City Council Regular Meeting October 1, 2014 Regular Meeting of the Suffolk City Council was held in the City Council Chamber, 442 West Washington Street, on Wednesday, October 1, 2014, at 7:00 p.m. PRESENT Council Members - Linda T. Vice Mayor Brown offered the Invocation and led the Pledge of Allegiance to the Flag. FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of October 1, 2014, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Parr, on a motion seconded by Council Member Duman, moved that the resolution be approved, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF OCTOBER 1, 2014, PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED APPROVAL OF THE MINUTES Council Member Duman, on a motion seconded by Vice Mayor Brown, moved to approve the minutes from the September 17 2014, Work Session and Regular Meeting, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 1 City Council Regular Meeting October 1, 2014 SPECIAL PRESENTATIONS Special Presentation - A presentation regarding the Fire and Rescue Department’s annual Fill- the-Boot Campaign Fire Chief Cedric Scott introduced Andrea Shaver, Muscular Dystrophy Association, who offered brief remarks and joined Mayor Johnson for the check presentation. Special Presentation - A proclamation regarding Fire Prevention Week Mayor Johnson presented the above referenced item to Fire Chief Scott. Special Presentation - A proclamation regarding Birdsong Peanuts’ 100th Year Anniversary Mayor Johnson presented the above referenced item to George Birdsong, Chief Executive Officer, Birdsong Peanuts. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson asked if any members of City Council wished to remove any of the Consent Agenda items for separate action. Hearing no requests for removal of any items, Mayor Johnson advised that a motion was in order at this time to adopt the agenda as outlined. CONSENT AGENDA City Clerk Dawley presented the following items: Consent Agenda Item #7 - An ordinance to accept and appropriate funds from the Hampton Roads Planning District Commission for the Department of Parks and Recreation Consent Agenda Item #8 - An ordinance to name the new Municipal Center building, located at 442 West Washington Street, City Hall 2 City Council Regular Meeting October 1, 2014 Vice Mayor Brown asked for a summary of Consent Agenda Item #7 - An ordinance to accept and appropriate funds from the Hampton Roads Planning District Commission for the Department of Parks and Recreation. ORDINANCES Ordinance – An ordinance amending Article IV of Chapter 2 of the Code of the City of Suffolk concerning benefits for the Chief Deputy while serving as an Interim Constitutional Officer City Manager Cuffee-Glenn gave a report on the background information as printed in the official agenda. Council Member Fawcett, on a motion seconded by Council Member Parr, moved to nominate and appoint the aforementioned individual, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 Council Member Duman, on a motion seconded by Council Member Parr, moved to initiate text amendments to Sections 31-304(c), Subsequent Applications; 31-305, Conditional Rezoning; 31-306(e), Subsequent Applications; Article 5, Subdivision, Section 31-606, Parking and Loading Standards; and 31-701 Accessory Uses and Structures of the Unified Development Ordinance and to forward the matter to the Planning Commission for review and a recommendation, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint presentation, Media and Community Relations Manager Timothy Kelley reported on the following items: relocation of various departments to the new City Hall; the closure of the Offices of the City Treasurer and the Commissioner of the Revenue’s Downtown locations, as well as, the Planning and Community Development Department for relocation to the new City Hall; ribbon cutting for Rajput Indian Cuisine; the announcement of the location of Friant to CenterPoint Intermodal Center; the retirement of Commissioner of the Revenue Thomas Hazelwood; recognition of public safety personnel by Joe Bagley Veteran of Foreign Wars Post 2582; Suffolk Police Department Promotional Ceremony; the expiration of the summer burn ban; the Think Green R(e)cycling Drive and Tire Amnesty Day; the observance of October as Adopt a Shelter Dog