Vice Mayor Bennett, on a motion seconded by Council Member Fawcett, moved to approve the ordinance, by the following roll call vote: AYES: Mayor Duman, Vice Mayor Bennett, and Council Members Butler Barlow Fawcett, Goldberg, Johnson, Ward and Williams 8 NAYS: None 0 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF BONDS BY THE CITY OF SUFFOLK, VIRGINIA, AND ESTABLISHING THE TERMS, DETAILS, AND PROVISIONS FOR THE PAYMENT THEREOF Public Hearing - An ordinance authorizing the realignment of the Suffolk Transit bus routes to increase the timeliness of the buses, increase reliability, maximize existing routes and better meet the needs of the riders of Suffolk Transit Utilizing a PowerPoint presentation, Transit Manager Maria Ptakowski submitted a report on the background information as printed in the official agenda. Hearing no speakers, the public hearing was closed. 3 City Council Regular Meeting August 18, 2021 Referring to the presentation, Council Member Ward called for clarification about the inclusion of the North Suffolk Library on the proposed pink line. Transit Manager Ptakowski replied in the affirmative. Council Member Goldberg queried about the feasibility of new bus shelters. Transit Manager Ptakowski explained that the City is working on seeking federal funding to replace bus shelters. Council Member Goldberg inquired about a transit route from Suffolk to the Holland/Windsor/Franklin areas. Transit Manager Ptakowski said that as of now, there is no such route, but the City is working towards offering some type of connecting service in the future. Council Member Goldberg moved to approve the ordinance, as presented. The motion failed to receive a second. Council Member Williams sought information about the City’s transit fare system. Transit Manager Ptakowski reported that there are variety of transit fare classifications, including seniors, disabled residents, adult and student rates and monthly passes. City Attorney Hutchings stated that the proposed ordinance does not include any conditions, because it is for a rezoning. Interim Planning and Community Development Director Goumas added that the next proposed ordinance is for a conditional use permit, which is a companion piece to this item and would include conditions. Interim Planning and Community Development Director Goumas offered a synopsis of the background information as printed in the official agenda. 9 City Council Regular Meeting August 18, 2021 Council Member Williams, on a motion seconded by Council Member Ward, moved to approve the ordinance as presented. Referring to the distributed handout, Council Member Butler Barlow opined about correspondence from Mr. Bob Arnette, Managing Member, Meadows Landing Associates, LLC, regarding the property and asked about follow up with Mr. Cross. Mr. E. Grier Ferguson, attorney for applicant, reported that there is a contract on the property. He elaborated that the 25% owner of the property has come forward, but no agreement has been reached with that property owner. Council Member Goldberg asked whether there was a signed contract for the property. Mr. Ferguson replied that a contract exists with Thomas Cross, his brother and his sister. Thomas Cross, 2562 Jackson Road, on behalf of his father, was recognized to speak by Mayor Duman. Mr. Cross said he never had an opportunity to see a contract for the land. Mayor Duman opined that the matter might be a civil affair. City Attorney Hutchings advised that in order for the ordinance to move forward, certification that the application is complete and that all parties have signed the application is required from the Interim Planning Director. Mayor Duman asked for whether such certification exists. Interim Planning Director Goumas was unable to certify the completeness of the application at this time. Mayor Duman solicited information about the feasibility of continuing consideration of the proposed ordinance to the next meeting. City Attorney Hutchings advised that City Council cannot move forward on the proposed ordinance until the application is certified. Mayor Duman asked whether it could be continued administratively or if City Council would need to act. City Attorney Hutchings advised that City Council would need a motion to continue consideration of the proposed ordinance. Council Member Goldberg inquired about the application process for the current ordinance. City Attorney Hutchings said that all property owners need to sign onto the application for the action to be considered valid. Council Member Goldberg asked about the process should staff certify the application tomorrow. City Attorney Hutchings advised that City Council could act on the ordinance at the next City Council meeting. Council Member Fawcett opined about the completeness of the application. Mayor Duman solicited information about the events, should a property owner want to withdraw consent from an application before it is approved. City Attorney Hutchings explained that there are three ways to rescind a rezoning: by City Council action, by Planning Commission action or by the property owner. Council Member Goldberg asked whether a civil suit might occur. City Attorney Hutchings replied that it was possible. 10 City Council Regular Meeting August 18, 2021 Council Member Williams and Council Member Ward withdrew the motion to approve the ordinance, as presented.
