Council Member Milteer offered the Invocation and the Pledge of Allegiance to the Flag. APPROVAL OF THE MINUTES Council Member Fawcett, on a motion seconded by Council Member Goldberg, moved to approve the minutes from the November 2, 2016, Work Session and Regular Meeting, as presented, by the following vote: AYES: Mayor L. Johnson, Milteer and Ward 8 NAYS: None 0 SPECIAL PRESENTATIONS Special Presentation – 2016 National Night Out National Award Utilizing a video presentation, Media and Community Relations Department Director Diana Klink and Police Chief Thomas Bennett supplied a summary of the above referenced item. 1 City Council Regular Meeting December 7, 2016 REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson asked if any members of City Council wished to remove any Consent Agenda items for separate action. Hearing no requests for removal any of the items, Mayor Johnson advised that a motion was in order at this time to adopt the agenda, as presented. Hearing no speakers, the public hearing was closed. Johnson, Milteer and Ward 8 NAYS: None 0 AN ORDINANCE VACATING AND ABANDONING A SEGMENT OF FERRY ROAD LOCATED CONTIGUOUS TO OR NEAR 3305 FERRY ROAD, ZONING MAP 12, PARCEL 49, SV01-16 ORDINANCES Ordinance – An ordinance to amend Section 86-291 of the Code of the City of Suffolk restricting through truck traffic on Kenyon Road Utilizing a PowerPoint presentation, Public Works Eric Nielsen gave an overview on the background information as printed in the official agenda. Council Member Milteer, a motion seconded by Council Member Fawcett, moved to approve the ordinance, as presented. Referring to the presentation, Council Member Fawcett called for information about the effective date of the proposed ordinance. Public Works Director Nielsen stated that the proposed ordinance would be effective upon its passage. Johnson, Milteer and Ward 8 NAYS: None 0 AN ORDINANCE TO AMEND SECTION 86-291 OF THE CODE OF THE CITY OF SUFFOLK RESTRICTING THROUGH TRUCK TRAFFIC ON KENYON ROAD 3 City Council Regular Meeting December 7, 2016 RESOLUTIONS Resolution – A resolution to establish a planning grant steering committee to oversee the creation of a Bicycle and Pedestrian Master Plan to be adopted as a component of the Suffolk 2035: A Vision for the Future, City of Suffolk Comprehensive Plan Parks and Recreation Director Lakita Watson reviewed the background information as printed in the official agenda. Council Member Fawcett, on a motion seconded by Vice Mayor Bennett, moved to approve the resolution, as presented, by the following vote: AYES: Mayor L. The following individuals representing the United Food and Commercial Workers International Union spoke in opposition to the businesses practices at Walmart: Anahi Tapia, no address provided. Tiffany Beroid, 1775 K Street, Northwest, Washington D.C. Juanita Hart, 314 Burnett’s Way. Randy Parras, 1775 K Street, Northwest, Washington D.C. City Clerk Dawley advised City Council that Mr. Warder was present. It was the unanimous consent of City Council to suspend the Rules of Order and Procedure to permit Mr. Warder to speak. Richard Warder, 209 Waterwood Way, representing self, opined about pedestrian traffic on Godwin Boulevard near the Western Tidewater Regional Jail. NEW BUSINESS Council Member Duman, on a motion seconded by Council Member Ward, moved to direct City Attorney Holland to draft an ordinance that amended City Code Sections 34-188 and 34-189 for the penalty for noise violations to be a Class 3 misdemeanor for a first offense and a Class 3 misdemeanor for a second or subsequent violation within 12 months. Referring to the motion, Council Member Fawcett called for clarification. Council Member Duman restated the motion. Council Member Duman, on a motion seconded by Council Member Ward, moved to direct City Attorney Holland to draft an ordinance that amended City Code Sections 34-188 and 34-189 for the penalty for noise violations to be a Class 3 misdemeanor for a first offense and a Class 3 misdemeanor for a second or subsequent violation within 12 months, by the following vote: AYES: Mayor L. Johnson, Milteer and Ward 8 NAYS: None 0 5 City Council Regular Meeting December 7, 2016 ANNOUNCEMENTS AND COMMENTS Utilizing a