Mayor Johnson said that the motion needs to be amended to reflect that during the Work Session, City Council approved a motion to move the presentation regarding the fiscal impact of real estate tax exemption for surviving spouses of certain emergency service providers to Staff Reports. STAFF REPORTS Staff Report - Fiscal Impact of Real Estate Tax Exemption for Surviving Spouses of Certain Emergency Service Providers Utilizing a PowerPoint presentation, Finance Director Tealen Hansen offered a summation on the above referenced item. 6 City Council Regular Meeting July 17, 2019 Council Member Duman inquired about the effective date for the real estate tax exemption. Finance Director Hansen said that the real estate tax exemption was approved in 2016 and took effect in 2017. Referring to the presentation, Council Member Duman asked whether the fiscal impact information presented was the annual amount. Finance Director Hansen replied in the affirmative. Referring to the presentation, Council Duman asked if the three real estate tax exemptions granted by the City of Chesapeake were the highest number to date. Finance Director Hansen replied in the affirmative. Council Member Duman asked if the City real estate tax exemption was limited to the amount of the house. Finance Director Hansen replied in the affirmative. Council Member Duman called for clarification about the entity that determines whether an employee’s death is a result of their job. City Attorney Holland explained that the Virginia Retirement System is the agency responsible for determining if an employee’s death is a result of their job. She added that they do not any determining authority regarding the real estate exemption. Council Member Duman asked if a locality would be the agency that determines if an employee’s death is a result of their job. City Attorney Holland replied that a locality would not be the agency that determines if an employee’s death is a result of their job. Council Member Goldberg opined about any new information since City Council last discussed the possible real estate tax exemption. City Attorney Holland stated that nothing has changed in the context of the real estate tax exemption since the last time this matter was discussed, but the Virginia Retirement System has added specific illnesses that can be considered when determining a line of duty death. She added that attorneys statewide are planning to form a work group to discuss this matter. Vice Mayor Bennett asked if the real estate tax exemption applies to employees who live and work in the City of Suffolk. Finance Director Hansen said that the real estate tax exemption applies to all employees that are in the Virginia Retirement System. City Attorney Holland reiterated this information. Mayor Johnson asked if the real estate tax exemption is permitted statewide. City Attorney Holland replied in the affirmative. Council Member Milteer asked if the cause of death would have to be while the employee is at work, in order to qualify for the real estate tax exemption. City Attorney Holland reported that the employee would not have to die at work in order to qualify for the real estate tax exemption. She added that there are presumptive illness that could qualify an employee’s death as a result of his or her job. Council Member Milteer opined about an employee’s exposure to certain chemicals that could result in cancer. City Attorney Holland advised that the Virginia Retirement System is the agency that would determine any link between an employee’s death and their work environment under the Line of Duty Act. Mayor Johnson asked if the Virginia Retirement System deleted any categories of employees who would be eligible for the real estate tax exemption under the Line of Duty Act. City Attorney Holland said that no categories of employees eligible for the real estate tax exemption under the Line of Duty Act were eliminated. 7 City Council Regular Meeting July 17, 2019 Council Member Duman asked what action City Council could take if the real estate tax exemption was approved, and it became financially burdensome. City Attorney Holland explained that should City Council approve the real estate tax exemption and it became financially burdensome, City Council could repeal the real estate tax exemption or place a moratorium on the real estate tax exemption. Council Member Duman moved to direct City Attorney Holland to prepare an ordinance in accordance with State Code of Virginia Section 58.1-3219.14. The motion failed for lack of a second. Council Member Fawcett opined about the eligibility of employees to qualify for the real estate tax exemption, if the employee is originally from out of state. City Attorney Holland indicated that she would have to research that matter, however, the Virginia Retirement System would be the agency that would determine if an employee qualified for the real estate tax exemption. Council Member Fawcett moved to table further consideration of the Line of Duty Act exemption for 60 days. The motion failed for lack of a second. Members of City Council opined about the real estate tax exemption permitted under the Line of Duty Act. Referring to the presentation, Council Member Duman asked if the number of employees that have received the real estate tax exemption region-wide represent all of the categories of employees eligible for the real estate exemption, per the State Code. Finance Director Hansen said that all of the employees that have received the real estate tax exemption region-wide represent the people who have actually applied. Council Member Duman, on a motion seconded by Council Member Ward, moved to direct City Attorney Holland to prepare an ordinance in accordance with State Code of Virginia Section 58.1-3219.14. Members of City Council opined about the real estate tax exemption permitted under the Line of Duty Act. Council Member Ward asked about the meaning of the acronym VRS. City Attorney Holland replied that VRS is the acronym for the Virginia Retirement System. Council Member Ward sought clarification about eligibility for the real estate tax exemption. City Attorney Holland stated that the spouse of an employee would be eligible for an exemption on their real estate taxes in the municipality that the home is located. Council Member Ward asked whether the real estate tax exemption could be received if the first responder who applied was from another state. City Attorney Holland said she would research the matter, but the applicant would have to comply with the Line of Duty Act. Referring to the motion, Mayor Johnson asked when City Attorney Holland could present the ordinance for consideration.
