April 14, 2025 The City Council of the City of Sulphur, Louisiana, met in regular session at its temporary location located at 501 Willow Avenue in the Council Chambers, Sulphur, Louisiana, on April 14, 2025, at 5:30 p.m., after full compliance with the convening of said meeting with the following members present: DRU ELLENDER, Council Representative of District 1 NICK NEZAT, Council Representative of District 2 MELINDA HARDY, Council Representative of District 3 JOY ABSHIRE, Council Representative of District 4 MANDY THOMAS, Council Representative of District 5 After the meeting was called to order and the roll called with the above result, prayer was led by Mrs. Hardy, followed by the reciting of the Pledge of Allegiance led by Mrs. Ellender. The Chairman asked if there were any changes to the minutes of the previous meeting. With no changes made, motion was made by Mrs. Hardy seconded by Mrs. Thomas that the minutes stand as written. Motion carried unanimously. Motion was then made by Mrs. Ellender seconded by Mrs. Hardy that item #5 be postponed to the May agenda: - Public hearing on ordinance entering into a franchise agreement with Conterra Ultra Broadband, LLC. Motion carried unanimously. Motion was then made by Mrs. Ellender seconded by Mrs. Abshire that the agenda stand as amended. