Council Member Goldberg offered the Invocation and led the Pledge of Allegiance. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of January 19, 2022, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Fawcett, on a motion seconded by Council Member Williams, moved to approve the resolution, as presented, by the following roll call vote: AYES: Mayor Duman, Vice Mayor Bennett, and Council Members Butler Barlow Fawcett, Goldberg, Johnson, Ward and Williams 8 NAYS: None 0 A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF JANUARY 19 2022, PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED 1 City Council Regular Meeting January 19, 2022 APPROVAL OF THE MINUTES Council Member Goldberg, on a motion seconded by Council Member Johnson, moved to approve the minutes from the July 21, 2021, Work Session and Regular Meeting, as presented, by the following roll call vote: AYES: Mayor Duman, Vice Mayor Bennett, and Council Members Butler Barlow Fawcett, Goldberg, Johnson, Ward and Williams 8 NAYS: None 0 SPECIAL PRESENTATIONS There were no items under this portion of the agenda. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Duman said that a motion was in order at this time to adopt the agenda, as presented. He then advised that City Manager Moor had additional information for City Council. City Manager Moor announced that the applicant for Public Hearing Item #16 - An ordinance to rezone and amend the official zoning map of the City of Suffolk, to change the zoning from RLM, Residential Low Medium Density zoning district, to RU-18, Residential Urban-18 (Conditional) zoning district, for property located at 5100 Nansemond Parkway, Zoning Map 20, Parcel 19, Account Number 303740000; RZN2021-015 (Conditional) – has withdrawn the application, and the agenda needed to be amended to remove Public Hearing Item #16 and adopt the remainder of the agenda as presented. Mayor Duman reiterated to those in attendance that the applicant for RZN2021-015 has withdrawn the request for rezoning. 3 City Council Regular Meeting January 19, 2022 Public Hearing – An ordinance to grant a Conditional Use Permit to amend the previously approved conditions pertaining to the establishment of a Daycare, and Child Day Center, on property located at 3215 Bridge Road, Suite 3B & 4, Zoning Map 12, Parcel 12I, Account Number 304380200; CUP2021- 022 Utilizing a PowerPoint presentation, Interim Planning and Community Development Director Kevin Wyne provided a synopsis of the background information as printed in the official agenda. Carl and Melvina Williams, 300 Princess Arch, applicant, on behalf of Mountainview Bennnett’s Creek LLC and Club Forest Bennett’s Creek, LLC, property owners, spoke in support of the ordinance as presented. Wallace Johnson, 2086 Nansemond Parkway, representing self, spoke in support of the ordinance as presented. Hearing no additional speakers, the public hearing was closed. Whit Harper, no address provided, Saunders and Ojeda, P.C., representing Alice Fuller, property owner, spoke in support of the appeal Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Council Member Goldberg asked the applicant to summarize her appeal. Ms. Fuller advised that the roof is leaking, so she is concerned about mold. Council Member Goldberg, on a motion seconded by Council Member Fawcett, moved to reverse the decision of the Historic Landmarks Commission. 4 City Council Regular Meeting January 19, 2022 Referring to the presentation, Mayor Duman asked whether the proffered shingles were the same color as the existing roof. Mr. Harper replied in the affirmative. NEW BUSINESS City Clerk Dawley presented the following board and commission nomination: Economic Development Authority of the City of Suffolk (Chuckatuck borough) – John Broderick Council Member Butler Barlow, on a motion seconded by Council Member Fawcett, moved to nominate and appoint the above referenced individual to the aforementioned body, by the following roll call vote: AYES: Mayor Duman, Vice Mayor Bennett, and Council Members Butler Barlow Fawcett, Goldberg, Johnson, Ward and Williams 8 NAYS: None 0 ANNOUNCEMENTS AND COMMENTS Utilizing a PowerPoint presentation, Interim Media and Community Relations Director Timothy Kelley provided a report on the following: the winter storm preparations; appointment of Alfred S. Chandler, Jr. as Police Chief; Suffolk Police Department’s Badge Pinning; the Finance Department’s award for the Popular Annual Finance Report from the Government Finance Officers Association; Suffolk Public Library’s 5th Annual Winter Reading Challenge; and the Commonwealth’s coronavirus vaccination finder website and customer service number. Council Member Butler Barlow reported she attended the Chuckatuck Oakland Civic League meeting. Council Member Johnson congratulated Police Chief Chandler. Council Member Johnson warned of incoming winter weather. Council Member Fawcett warned of incoming winter weather. Council Member Williams summarized a COVID-19 community testing event. Council Member Williams acknowledged the efforts of the Media and Community Relations Department. Council Member Williams City Manager Moor provide a report about the addition of curb and sidewalks in the Pleasant Hill area as it relates to American Rescue Plan funding. City Manager Moor summarized that staff is working to get the projects City Council considered designed and underway. Council Member Goldberg congratulated Police Chief Chandler. Council Member Goldberg warned of incoming winter weather. Council Member Ward congratulated Police Chief Chandler. 6 City Council Regular Meeting January 19, 2022 Council Member Ward extended appreciation for the addition of a third redistricting map for consideration. Vice Mayor Bennett asked for an update on the Portsmouth Boulevard sidewalk project. City Manager Moor reported that a waterline was found. He further explained that there were delays in receiving material, but work is back on track, weather permitting. Vice Mayor Bennett congratulated Police Chief Chandler. Vice Mayor Bennett opined about the Suffolk Police Department Badge Pinning ceremony. Vice Mayor Bennett announced he attended the East Suffolk Recreation Center COVID-19 testing event. Vice Mayor Bennett warned of incoming winter weather. Mayor Duman congratulated Police Chief Chandler. Mayor Duman reported on the Oath of Office Ceremony for Commonwealth’s Attorney Narendra Pleas.
