Adjournment MINUTES SUFFOLK WETLANDS BOARD September 19, 2013 6:00 P.M. The regular meeting of the Suffolk Wetlands Board was held on Thursday, September 19, 2013, at 6:00 p.m., in the Council Chambers of the Municipal Building, 441 Market Street, Suffolk, Virginia. MEMBERS: STAFF: Geoffrey Hinshelwood Scott Mills, Director of Planning Brad L. O’Berry, III Karla Williams, Associate City Attorney Gretchen Arnold Brian Alperin, Principal Planner Sidney Hazelwood David Parks, Planner II ROLL CALL: The meeting was called to order by Vice-Chairman O’Berry. The roll was called by Mr. Alperin and the Vice-Chairman was informed that a quorum was present. APPROVAL OF THE MINUTES: A motion was made to approve the minutes of the previous meeting as distributed which was passed by a voice vote 4 to 0. PUBLIC HEARINGS: VMRC #12-1348 – River Bluff Living Shoreline – Monthly Update/Progress Report Mr. Alperin stated that at the Commission’s meeting last month, the Board wanted to 1 seek opinion from the City Attorney’s office regarding several specific matters pertaining to the Wetlands Board jurisdiction. Mr. Hinshelwood, on a motion seconded by Mr. Hazelwood, moved that the Wetlands Board convene in a closed meeting for the following purpose, by the following roll call vote: Pursuant to Virginia Code Section 2.2-3711(A)(7), consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advice by such counsel, specifically concerning the living shoreline project with the River Bluff subdivision. AYES: O’Berry, Hinshelwood, Hazelwood, Arnold 4 NAYS: None 0 Wetlands Board convened in Closed Meeting at 6:05 p.m. The Closed Meeting concluded at 6:20 p.m. FREEDOM OF INFORMATION ACT CERTIFICATION The Wetlands Board moved that the resolution be adopted, as presented, by the following roll call vote: AYES: Hinshelwood, Hazelwood, O’Berry, Arnold 4 NAYS: None 0 A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF 2 September 19, 2013, PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED. Mr. Alperin stated that staff has inspected the property on several occasions and there have been significant progress made since the Board’s last special work session. David Parks, Planner II, showed pictures taken during staff’s visits on the property. Mr. Parks also advised that staff did meet with representatives from DEQ, VMRC, Corps of Engineers and Public Works at the River Bluff subdivision. DEQ said that the site was in compliance with the E&S measures. The Corps of Engineers advised that everything was in conformance to the Wetlands permit application. A copy of the VIMS report was sent to the Board members. Mr. Bobby Reed, Parker Crossing, also gave an update on the project. ADJOURNMENT: There being no further business before the Board, the meeting was adjourned. 3 Resolution No._ __ A RESOLUTION OF CERTIFICATION OF THE CLOSED MEETING OF SEPTEMBER 19, 2013 PURSUANT TO SECTION 2.2-3712 OF THE CODE OF VIRGINIA (1950), AS AMENDED WHEREAS the Suffolk Wetlands Board has convened a closed meeting on the above date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by this BOARD that such closed meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED that the Suffolk Wetlands Board hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements of Virginia law and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by the Suffolk Wetlands Board in the closed meeting.
