City Council Regular Meeting June 21, 2017 Regular Meeting of the Suffolk City Council was held in the City Council Chamber, 442 West Washington Street, on Wednesday, June 21, 2017, at 7:00 p.m. PRESENT Council Members - Linda T. PUBLIC HEARINGS Public Hearing – An ordinance to grant a Conditional Use Permit to establish a daycare, child (as accessory use to permitted place of worship or school), on property located at 2460 Pruden Boulevard, Zoning Map 25A, Parcel 1*A; C05-17 Utilizing a PowerPoint presentation, Planning and Community Development Director David Hainley supplied a summary of the background information as printed in the official agenda. David Sexton, no address provided, Pastor, CrossPointe Freewill Baptist Church, applicants and property owners, spoke in support of the proposed ordinance, as presented. Hearing no additional speakers, the public hearing was closed. 2 City Council Regular Meeting June 21, 2017 Council Member Duman, on a motion seconded by Council Member Goldberg, moved to approve the ordinance, with conditions, as presented. Referring to the presentation, Council Member Milteer queried about the number of students at the proposed daycare. Planning and Community Development Director Hainley said that the applicant would be limited to a maximum of 50 students. Referring to the presentation, Council Member Milteer opined about the applicant’s compliance with all State regulations regarding daycare facilities. Planning and Community Development Director Hainley replied in the affirmative. Council Member Duman, on a motion seconded by Council Member Goldberg, moved to approve the ordinance, with conditions, as presented, by the following vote: AYES: Mayor L. Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Vice Mayor Bennett solicited clarification about the structure included in the proposed ordinance. Planning and Community Development Director Hainley reported that the two-story building is only one included in the proposed ordinance. Johnson, Milteer and Ward 8 NAYS: None 0 3 City Council Regular Meeting June 21, 2017 AN ORDINANCE TO GRANT A CONDITIONAL USE PERMIT TO RESTORE AND RENOVATE A NON-CONFORMING USE AND STRUCTURE WHICH EXCEEDS FIFTY PERCENT OF THE REPLACEMENT COST, ON PROPERTY LOCATED AT 2231 EAST WASHINGTON STREET, ZONING MAP 3, PARCEL(S) 159A; C06-17 Public Hearing – An ordinance to grant a Conditional Use Permit to establish a truck stop/travel plaza on property located at 2400 and 2410 Holland Road, Zoning Map 32B, Parcel(s) 3*1 and 3*2; C07-17 Utilizing a PowerPoint presentation, Planning and Community Development Director Hainley gave a report on the background information as printed in the official agenda. Brad Alsup, 5580 Loomis Road, Knoxville, Tennessee, Pilot Travels Center, LLC, applicants, representing CenterPoint Properties Trust, spoke in support of the proposed ordinance, as presented. Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Council Member Fawcett opined about the hours of operation of the proposed facility. Mr. Alsup indicated that the proposed facility will operate 24 hours. Referring to the presentation, Council Member Fawcett queried about the exit from the proposed facility. Mr. Alsup stated that the trucks would exit from Ace Drive onto the CenterPoint Drive. Referring to the presentation, Council Member Johnson asked about the type of buffer that would be between the proposed facility and the adjacent neighborhood. Mr. Alsup said that a vegetative buffer would be installed between the proposed facility and the adjacent neighborhood. Referring to the presentation, Council Member Johnson called for clarification about the ability to take left turns onto Holland Road from the proposed facility. Mr. Alsup explained that no left turns will be permitted onto Holland Road from the facility. Council Member Johnson, on a motion seconded by Council Member Milteer, moved to approve the ordinance, with conditions, as presented: AYES: Mayor L. Doug Davis, no complete address provided, Virginia Beach, spoke in support of the proposed ordinance, as presented. Whitney Saunders, 705 West Washington Street, Saunders and Ojeda, P.C., representing Moore’s Point, LLC, property owner, spoke in support of the proposed ordinance, as presented. Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Council Member Milteer opined about matter of encroachment on adjacent property owners. Mr. Saunders stated that no adjacent property owners will be impacted. Referring to the presentation, Council Member Milteer queried about the property owners willingness to meet with the adjacent property owners. Mr. Saunders replied in the affirmative. Referring to the presentation, Mayor Johnson solicited information about the outcome of the survey as it relates to the property lines. Mr. Saunders said that the survey would advise where the property lines are located. Referring to the presentation, Council Member Fawcett sought an explanation about the proposed surety bond. Referring to the map included in the background information printed in the official agenda, Mr. Saunders reviewed the area covered by the surety bond and added that the bond would be in