Council Member Butler Barlow offered the Invocation and led the Pledge of Allegiance. APPROVAL OF THE MINUTES Council Member Rector, on a motion seconded by Council Member Williams, moved to approve the minutes from the February 5, 2025, Work Session and Regular Meeting, as presented, by the following vote: AYES: Mayor Duman, Vice Mayor Ward, and Council Members Bennett, Butler Barlow, Johnson, Rector, Williams and Wright 8 NAYS: None 0 SPECIAL PRESENTATIONS Special Presentation - A proclamation in recognition of “National Emergency Medical Services Week” Mayor Duman presented the proclamation to Fire Chief Michael Barakey and Battalion Chief Jeff Matthews. Special Presentation - A proclamation in recognition of “Building Safety Month” Mayor Duman presented the proclamation to Planning and Community Development Director Kevin Wyne and Planning and Community Development Assistant Director Jennifer Cobb. 1 City Council Regular Meeting May 21, 2025 Special Presentation – 2025 Summer Events (This item was moved from the Work Session agenda.) Utilizing a PowerPoint presentation, Tourism Manager Theresa Earles gave an update on the above referenced item. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA City Manager Moor announced that the applicants for Public Hearing Items #9 and #11 have asked for continuances to the June 18, 2025, City Council meeting. Council Member Williams, on a motion seconded by Council Member Wright, moved to continue Public Hearing Items #9 and #11 to the June 18, 2025, City Council meeting and adopt the remainder of the agenda, as presented, by the following vote: AYES: Mayor Duman, Vice Mayor Ward, and Council Members Bennett, Butler Barlow, Johnson, Rector, Williams and Wright 8 NAYS: None 0 AGENDA SPEAKERS There were no speakers under this portion of the agenda. CONSENT AGENDA City Clerk Dawley presented the following Consent Agenda items: Consent Agenda Item # 7 - An ordinance to accept and appropriate additional State funds for Suffolk Public Schools Consent Agenda Item #8 - An ordinance amending Chapter 70 of the Code of the City of Suffolk by the addition of Article V “Refuse Fund” Referring to Consent Agenda Items #7 and #8, City Manager Moor submitted a review of the background information as printed in the official agenda. Council Member Bennett, on a motion seconded by Council Member Johnson, moved to adopt Consent Agenda Items #7 and #8, as presented, by the following vote: AYES: Mayor Duman, Vice Mayor Ward, and Council Members Bennett, Butler Barlow, Johnson, Rector, Williams and Wright 8 NAYS: None 0 2 City Council Regular Meeting May 21, 2025 PUBLIC HEARINGS Public Hearing - An ordinance to rezone and amend the official zoning map of the City of Suffolk to change the zoning from A, Agricultural Zoning District to RC, Residential Compact (Conditional) Zoning District for a portion of property located at 2201 Holland Road, Zoning Map 33, Parcel 113, Account Number 152525000; RZN2024-010 (Conditional) This item was continued to the June 18, 2025, City Council meeting under “Removal of Items from the Consent Agenda and Adoption of the Agenda.” Public Hearing - An ordinance to rezone and amend the official zoning map of the City of Suffolk to change the zoning from O-I, Office Institutional Zoning District, to B-2, General Commercial (Conditional) Zoning District for property located at Lynn Drive, Zoning Map 13, Parcels 4A*20, 4A*21, 4A*22, 4A*23, 4A*24, 4B, and 4C, Account Numbers 301158000, 300281000, 301308000, 301217000, 301218000, 301159000, and 300973500; RZN2024-012 (Conditional) Utilizing a PowerPoint presentation, Planning and Community Development Director Kevin Wyne gave an overview of the background information as printed in the official agenda. Referring to the distributed handout, he also mentioned that there is following updated language in proffer number one: “The Rezoning Area shall be developed generally in accordance with the conceptual site plan entitled “RZN 2024-0012 Project Broken Branch Conceptual Layout Exhibit” prepared by AES Consulting Engineering dated February 7, 2025 (“Concept Plan”) which is part of the Rezoning Application with only charges thereto that the Zoning Administration reasonable determines do not alter the basic concept or character of the development; provided, however, such development shall be expressly subject to such changes in configuration, composition and location as required by all other governmental authorities having jurisdiction over such development, including without limitation the U.S. Army Corps of Engineers and the Virginia Department of Environmental Quality.” He added that should City Council make a motion to approve the proposed ordinance, the updated language would need to be included. Lisa Murphy, 4404 Monticello Avenue, Norfolk, Virginia, representing Ali Hamed Peak, AVA RE, LLC, applicant, spoke in support of the proposed ordinance, with the amended proffer number one and proffers two through four, as presented. Rebecca Hersey, 5787 Lynn Drive, representing self, spoke in opposition to the proposed ordinance. Lisa Murphy, 4404 Monticello Avenue, Norfolk, Virginia, representing Ali Hamed Peak, AVA RE, LLC, applicant, spoke in support of the proposed ordinance, with the amended proffer number one and proffers two through four, as presented. Hearing no additional speakers, the public hearing was closed. Vice Mayor Ward asked if the applicant spoke to Ms. Heresy. Ms. Murphy said that the applicant did not speak to Ms. Hersey as her home is hidden from the parcel under consideration. She added that the applicant can speak to Ms. Hersey about the addition of a fence and landscape buffering. 