City Attorney Hutchings advised that the amended ordinance meets the requirements of the Open Space Land Act and explained that staff in the Office of the City Attorney worked to ensure the recordation would be accurate. Council Member Johnson asked whether the funding was approved previously and the reason it was not spent already. Interim Budget Director Meek advised that the funding was approved in the prior year. He further stated that the monies were not spent and need to be reallocated. Council Member Johnson inquired about the feasibility of allocating Suffolk Public Schools less money. Interim Budget Director Meek advised the money was in a restricted fund. Council Member Johnson solicited a reason the money was not spent. Interim Budget Director Meek theorized there may have been supply chain issues. Suffolk Public Schools Chief Financial Officer Wendy Forsman added that CARES Act money was already budgeted and encumbered, but the items ordered did not show up until the follow year. Subsequently, Suffolk Public Schools is required to request the funds be reallocated. Council Member Rector asked about the status of the funds. Suffolk Public Schools Chief Financial Officer Forsman advised that the federal funding is reimbursable, i.e. the school system purchases products and services, and the federal government reimburses them. Council Member Williams asked about the deadline to spend the funding. Suffolk Public Schools Chief Financial Officer Forsman said September 30 is the deadline. Council Member Williams inquired about the future of funding. Suffolk Public Schools Chief Financial Officer Forsman advised that they submit requests for reimbursement from the federal government every 30 days and will have monies committed by August 1, 2024. Planning and Community Development Director Wyne advised in the affirmative and said there would be an addition to the site. NEW BUSINESS City Clerk Dawley presented the following nominations for appointment to the respective bodies: Economic Development Authority of the City of Suffolk Cypress Borough – Wesley King and Fine Arts Commission – Christine Rupsch Council Member Johnson, on a motion seconded by Council Member Bennett, moved to nominate and appoint the aforementioned individuals to the respective bodies, as presented, by the following vote: AYES: Mayor Duman, Vice Mayor Ward, and Council Members Bennett, Butler Barlow, Fawcett, Johnson, Rector and Williams 8 NAYS: None 0 Council Member Fawcett, on a motion seconded by Vice Mayor Ward, moved “that a second absentee ballot precinct be established in the north end area of the City to be used with the November 2024, General Election and that the Registrar be requested to identify a suitable location no later than March 18, 2024; further the City Manager shall report a location to City Council as it meets on March 20th in order to publicly have the hearing that would occur May the 1st.” Council Member Bennett asked whether implementation is feasible this late in the election year. City Manager Moor said the memo from the Electoral Board outlines additional cost and personnel, but more discussion would need to occur. 9 City Council Regular Meeting February 21, 2024 Council Member Butler Barlow inquired if the motion directs another precinct be established or asks for recommendation about the establishment for a second absentee precinct. Council Member Fawcett clarified that the motion requests the Electoral Board to establish a second absentee precinct. Council Member Rector requested information regarding City Council’s authority to make such a request. City Attorney Hutchings advised that City Council has the authority to make the request, but the Registrar must certify that the location meets legal requirements. He further explained that the City pays for voting machines and people who work the elections. City Attorney Hutchings summarized that while the City Council can make such requests, there are legal requirements to fulfill. Council Member Rector asked whether achieving the aim the motion is possible within the requisite timeline. City Attorney Hutchings replied in the affirmative. Members of City Council opined about the proposed motion. Council Member Fawcett announced he attended the Swearing In Ceremony for Deputy City Attorney Stephanie Pough. 10 City Council Regular Meeting February 21, 2024 Council Member Fawcett asked for a recognition for Cole Christiansen, a member of the Kansas City Chiefs, which won the Superbowl. Council Member Williams extended his condolences to Sheriff E.C. Harris on the loss of his father, to Thelma Hinton on the loss of her son and to the family of Morris Jones upon his passing. Council Member Williams announced he attended a Family and Friends service at New Life Outreach Church. Council Member Williams reported he attended the Black and White Gala hosted by Speaker Don Scott in Richmond. Council Member Rector advised he attended a meeting of the Workforce Development Council. Council Member Butler Barlow thanked the Public Works and Public Utilities Department for attending a Greater Oakland Chuckatuck Civic League meeting. Council Member Butler Barlow opined about the United States Department of Agriculture’s survey of agriculture. Council Member Butler Barlow extended birthday wishes to her mother. Council Member Bennett offered advice about the traffic enforcement cameras. Council Member Bennett extended his condolences to Sheriff E.C. Harris on the loss of his father, to Thelma Hinton on the loss of her son and to the families of Morris Jones and Donna Perry upon their passing. Council Member Bennett reported he attended the Dorothy S. Rawles Scholarship Fund check presentation to Virginia State University. Council Member Bennett offered acknowledgements related to Black History Month. Council Member Johnson invited public comment on the 2045 Comprehensive Plan. Council Member Johnson opined about the City Assessor’s report and the Suffolk Sister Cities presentation. Vice Mayor Ward reported he attended the Alpha Kappa Alpha Zeta Epsilon Omega Chapter’s 70th anniversary event. Vice Mayor Ward said he went to the 41st Annual Naomi P. Chambers Prayer Breakfast and the Black and White Gala hosted by Speaker Don Scott in Richmond Vice Mayor Ward opined about Pughsville improvements and infrastructure. Vice Mayor Ward encouraged attendance at an upcoming Town Hall meeting in Nansemond Borough. 11 City Council Regular Meeting February 21, 2024 Vice Mayor Ward extended his condolences to Sheriff E.C. Harris on the loss of his father and to Thelma Hinton on the loss of her son. Mayor Duman advised Council Member Fawcett a ceremonial item would be offered to Cole Christianson. Mayor Duman reported he attended the following events: Suffolk Night at the Hampton Roads Admirals; Fifth Judicial Circuit Drug Treatment Court graduation; and an Eagle Scout Court of Honor event. Mayor Duman offered comments about the most recent Finance Committee meeting. Mayor Duman mentioned staff attendance at the Greater Oakland Chuckatuck Civic League meeting. Mayor Duman said he attended the Early Resultz Day Care Ribbon Cutting and Swearing In Ceremony for Deputy City Attorney Stephanie Pough. Mayor Duman invited participation in the City’s Public Safety Portal. Mayor Duman solicited attendance to Suffolk Humane Society’s Paws for the Arts. Mayor Duman extended condolences on the passing of Thelma Hinton’s son, Donna Perry and Sheriff E.C. Harris’ father. Mayor Duman opined about the resolution sponsored by Delegate Nadarius Clark and passed by the General Assembly, HR152 Celebrating the life of Marie Brinkley Hill.