effect for one year. Referring to the presentation, Council Member Fawcett asked if the proposed surety bond was currently in place. Mr. Saunders replied that the matter is under discussion, and the amount of the bond will be determined after City Council takes action on the proposed ordinance. Referring to the presentation, Vice Mayor Bennett inquired about the feasibility of installing a permanent secondary exit onto Nansemond Parkway. Mr. Saunders deferred to City staff to address this matter. Traffic Engineer Robert Lewis reported that the access will be a permanent wide sidewalk for emergency access. He added that the subdivision does will not meet the warrants of the Virginia Department of Transportation or the City for a public road. Referring to the presentation, Vice Mayor Bennett requested information about the timeline for access from the proposed subdivision and Portsmouth Boulevard. Mr. Saunders said that access to Portsmouth Boulevard would be immediate. 5 City Council Regular Meeting June 21, 2017 Referring to the presentation, Council Member Duman asked if the applicant had all of the necessary permits. Mr. Saunders replied in the affirmative. Referring to the presentation, Council Member Duman queried about the timeline for the construction of the entrance for the proposed subdivision. Mr. Saunders advised that the entrance would be constructed within the year. Referring to the presentation, Council Member Duman opined about the applicant’s willingness to add a following condition to the proposed ordinance - The required secondary access to Portsmouth Boulevard be completed within one year from the date of the approval of the subdivision variance. Mr. Saunders said that the applicant would be amendable to the addition of the aforementioned condition. Council Member Duman, on a motion seconded by Council Member Goldberg, moved to approve the proposed ordinance with condition number one as presented and the addition of the following condition - The required secondary access to Portsmouth Boulevard be completed within one year from the date of the approval of the subdivision variance, by the following vote: AYES: Mayor L. Hearing no speakers, the public hearing was closed. Referring to the presentation, Council Member Goldberg opined about the recommendations from the Planning Commission. Planning and Community Development Director Hainley said that that City Council requested an ordinance that would provide City staff with the authority to address accessory uses and structures. He added that the Planning Commission amended this request and recommended that accessory uses and structures be addressed through the Planning Commission and City Council. 6 City Council Regular Meeting June 21, 2017 Referring to the presentation, Council Member Fawcett asked about the square footage of the accessory structures that City Council has considered over the past year. Planning and Community Development Director Hainley stated that the average square footage of the accessory structures that City Council has considered over the past year was 800 square feet. Referring to the presentation, Council Member Fawcett called for clarification of the taxation status of accessory structures. Planning and Community Development Director Hainley reported that accessory structures are subject to real estate taxes. Referring to the presentation, Council Member Fawcett queried about the feasibility of enforcement as it relates to possible rental of accessory structures. Planning and Community Development Director Hainley indicated that it is difficult to enforce issues regarding rental of accessory structures. Referring to the presentation, Council Member Milteer queried about the status of the conditional use permit for an accessory structure in the event that the property owner dies. Planning and Community Development Director Hainley said that if a property owner dies, the conditional use permit authorizing the accessory structure remains in effect. Referring to the presentation, Mayor Johnson opined about the creation of a two family situation in a single family dwelling, should accessory structures be considered administratively. Planning and Community Development Director Hainley advised that the effect on density was discussed by the Planning Commission. Referring to the presentation, Council Member Ward asked about any limitations on the number of individuals that could reside in an accessory structure. Planning and Community Development Director Hainley stated that he would need to research that matter. Deputy City Manager D. Scott Mills said that according to the United States Housing and Urban Development Department, the requirement is 200 square feet per person, and the proposed ordinance would eliminate that requirement. Referring to the presentation, Council Member Ward opined about the enforcement of the number of individuals that reside in an accessory structure. Planning and Community Development Director Hainley advised violations of this nature would be addressed through enforcement. Referring to the presentation, Council Member Goldberg called for clarification about the inclusion