Council Member Milteer offered the Invocation and the Pledge of Allegiance to the Flag. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of October 7, 2015, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Fawcett, on a motion seconded by Council Member Milteer, moved to approve the resolution, as presented, by the following vote: AYES: Mayor L. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson asked if any members of City Council wished to remove any Consent Agenda items for separate action. Hearing no requests for removal any of the items, Mayor Johnson advised that a motion was in order at this time to adopt the agenda as presented. CONSENT AGENDA City Clerk Dawley presented the following Consent Agenda items: Consent Agenda Item #7 - An ordinance to accept and appropriate funds from Virginia Municipal League Insurance Programs for the City of Suffolk Risk Management Program Consent Agenda Item #8 - An ordinance to accept and appropriate funds from the Virginia Department of Aviation in support of the Parallel Taxiway Project at the Suffolk Executive Airport Consent Agenda Item #9 - An ordinance to accept and appropriate a Port Security Grant from the United States Department of Homeland Security for the Suffolk Police Department 2 City Council Regular Meeting October 7, 2015 Council Member Milteer requested a summary of Consent Agenda Item #8 - an ordinance to accept and appropriate funds from the Virginia Department of Aviation in support of the Parallel Taxiway Project at the Suffolk Executive Airport. Council Member Fawcett called for summaries of Consent Agenda Items #7 and #9 - an ordinance to accept and appropriate funds from Virginia Municipal League Insurance Programs for the City of Suffolk Risk Management Program and an ordinance to accept and appropriate a Port Security Grant from the United States Department of Homeland Security for the Suffolk Police Department. Referring to Consent Agenda Items #7, #8 and #9, Interim City Manager Roberts submitted a summation of the background information as printed in the official agenda. ORDINANCES Ordinance – An ordinance authorizing the issuance and sale of revenue bonds by the City of Suffolk, Virginia, and establishing the terms, details, and provisions for the payment thereof Utilizing a PowerPoint presentation, David Rose, Senior Vice President, Davenport and Company, the City’s financial advisors, offered a summation of the background information as printed in the official agenda. Vice Mayor Bennett asked what effect, if any, the proposed ordinance would have on future water rates. Mr. Rose replied that the proposed ordinance could possibly slow the increase of rates in future years. Referring to the presentation, Council Member Duman opined about the maturity dates. Mr. Rose explained that under the terms of the proposed ordinance, the maturity of the outstanding debt would not be extended, and the final maturity of the new money would be in 30 years. Referring to the presentation, Council Member Duman called for information about the impact of the proposed ordinance on the City’s debt service out of the Utility Enterprise Fund. Mr. Rose advised that at this point, it is difficult to know the specific impact as the interest rate could change, but the anticipated impact is expected to be moderate. 3 City Council Regular Meeting October 7, 2015 Council Member Duman, on a motion seconded by Council Member Fawcett, moved to approve the ordinance, as presented, by the following vote: AYES: Mayor L. Johnson, Milteer and Ward 8 NAYS: None 0 NON-AGENDA SPEAKERS There were no speakers under this portion of the agenda. 4 City Council Regular Meeting October 7, 2015 NEW BUSINESS Mayor Johnson presented the following resolution: a resolution appointing Patrick G. Roberts as the City Manager with the following terms: an annual salary of $170,811.00; a severance of six months salary and benefits should the City Manager’s services be terminated for any reason other than for cause; $12,000.00 in deferred compensation annually and $700.00 per month in automobile allowance. Referring to the proposed ordinance, Council Member Fawcett called for clarification of the car allowance amount. Mayor Johnson restated that the proposed car allowance would be $700.00 per month. Council Member Duman, on a motion seconded by Council Member Fawcett, moved to approved the resolution appointing Patrick G. Roberts as the City Manager under the aforementioned terms, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Johnson, Milteer and Ward 8 NAYS: None 0 A RESOLUTION APPOINTING PATRICK G. ROBERTS CITY MANAGER FOR THE CITY OF SUFFOLK Council Member Duman, on a motion seconded by Council Member Fawcett, moved to have staff provide a presentation at the November 4, 2015, City Council meeting pertaining to zoning code requirements for non-commercial gardens on vacant lots and provide recommendations regarding their appropriateness, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Johnson, Milteer and Ward 8 NAYS: None 0 ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint presentation, Media and Community Relations Manager Tim Kelley reported on the following: ribbon cutting for Goodwill; the naming of Tealan Hansen as the Finance Director; the upcoming Suffolk Police Department Badge Pinning Ceremony; the upcoming Suffolk Humane Society adopt-a-thons; the upcoming Suffolk Seaboard Coastline Trail Grand Dedication; the City’s severe weather tips and updates webpage; and the City’s operating hour for the Columbus Day holiday. Council Member Johnson congratulated the Peanut Fest Queen Stasha Waterfield and members of the Queen’s Court. Council Member Johnson advised he attended the Virginia Municipal League Newly Elected Official Conference. Council Member Milteer reported he attended the Peanut Fest Queen’s Banquet. Council Member Milteer opined about the bond ordinance approved earlier tonight and the City’s overall financial health. 5 City Council Regular Meeting October 7, 2015 Council Member Fawcett congratulated the Finance Director Hansen. Council Member Fawcett reported he attended the Peanut Fest Queen’s Banquet and the Virginia Municipal League Conference. Council Member Fawcett acknowledged the new police officers who will be recognized at the upcoming Suffolk Police Department Badge Pinning. Council Member Fawcett thanked the Parks and Recreation Department for the improvements at Sleepy Hole Park. Council Member Fawcett opined about the Suffolk Seaboard Coastline Trail Grand Dedication; Shrimp Feast; and Peanut Fest. Council Member Fawcett acknowledged the Public Works Department for addressing a citizen concern in Belle Harbour Woods. Council Member Goldberg reported he attended the Virginia Municipal League Newly Elected Officials Conference. Council Member Goldberg congratulated City Manager Roberts. Council Member Goldberg encouraged residents to attend Peanut Fest. Council Member Goldberg commended all City departments on their efforts during the recent storm. Council Member Ward advised he attended the Peanut Feast Queen’s Luncheon and the Virginia Municipal League Annual Conference. Council Member Duman opined about cancellations of various events due to inclement weather. Council Member Duman encouraged residents to attend Shrimp Feast. Council Member Duman congratulated Finance Director Hansen and City Manager Roberts. Vice Mayor Bennett congratulated Finance Director Hansen and City Manager Roberts. Vice Mayor Bennett advised he attended the Virginia Municipal League Annual Conference. Vice Mayor Bennett thanked Mr. Rose for his presentation. Vice Mayor Bennett reported a drainage issue on Nansemond Parkway near Hargrove Landing and 84 Lumber. Vice Mayor Bennett expressed his sympathy for those impacted by flooding in South Carolina. Mayor Johnson congratulated Finance Director Hansen and Peanut Fest Queen Stasha Waterfield. 6 City Council Regular Meeting October 7, 2015 Mayor Johnson opined about the Suffolk Seaboard Coastline Trail; the Lake Meade Trail; and the Driver Days celebration. Mayor Johnson thanked Mr. Rose for his presentation. Mayor Johnson encouraged residents to attend Peanut Fest. Mayor Johnson congratulated City Manager Roberts.