3 City Council Regular Meeting May 21, 2025 Council Member Butler Barlow called for information about the distance between the car dealership, which is on the parcel under consideration, and Ms. Hersey’s residence. Jason Seas, AES Consulting Engineers, the engineer for the applicant, stated that the parcel under consideration is about 130 to 140 feet from the residence, with 40 to 50 feet of right of way. Council Member Butler Barlow called for clarification about the total number of feet between car dealership on the parcel under consideration and Ms. Hersey’s residence. Mr. Seas replied there is 200 feet between car dealership on the parcel under consideration and Ms. Hersey’s residence. Council Member Johnson, on a motion seconded by Council Member Williams, moved for approval of the ordinance, with aforementioned proffer number one, as amended, and proffers two through four, as presented. Council Member Bennett opined about the inclusion of buffer between the car dealership on the parcel under consideration and Ms. Hersey’s residence. Planning and Community Development Director Wynn replied in the affirmative. MOTIONS Motion - A motion to schedule a City Council Work Session, for Wednesday, June 4, 2025, at 4:00 p.m., unless canceled by the Mayor and the City Manager Council Member Bennett, on a motion seconded by Council Member Butler Barlow, moved to schedule City Council Work Session for June 4, 2025, at 4:00 p.m., unless canceled by the Mayor and City Manager unless canceled, by the following vote: AYES: Mayor Duman, Vice Mayor Ward, and Council Members Bennett, Butler Barlow, Johnson, Rector, and Wright 7 NAYS: None 0 ABSTAIN: Council Member Williams was out of the chamber at the time of the vote. 1 NON-AGENDA SPEAKERS Travis McKinney, 2804 Lake Cahoon Point, was not present when called. 5 City Council Regular Meeting May 21, 2025 Dallas Ellis, Jr. 102 Sweetbriar Lane, representing United Full Gospel Revival Center, requested assistance with the cost of stabilizing erosion at his church. DeAngelo Askew, 501 Harrison Street, representing self, reported concerns about actions of the Risk Management Division as it relates to the Public Works Department. Richard Griffin, Jr., 234 North 5th Street, representing self, reported concerns about actions of the Risk Management Division as it relates to the Public Works Department. Shane Alexander, 1800 White Marsh Road, representing self, opined about noise from the Stratford Solar Farm. NEW BUSINESS There were no items under this portion of the agenda. ANNOUNCEMENTS AND COMMENTS Mayor Duman announced Council Member Williams was excused at 7:55 p.m. Utilizing a PowerPoint presentation, Communications Director Jennifer Moore provided a report on the following: the City’s Memorial Day operation hours; the Suffolk State of the City; Library Director Clint Rudy’s receipt of the Movers and Shakers Award; the Chesapeake Bay Foundation’s and Keep Suffolk Beautiful’s Save the Bay Day event at Constant’s Wharf Park & Marina; two closures at Nansemond Parkway; traffic enforcement cameras at the Southeastern Public Service Authority’s Interchange Improvements project on Route 58 and the observance of National Public Works Week. Council Member Butler Barlow congratulated local graduates. Council Member Butler Barlow acknowledged all of the Non-Agenda Speakers. Council Member Bennett acknowledged all of the Non-Agenda Speakers. Council Member Bennett congratulated local graduates. Council Member Johnson opined about the Suffolk State of the City. Council Member Johnson acknowledged the efforts of the Public Works Department. Council Member Johnson announced he attended the Pilot Club Civic Night. Council Member Johnson opined about today’s Work Session presentation about the 2025 General Assembly Session. Council Member Wright reported that she went to the Parks and Recreation Department’s International Festival and the Nansemond River High School’s Senior Awards Night. Council Member Wright acknowledged Deputy City Manager Azeez Felder for his assistance. 6 City Council Regular Meeting May 21, 2025 Council Member Wright opined about Mr. Alexander’s comments. Council Member Rector announced that he attended the Kingsboro Civic League meeting. Council Member Rector opined about Mr. Alexander’s comments. Council Member Rector reported that he attended the following: Public Service Week Food Rodeo; Law Enforcement Memorial Service; Parks and Recreation Department’s International Festival and a tour of the Southeastern Public Service Authority. Vice Mayor Ward opined about the Suffolk State of the City. Vice Mayor Ward opined about Mr. Ellis’ comments. Mayor Duman acknowledged the efforts of the Public Works Department. Mayor Duman announced that he attended the Suffolk Humane Society’s Paws for the Arts Fundraiser. Mayor Duman opined about the Suffolk State of the City. Mayor Duman reported that he attended the Law Enforcement Memorial Service and the Pilot Club Civic Night.