PowerPoint presentation, Media and Community Relations Assistant Director Tim Kelley reported on the following: the location of the Federal Emergency Management Agency Disaster Recovery Center for Hurricane Matthew at the East Suffolk Recreation Center; the opening of the Boston Neighborhood Park; the receipt of the Best New Facility Award from the Virginia Recreation and Park Society for the Whaleyville Community Center; Suffolk Police Department Badge Pinning Ceremony; Painting the Town for the Holidays; and the City Holiday Parade. Council Member Johnson thanked Finance Director Tealen Hansen for the Comprehensive Annual Financial Report. Council Member Johnson reported he attended the Green Infrastructure Community Forum and the Holland Holiday Tree Lighting. Council Member Milteer advised that there is a water leak at Oxford Avenue and Roy Street. Council Member Milteer announced he attended the groundbreakings for the new elementary and middle schools in North Suffolk. Council Member Fawcett reported he attended the following: the 2016 Hampton Roads Leadership Prayer Breakfast; the Grand Illumination; the groundbreakings for the new elementary and middle schools in North Suffolk; and the Suffolk Police Department Badge Pinning. Council Member Fawcett opined about the following: Comprehensive Annual Financial Report; the Boston Neighborhood Park; the receipt of the Best New Facility Award from the Virginia Recreation and Park Society for the Whaleyville Community Center; and the City Holiday Parade. Council Member Goldberg opined about the Comprehensive Annual Finance Report. Council Member Goldberg queried about parking lot maintenance at the Suffolk Center for Cultural Arts. City Manager Roberts said that the City maintains the landscaping, and he would investigate the matter of the parking lot maintenance. Council Member Goldberg opined about the installation of a grill and lights at the Boston Neighborhood Park. City Manager Roberts stated those matters could be considered during the Capital Improvement Plan process. Council Member Ward advised he attended the following: the groundbreakings for the new elementary and middle schools; Delta Sigma Theta World AIDS Day event; National Night Out Community Awards; and the Hampton Roads Chamber of Commerce Suffolk Division Holiday Social. Council Member Ward opined about the issues raised by the speakers representing the United Food and Commercial Workers International Union. City Manager Roberts explained that any types of concerns regarding discriminatory business practices should be reported to the United States Department of Justice. 6 City Council Regular Meeting December 7, 2016 Council Member Duman opined about the Comprehensive Annual Financial Report and the National Night Out Community Awards. Council Member Duman announced he attended the following: the Grand Illumination; the Suffolk Police Department Badge Pinning; and the groundbreaking for the new elementary and middle schools in North Suffolk. Council Member Duman congratulated Sheriff Raleigh Isaacs on his retirement. Vice Mayor Bennett congratulated the winners at the National Night Out Community Awards. Vice Mayor Bennett advised he attended the groundbreakings for the new elementary and middle schools in North Suffolk and the Suffolk Police Department Badge Pinning. Vice Mayor Bennett congratulated Sheriff Raleigh Isaacs on his retirement. Vice Mayor Bennett reported concerns from residents of Cypress Farm Homeowners Association regarding parking on the grass. Mayor Johnson congratulated those recognized at the Suffolk Police Department Badge Pinning Ceremony. Mayor Johnson opined about the Comprehensive Annual Financial Report. Mayor Johnson announced she attended the groundbreakings for the new elementary and middle schools in North Suffolk and the Grand Illumination. Mayor Johnson congratulated Sherriff Raleigh Isaacs on his retirement. Mayor Johnson encouraged residents to attend the City Holiday Parade. Mayor Johnson congratulated Dr. L.D. Britt on his election to the National Academy of Medicine. Mayor Johnson encouraged residents to attend the Albert G. Horton Jr., Memorial Veterans Cemetery Wreath Society’s annual wreath laying ceremony.
