City Council Regular Meeting November 5, 2014 Regular Meeting of the Suffolk City Council was held in the City Council Chamber, 442 West Washington Street, on Wednesday, November 5, 2014, at 7:00 p.m. PRESENT Council Members - Linda T. Johnson, Mayor Charles F. Brown, Vice Mayor Michael D. Duman Roger W. Fawcett Jeffrey L. Gardy Curtis R. Milteer, Sr. Charles D. Parr, Sr. Lue R. Ward, Jr. Selena Cuffee-Glenn, City Manager Helivi L. Holland, City Attorney Erika S. Dawley, City Clerk ABSENT None CALL TO ORDER/INVOCATION/PLEDGE OF ALLEGIANCE Mayor Johnson called the meeting to order. Vice Mayor Brown offered the Invocation and led the Pledge of Allegiance to the Flag. APPROVAL OF THE MINUTES Council Member Milteer, on a motion seconded by Council Member Gardy, moved to approve the minutes from the October 1, 2014, Work Session and Regular Meeting, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 SPECIAL PRESENTATIONS Special Presentation - United Way Win Winslow, Relationship Manager, Western Tidewater United Way of South Hampton Roads, offered brief remarks and presented a certificate to Mayor Johnson. REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson asked if any members of City Council wished to remove any of the Consent Agenda items for separate action. 1 City Council Regular Meeting November 5, 2014 Hearing no requests for removal of any items, Mayor Johnson advised that a motion was in order at this time to adopt the agenda as outlined. Referring to Consent Agenda Items #7 - #11, City Manager Cuffee-Glenn submitted an overview of the background information as printed in the official agenda. 2 City Council Regular Meeting November 5, 2014 Referring to Consent Agenda Item #11, Council Member Parr opined about the funding for the trail. City Manager Cuffee-Glenn explained that the City previously received funds from Virginia for the trail, and the proposed ordinance is an appropriation of a grant from the Obici Healthcare Foundation. Council Member Gardy, on a motion seconded by Council Member Parr, moved to approve the Consent Agenda, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 PUBLIC HEARINGS There were no items under this portion of the agenda. ORDINANCES Ordinance – An ordinance amending Chapter 82 of the Code of the City of Suffolk regarding automobile graveyards and junkyards City Attorney Holland gave a report on the background information as printed in the official agenda. Council Member Duman, on a motion seconded by Council Member Parr, moved to approve the ordinance, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 AN ORDINANCE AMENDING CHAPTER 82 OF THE CODE OF THE CITY OF SUFFOLK REGARDING AUTOMOBILE GRAVEYARDS AND JUNKYARDS RESOLUTIONS Resolution – A resolution of support for the establishment of a regional Governor’s School for Innovation and Entrepreneurship Economic Development Director Kevin Hughes introduced Charles V. McPhillips, Greater Norfolk Corporation. Mr. McPhillips summarized the information as referenced in the distributed information. Referring to the presentation, Council Member Parr asked for clarification about any immediate financial commitment, should the City Council approve the proposed resolution. Mr. McPhillips advised that at this time, the only commitment would support the concept of a regional Governor’s School. Referring to the presentation, Council Member Parr queried about the endorsement of the proposed resolution by any of the area school systems. Mr. Phillips said that to date, no school systems have endorsed the proposed resolution, and gaining support would be one of the next steps in the process. 3 City Council Regular Meeting November 5, 2014 Referring to the presentation, Council Member Parr opined about the feasibility of amending the proposed resolution to include language that would specify the City’s endorsement of a regional Governor’s School without making a financial commitment at this time. City Attorney Holland explained that the final paragraph of the proposed resolution outlines that. She further explained the resolution would only endorse the establishment of a regional Governor’s School. Council Member Milteer, on a motion seconded by Council Member Parr, moved to approve the resolution, as presented, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 A RESOLUTION OF SUPPORT FOR THE ESTABLISHMENT OF A REGIONAL GOVERNOR’S SCHOOL FOR INNOVATION AND ENTREPRENEURSHIP STAFF REPORTS Staff Report - Suffolk