Month and upcoming adoption events; Homearama 2014; Peanut Fest Parade; Peanut Fest; 13th Annual Suffolk Swamp Road Motorcycle Rally; Touch a Truck, Train and More; and the City’s observance of Columbus Day. 4 City Council Regular Meeting October 1, 2014 Council Member Milteer reported he attend the Peanut Fest Queen’s Banquet. Council Member Fawcett advised he attended the Walk to End Alzheimer's and the Think Green R(e)cycling Drive and Tire Amnesty Day. Council Member Fawcett opined about the new City Hall and the City Council retreat. Council Member Fawcett reported he attended the Art D’vine Fundraiser and the Suffolk Police Department Promotional Ceremony. Council Member Fawcett encouraged residents to attend Peanut Fest and Shrimp Feast. Council Member Fawcett opined about the importance of smoke alarms. Council Member Fawcett congratulated the following: Birdsong Peanuts on its 100th Anniversary; the departments that have moved into the new City Hall; Interim Commissioner of the Revenue Susan Draper and the participants in the Fill the Boot Fundraiser. Council Member Fawcett opined about Homearama 2014 and the Virginia Municipal League Conference. Council Member Ward opined about the new City Hall and the City Council retreat. Council Member Ward congratulated Morgan Hunt, 2014 Peanut Fest Queen. Council Member Gardy congratulated Birdsong Peanuts on its 100th anniversary. Council Member Gardy opined about an editorial in the Suffolk News Herald and location of Friant to CenterPoint Intermodal Center. Council Member Gardy reported on the upcoming Kenyon Road Interceptor project. Council Member Duman thanked Theresa and Brain Mullins for hosting the Passion for Paws fundraiser. Council Member Duman reported he attended the Suffolk Police Department Promotional Ceremony. Council Member Duman extended his condolences to the family of the late Jerry Saunders, former Fire Chief, Chuckatuck Volunteer Fire Department. Council Member Duman opined on the City Council retreat, the new City Hall and a letter to the editor in the Suffolk News Herald. Council Member Parr congratulated Birdsong Peanuts on its 100th anniversary. Council Member Parr opined on the City Council retreat and an article in the Suffolk News Herald. 5 City Council Regular Meeting October 1, 2014 Council Member Parr called for information on the turnover rate and city domicile rates for the Suffolk Police and Fire Departments, respectively. Fire Chief Scott reported that his department’s turnover rate is one point six percent. Council Member Parr queried about response times of the Suffolk Fire Department since 2006. Fire Chief Scott advised that response times have improved in that that time frame. Council Member Parr asked if the Suffolk Fire Department was adequately equipped. Fire Chief Scott replied in the affirmative, and mentioned 34.6% of firefighters reside in Suffolk. Mayor Johnson sought clarification about the inclusion of retirees in the turnover rate of the Suffolk Fire Department. Fire Chief Scott clarified that percentage only includes terminations and voluntary separations. Police Chief Thomas Bennett stated that the turnover rate of his department is between seven and nine percent, and 68% of police officers reside in Suffolk. Council Member Parr inquired about the Public Utility Fund. Public Utilities Director Albert Moor said that the fund must be self-sustaining. Council Member Parr opined about the following: expanded transit service into the northern part of the City; the Pioneer Elementary Dedication Ceremony; activities at the Great Dismal Swamp Wildlife Refuge and the NAACP Candidates Forum. Council Member Parr congratulated Interim Commissioner of the Revenue Susan Draper and retiring Commission of the Revenue Thomas Hazelwood. Vice Mayor Brown opined about Homearama 2014. Vice Mayor Brown congratulated Morgan Hunt, 2014 Peanut Fest Queen. Vice Mayor Brown opined about the new City Hall. Mayor Johnson opined about the City Council retreat. Mayor Johnson thanked Deputy City Manager Patrick Roberts and Capital Programs and Building Director Gerry Jones for their efforts on the new City Hall. Mayor Johnson opined about the new Pioneer Elementary School. Council Member Fawcett announced the upcoming Sleepy Hole Town Hall meeting on October 21st.