of impervious materials requirements in the City’s Unified Development Ordinance. Planning and Community Development Department Hainley explained that the proposed ordinance would not supersede the City’s current requirement as they relate to impervious materials requirements. Council Member Duman moved to approve the proposed ordinance with the proposed amendments: to allow for attached accessory structures by administrative approval in lieu of a conditional use permit in all permitted zoning designations; to allow for the detached accessory structures by administrative approval in lieu of a conditional use permit in the A, Agricultural, RR, Rural Residential and RE, Rural Estate zoning designations; retain the language regarding the restriction that the apartment shall not be offered to the general public for rental purposes; remove the proposed requirement that accessory dwelling units shall be occupied only by persons either related by blood, marriage or adoption to the occupants of the principal dwelling and to include language that would require occupancy of the occupancy of the accessory dwelling unit shall not exceed one person per 200 square feet as a maximum. 7 City Council Regular Meeting June 21, 2017 Vice Mayor Bennett called for consideration of any amendments would be considered at the July 19, 2017, City Council meeting. Council Member Duman said that the intent of the motion is to consider the proposed amendments at the July 19, 2017, City Council meeting. Referring to the presentation, Council Member Johnson asked about the cost for an application for an accessory structure if it was approved administratively. City Manager Roberts said that the application would be $35.00. Referring to the presentation, Mayor Johnson opined about the validity of a conditional use permit in the event that a parcel is sold. Planning and Community Development Director Hainley explained that if a parcel is sold, the conditional use permit remains in place. Mayor Johnson asked Council Member Duman to restate his motion - Council Member Duman moved to continue consideration of the proposed ordinance to the July 19, 2017, City Council meeting with the following amendments – to allow for attached accessory structures by administrative approval in lieu of a conditional use permit in all permitted zoning designations; to allow for the detached accessory structures by administrative approval in lieu of a conditional use permit in the A, Agricultural, RR Rural Residential and RE, Rural Estate zoning designations; retain the language regarding the restriction that the apartment shall not be offered to the general public for rental purposes; remove the proposed requirement that accessory dwelling units shall be occupied only by persons either related by blood, marriage or adoption to the occupants of the principal dwelling and to include language that would require occupancy of the occupancy of the accessory dwelling unit shall not exceed one person per 200 square feet as a maximum Referring to the motion, City Attorney Holland recommended the following language as it relates to the matter of rental of an accessory dwelling unit – the accessory dwelling unit shall not be offered for rental purposes. The maker of the motion consented to this change. Council Member Duman, on a motion seconded Council Member Ward, moved to continue consideration of the proposed ordinance to the July 19, 2017, City Council meeting with the following amendments – to allow for attached accessory structures by administrative approval in lieu of a conditional use permit in all permitted zoning designations; to allow for the detached accessory structures by administrative approval in lieu of a conditional use permit in the A, Agricultural, RR Rural Residential and RE, Rural Estate zoning designations; revise the language regarding the restriction that the accessory dwelling unit shall not be offered for rental purposes; remove the proposed requirement that accessory dwelling units shall be occupied only by persons either related by blood, marriage or adoption to the occupants of the principal dwelling and to include language that would require occupancy of the occupancy of the accessory dwelling unit shall not exceed one person per 200 square feet as a maximum, by the following vote: AYES: Mayor L. Council Member Milteer, on a motion seconded by Vice Mayor Bennett, moved to approve the ordinance, as presented. Referring to the presentation, Council Member Johnson asked if the proposed ordinance would facilitate the timeline for land use applications. Planning and Community Development Director Hainley replied in the affirmative. Referring to the presentation, Council Member Duman queried about the requirement for site plan review waiver as it relates to the proposed ordinance. Planning and Community Development Director Hainley replied in the affirmative. Referring to the presentation, Council Member Duman sought additional information about the approval process for a site plan review waiver. Planning and Community Development Director Hainley said that he would review all waivers with input from the Public Works Department.
