcett expressed his condolences to the family of the late John Nelms, Jr., former Mayor. Council Member Gardy acknowledged the opening the new Pioneer Elementary School. Council Member Duman congratulated the new members of the Suffolk Police Department. Council Member Duman reported on the Suffolk Humane Society Pet Pantry and the Cut and Shears Back to School Supply Drive and Free Haircuts event. Council Member Milteer thanked City Administration for their assistance with a drainage issue at Airport and Carolina Roads. Council Member Milteer encouraged residents to attend local high school athletic events. Council Member Parr advised he attended a recent meeting of the Suffolk Redevelopment and Housing Authority. Council Member Parr thanked City Administration with the relocation of Starbucks. Council Member Parr encouraged residents to attend the Taste of Suffolk. Council Member Parr congratulated the new members of the Suffolk Police Department. Vice Mayor Brown opined on the new Pioneer Elementary School. 6 City Council Regular Meeting September 3, 2014 Council Member Milteer announced that City Manager Cuffee-Glenn would be speaking at Saint Mark’s Episcopal Church Women’s Day.
