SUFFOLK PLANNING COMMISSION
December 20, 2016
2:00 P.M.
The meeting of the Suffolk Planning Commission was held on Tuesday, December 20,
2016, at 2:00 p.m., in the Council Chambers of the Municipal Building, 442 W.
Washington Street, Suffolk, Virginia, with the following persons present:

The meeting was called to order by Chairman Benton and Commissioner Staylor
opened with a prayer. The roll was called by Mr. Goumas and the Chairman was
informed that a quorum was present.
APPROVAL OF MINUTES:
The minutes of the previous meeting were approved as written.
PUBLIC HEARING:
REZONING REQUEST, RZ11-16, (Conditional), Golden Peanut Company,
LLC: submitted by Tom Dickey, agent(s), on the behalf of Golden Peanut Company,
LLC, property owner(s), to rezone and amend the official zoning map of the City of

Suffolk to change the zoning from M-2, Heavy Industrial zoning district, to MUC-40,
Mixed Use Core-40 zoning district, for property located at 273 South Saratoga Street,
Zoning Map 34G23(A), Parcel(s) 114*115*116. The affected area is further identified
as being located in the Whaleyville Voting Borough, zoned M-2, Heavy Industrial
zoning district. The 2035 Comprehensive Plan designates this area as part of the
Central Growth Area, Core Support Use District.
The first item of business was introduced by the Chairman followed by a staff report
presented by Kevin Wyne, Principal Planner. Mr. Wyne stated that this application is
to request a change in zoning from M-2, Heavy Industrial, to MUC-40, Mixed Use
Core 40 in support of a proposed 233 apartment dwellings. The applicant has stated
that they intend to only construct 233 units; however, would like the flexibility to
construct up to 300 units. The zoning district proposed on the subject parcel appears to
be appropriate for a location within the Core Support Use District, which envisions
higher density residential, commercial, and mixed use development in the core areas of
the City. The current zoning would only permit heavy industrial use. The requested
change in zoning is consistent with the policies of the 2035 Comprehensive Plan. The
proposal, which consists of the redevelopment of a former industrial site, will create a
housing product of need in the City and specifically in an area that encourages high
density development due to the proximity of the City’s downtown area. The
redevelopment of the site will utilize the Historic Tax Credit Program. The proposed
development conforms to the objectives of the district as it will adaptively re-use a

historic property in close proximity to the downtown area to create a mixed use
development with a primary multi-family component. The proposed density and
location are consistent with the development principles established within the MUC-40
district. The development will feed into Hillpoint Elementary, Forest Glen Middle and
Lakeland High Schools. Based on UDO Section 31-601, there is adequate space in all
of these schools. The site has access to available water and sewer lines that serve the
area. The Department of Public Utilities reviewed the Public Facilities Report and
determined the site will have adequate levels of service for water and sanitary sewer,
thus they have no objections. The Public Facilities Report provided by the applicant
indicated that this project will address applicable stormwater management
requirements through a combination of Low Impact Development practices, which
may include underground detention, pervious pavers and bio‐retention in the vicinity
of the proposed parking area located in the northeast of site and additional
bio‐retention in the southern portion of the site. The applicant also proposed to
decrease the overall impervious surface on the site. The applicant submitted a Traffic
Impact Assessment in support of their application. The TIA based its modelling on the
creation of 300 apartment units served by four (4) full access site entrances. Two (2)
entrances will be on South Saratoga Street with the remaining two (2) entrances on
Wellons Street. The study states that no improvements are required or recommended

at any of the existing study intersections or site driveways to accommodate the traffic
generated by the project. This has been verified and approved by Traffic Engineering,
as the TIA has been accepted and approved. In support of the request, the developer
provided the City with a Fiscal Impact Statement which serves to project potential
costs and revenues the City can expect to be generated by the development proposal.
The study stated that the development will generate a net of $1.8 million over a 10 year
period. In summary, staff found that the proposal is consistent with the provisions of
the 2035 Comprehensive Plan and the UDO, and that the existing public facilities are
adequate to meet the additional demands generated by the proposed change in zoning.
Staff recommended approval of this application.
The public hearing was opened and speaking in favor of this application was Tom
Dickey, The Monument Companies.
There being no speakers in opposition, the public hearing was closed.
After discussion by the Commission, Commissioner Singleton made a motion to
approve this application, seconded by Commissioner Edwards and passed by a
recorded vote of 7 to 0.

by C. Raeford Eure, L.S., Hoggard-Eure Associates, P.C., agent(s), on the behalf of
John Napolitano, Napolitano Homes, applicant(s), on the behalf of WOV Properties,
LLC, property owner(s), to rezone and amend the official zoning map of the City of
Suffolk to change the zoning from PD, Planned Development zoning district, to RU,
