The project is located at 2000 Bleakhorn Road along Bleakhorn Creek; further identified as Zoning Parcel 5*19B, zoned B-2, General Commercial and RL, Residential Low Density Zoning District. V. Adjournment MINUTES SUFFOLK WETLANDS BOARD March 17, 2016 6:00 P.M. The meeting of the Suffolk Wetlands Board was held on Thursday, March 17, 2016, at 6:00 p.m., in the City Council Conference Room of the City Hall Building, 442 West Washington Street, Suffolk, Virginia. MEMBERS: STAFF: Geoffrey Hinshelwood Karla Williams, Associate City Attorney Darius Davenport Robert Goumas, Director of Planning & Richard Vroman Community Development C. Robbie Johnson David Parks, Principal Planner Brad L. O’Berry Amanda Beck, Planner II ROLL CALL: The meeting was called to order by Chairman Hinshelwood. The roll was then called by Mr. Parks and the Chairman was informed that a quorum was present. APPROVAL OF THE MINUTES: The minutes of the previous meeting were approved as written. PUBLIC HEARING: VMRC#15-1716, submitted by Richard Bartlett of Professional Construction Consultants, LLC, applicant, on behalf of Patrick Bryant, property owner, for the installation of a 144 linear foot bulkhead, a 50-foot open-pile pier with a 12-foot by 23-foot L-head and a 5-foot by 28-foot finger pier, 16-foot by 28-foot boathouse with boatlift, and 2 watercraft lifts. The project is located at 214 Water Pointe Way along the Nansemond River; further identified as Zoning Parcel 26J*2*42, zoned RLM, 1 Residential Low-Medium Zoning District. The first item of business was introduced by the Chairman followed by a staff report presented by Amanda Beck, Planner II. Mrs. Beck advised that the applicant is requesting to construct 35-feet of the new bulkhead no more than 2-feet channelward of the existing bulkhead, with the remaining 89-feet in-line with the existing bulkhead. The existing bulkhead is starting to fail and erosion behind the bulkhead was evident during a site visit. Adjacent to the dilapidated boathouse is where the 37-feet of riprap will be constructed. The application indicated that there will be a total of 111 square feet of impact in the CBPA Resource Protection Area, requiring mitigation in line with the Riparian Buffers Manual. There is no projected impact to wetlands due to the riprap. Installation of 124 linear foot bulkhead, including replacing existing bulkhead, will have minimal impact on subaqueous lands along sections B-E, and will be in-line from sections E-I, with construction occurring in non-vegetated wetlands along sections F-H. Sections A-B of the project will have a minimal impact to non-tidal vegetated wetlands, and to offset construction effects the applicant proposed to remove 80 square feet of the existing marginal wharf so that wetland plants may be reestablished along this portion of the property. Construction of the open-pile pier proposed to take access directly from the existing wharf, and construction will occur over non-vegetated wetlands within the Nansemond River; therefore, there will be no 2 wetland vegetation impacted by the pier. This action is exempt from the Wetlands Board’s action. The proposed boathouse, boatlifts, and additional watercraft lifts will be built upon non-vegetated wetlands. This action is exempt from the Wetlands Board’s action. The existing marginal wharf is within the CBPA Resource Protection Area Buffer, and is being mitigated through a buffer restoration plan which staff will review administratively. The previous VIMS report that was submitted in 2008 addressed the replacement of the existing bulkhead, as well as dredging 284 cubic yards of the access channel adjacent to the property for the historical boathouse. The report stated the installation of 80 linear feet of new bulkhead in addition to the existing bulkhead was appropriate for this site. Due to the impacts within the Resource Protection Area of the Chesapeake Bay Preservation Area Overlay District, the applicant will be required to submit a buffer restoration plan in accordance with UDO Section 31-415 and the Riparian Buffers Modification and Mitigation Manual. This application proposed removing 80 square feet of the marginal wharf; therefore, there will be no impact to the woody groundcover along the bank on the southeastern lot line. 800 square feet of vegetation such as understory trees, shrubs, and woody groundcover will be planted to mitigate impact to the 100-foot RPA Buffer. Obtaining a building permit will be conditional of staff approval of the buffer restoration plan first. This shoreline project will be required to obtain a land disturbance permit 3 through the Department of Public Works, which will include an erosion and sediment control plan approved by that Department prior to permit issuance. Due to the existing conditions on site, and the condition of the existing bulkhead, it was staff’s opinion that the site in question is appropriate for the proposed project and recommended approval of this application with the conditions. The public hearing was opened and speaking in favor of this application was Richard Bartlett of Professional Construction Consultants, LLC. He asked for the Board’s approval of this application. There being no speakers in opposition, the public hearing was closed. Mr. Davenport made a motion to approve this application as submitted subject to the relevant conditions made by staff, seconded by Mr. Johnson and passed by a recorded vote of 5 to 0. VIMS TRAINING: Mr. Parks advised Board members of the upcoming Annual VIMS Wetlands Workshop which will be held on May 5th.
