FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of February 6, 2019, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Rashad Lewis, 87 Stacy Drive, was not present when called. Reginald Copeland, 201 Lee Street, Apartment 119, was not present when called. Justin Irby, 124 ½ Wellons Street, was not present when called. Jyante Lewis, 124 ½ Wellons Street, was not present when called. Kanetrica Williams, 417 Jackson Street, was not present when called. Jonathan Williams, 417 Jackson Street, was not present when called. Kelly Hengler, 9345 Eclipse Drive, representing self, opined about the possibility of establishing historical designations for the villages of Crittenden and Eclipse. NEW BUSINESS City Clerk Dawley presented the following board and commission nomination for City Council’s consideration: Economic Development Authority of the City of Suffolk – John Clifton Harrell, Jr. (Suffolk Borough representative) and Maria Herbert (Nansemond Borough representative). Council Member Fawcett, on a motion seconded by Council Member Ward, moved to nominate and appoint the above referenced individuals to the aforementioned body, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Johnson, Milteer and Ward 8 NAYS: None 0 Council Member Duman, on a motion seconded by Council Member Goldberg, moved to direct City Attorney Holland to draft an ordinance to amend City Code Section 34-189(10) to amend the hours of construction noise prohibition from between the hours of 10:00 p.m. to 6:00 a.m. to between the hours of 10:00 p.m. to 7:00 a.m. Mayor Johnson asked about the various ending times for other localities. Council Member Duman advised that the ending times varied in surrounding localities. He added that he spoke with Tidewater Builders Association about the proposed amendment and they did not have any objections. Council Member Fawcett asked whether the ending time could be changed to 9:00 p.m. Council Member Duman, on a motion seconded by Council Member Goldberg, moved to direct City Attorney Holland to draft an ordinance to amend City Code Section 34-189(10) to amend the hours of construction noise prohibition from between the hours of 10:00 p.m. to 6:00 a.m. to between the hours of 10:00 p.m. to 7:00 a.m., by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Johnson, Milteer and Ward 8 NAYS: None 0 4 City Council Regular Meeting February 6, 2019 ANNOUNCEMENTS AND COMMENTS Utilizing a PowerPoint presentation, Media and Community Relations Assistant Director Timothy Kelley reported on the following: a public survey seeking citizen input regarding transit services; public informational meeting regarding the Route 17/Bridge Road and Shoulders Hill Road Intersection improvement project; the temporary road closure of Route 460/Pruden Boulevard due to construction work; the various activities sponsored by Suffolk Public Libraries in recognition of Black History Month; the Suffolk Parks and Recreation Department’s 757 Protégé-Suffolk Mentoring Program; upcoming Suffolk Humane Society’s adopt-a-thons; and the City’s observance of President’s Day. Council Member Goldberg acknowledged Steve Ely, President, Westside Civic League, who was in attendance. Council Member Goldberg opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Council Member Goldberg reported he attended the Suffolk Humane Society’s Paws for the Arts Gala. Council Member Fawcett opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Council Member Fawcett announced he attended the Suffolk Humane Society’s Paws for the Arts Gala. Council Member Milteer opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Council Member Duman opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Council Member Duman advised that the Western Tidewater Regional Jail would require level funding for the upcoming year. Council Member Duman reported he attended the Suffolk Humane Society’s Paws for the Arts Gala. Council Member Duman announced the upcoming Black History Month programs at the Suffolk Public Library. Council Member Duman supplied information about Senate Bill 1025 regarding dog tethering. Council Member Duman opined about the energy saving performance contract as it relates to Suffolk Public Schools. Council Member Ward opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Council Member Ward announced he attended the following: the Urban League of Hampton Roads, Incorporated Annual Dr. Martin Luther King, Jr. Day Community Leaders' Breakfast; Metropolitan Baptist Church Dr. Martin Luther King, Jr. Day event and First Baptist Church Bute Street Dr. Martin Luther King, Jr., Day event. 5 City Council Regular Meeting February 6, 2019 Council Member Johnson reported that he attended the Suffolk Art League’s Annual Exhibit of Excellence and the Suffolk Sister Cities International Commission Young Artists and Authors Showcase. Council Member Johnson encouraged residents to attend the upcoming Black History Month programs at the Suffolk Public Library. Council Member Johnson announced he attended the Suffolk Humane Society’s Paws for the Arts Gala. Council Member Johnson opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Vice Mayor Bennett opined about the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Vice Mayor Bennett encouraged residents to participate in the public survey seeking citizen input regarding transit services. Vice Mayor Bennett opined about the upcoming Boys and Girls Club of Southeast Virginia 100th Anniversary Dinner. Mayor Johnson reviewed the Work Session regarding the proposed Fiscal Year 2020-2029 Capital Improvements Program and Plan. Mayor Johnson encouraged residents to support the 757 Protégé-Suffolk Mentoring Program. Mayor Johnson reported on the failure of the Equal Rights Amendment in the General Assembly. Mayor Johnson opined about the energy saving performance contract as it relates to Suffolk Public Schools. Council Member Fawcett, on a motion seconded by Vice Mayor Bennett, moved to adjourn, by the following vote: AYES: Mayor L.
