City Council Work Session June 6, 2018 Work Session of the Suffolk City Council was held in the City Council Chamber, 442 West Washington Street, on Wednesday, June 6, 2018, 5:30 p.m. PRESENT Council Members - Linda T. Johnson, Mayor, presiding Leroy Bennett, Vice Mayor Michael D. Duman Roger W. Fawcett Donald Z. Goldberg Timothy J. Johnson Curtis R. Milteer, Sr. Lue R. Ward, Jr. Patrick G. Roberts, City Manager Helivi L. Holland, City Attorney Erika S. Dawley, City Clerk ABSENT None 2018 LEGISLATIVE CODE UPDATE Utilizing a PowerPoint presentation, City Attorney Helivi Holland, Deputy City Attorney William Hutchings, Assistant City Attorneys Kalli Jackson, Karla Carter and Mina Sandwich offered a report on the above referenced item. Referring to the presentation, Mayor Johnson opined about purpose for House Bill 865. City Attorney Holland reported that there was an issue in the City of Virginia Beach regarding pitbulls obtained from out of state that had an undisclosed violent history. She added that the State is attempting to regulate similar incidents in the future, and she would research the matter further. Referring to the presentation, Council Member Duman called for information about the methodology used to determine calculation of lost profits as it relates to Senate Bill 809. Deputy City Attorney Hutchings explained that property owners must submit their tax returns, and the judge presiding over the matter would determine the value of lost profits. Referring to the presentation, Council Member Duman asked about the required number of years of tax returns as it relates to Senate Bill 809. Deputy City Attorney Hutchings stated that three years of tax returns are required. Referring to the presentation, Council Member Duman opined about the potential impact of Senate Bill 571 on the Suffolk Humane Society’s fostering program. Assistant City Attorney Sandwich replied that it would depend if the society is classified as a releasing agency and, if so, the society would be required to provide notice of a dangerous animal. 1 City Council Work Session June 6, 2018 Referring to the presentation, Council Member Duman queried about the availability of a form to provide notice of a dangerous animal as it relates to Senate Bill 571. City Attorney Holland indicated that staff could research that matter. Referring to the presentation, Vice Mayor Bennett inquired about the right of hunters to recover an errant dog from another person’s property as it relates to House Bill 995. Assistant City Attorney Sandwich said she would research that matter. Referring to the presentation, Vice Mayor Bennett opined about House Bill 1413/Senate Bill 532 as it relates to enforcement. Assistant City Attorney Sandwich advised that the legislation just clarifies violations related to the display or parking of used motor vehicles for sale and the related penalties. She added that these matters would be enforced by the Planning and Community Development Department. Referring to the presentation, Mayor Johnson opined about House Bill 1413/Senate Bill 532 as it relates to the sale of auction cars online. City Attorney Holland indicated that she would research and provide recommendations for enforcement of violations. City Clerk Dawley presented the Closed Meeting motion for City Council’s consideration: 1. Pursuant to Virginia Code Sections 2.2-3711(A)(8) and (A)(1), the consultation with legal counsel employed by a public body regarding specific legal matters requiring the legal advice of such counsel, and the discussion, consideration, or interviews of prospective candidates for appointment and the assignment, appointment, and performance of specific public officers or appointees of the City, specifically the appointments as shown on the attached list for vacancies or term expirations for Community Policy and Management Team, Hampton Roads Planning District Commission, Historic Landmarks Commission, Human Services Advisory Board, Library Advisory Board, Paul D. Camp Community College Board, Senior Services of Southeast Virginia, Southeastern Virginia Alcohol Safety Program, Suffolk Clean Community Commission Keep Suffolk Beautiful Executive Board, The Planning Council, Tidewater Youth Services Commission, and Western Tidewater Water Authority. Council Member Milteer, on a motion seconded by Council Member Fawcett, moved that City Council convene in a closed meeting for the above referenced purposes, by the following roll call vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T.