Executive Airport Quarterly Report Utilizing a PowerPoint presentation, Economic Development Director Kevin Hughes submitted a synopsis of the above referenced item. Staff Report - Staff Report - 2015 Legislative Agenda Utilizing a PowerPoint presentation, Rob Catron, Managing Partner, Alcalde and Fay, Virginia, LLC, the City’s legislative consultant, provided a review of the above referenced item. Referring to the presentation, Council Member Duman queried about the City’s options, should the Department of Environmental Quality deny the City’s request for exemption from their regulations, which require a permit for localities incinerating animal carcasses collected from right of ways. Mr. Catron replied that the City would either have to refrain from using the incinerators or spend additional monies to reduce the carbon dioxide levels. Public Works Director Eric Nielsen added that the City has received a three-year extension from Department of Environmental Quality to use the incinerators. Referring to the presentation, Council Member Duman asked if other localities were seeking this exemption from the Department of Environmental Quality. Public Works Director Nielsen explained that different localities use different methods for animal carcass disposal. Referring to the presentation, Council Member Duman solicited information about possible partnership with other localities on the enterprise zone issue. Mr. Catron posited Chesapeake might be a good fit. 4 City Council Regular Meeting November 5, 2014 MOTIONS Motion - A motion to schedule a Work Session for November 19, 2014, at 4:00 p.m., unless cancelled Council Member Duman, on motion seconded by Council Member Parr, moved to schedule a Work Session for November 19, 2014, at 4:00 p.m., unless cancelled, by the following vote: AYES: Council Members Duman, Fawcett, Gardy, Milteer, Parr, Ward, Brown and Johnson 8 NAYS: None 0 NON-AGENDA SPEAKERS Calvin Prince, 437 Wellons Street, representing self, opined about a recycling facility in the Saratoga area. Chris Dove, 852 Colonel Meade Drive, representing self, opined about the recent election. NEW BUSINESS Mayor Johnson asked City Clerk Dawley if there were any New Business items for consideration. City Clerk Dawley advised that there were no items for addition to tonight’s agenda. ANNOUNCEMENTS AND COMMENTS Utilizing PowerPoint presentation, Media and Community Relations Manager Timothy Kelley reported on the following items: the upcoming ribbon cutting for City Hall; a recent ribbon cutting for River Yoga; Suffolk Restaurant Week; Suffolk Mystery Authors Festival; the City’s observance of Veteran’s Day; Suffolk Grand Illumination; City’s webpage for roadway maintenance reports; and ebola information on the City’s webpage. Council Member Milteer thanked the Public Works Department for the installation of flood lights at the Saratoga voting precinct. Council Member Milteer advised that he attend the Nansemond River High School Homecoming. Council Member Fawcett reported that he attended the following: Driver Days; ribbon cutting for River Yoga; Chuckatuck Founders Day; Great Hampton Roads Regional Crime Lines Top Cops Banquet; and Suffolk Foundation Luncheon. Council Member Fawcett opined about the recent election. Council Member Ward advised that he attended Driver Days. Council Member Ward opined about the recent election. Council Member Gardy acknowledged the staff at the Suffolk Executive Airport. Council Member Gardy opined about the recent election. 5 City Council Regular Meeting November 5, 2014 Council Member Duman recognized City employees who have been acknowledged by residents. Council Member Duman reported that he attended the following: the Sleepy Hole Borough Town Meeting; Chuckatuck Founders Day; anniversary celebration of the Chuckatuck Volunteer Fire Department; Nansemond River High School Advanced Placement Government Class and Suffolk Foundation Community Luncheon. Council Member Duman opined about the recent election. Council Member Parr offered comments about an article in The Suffolk News Herald about middle school overcrowding. Council Member Parr opined about the recent election. Vice Mayor Brown talked about about the recent election. Mayor Johnson opined about the recent election. Mayor Johnson congratulated the owners of River Yoga. Mayor Johnson advised that she attended Chuckatuck Founders Day and the anniversary celebration of the Chuckatuck Volunteer Fire Department.
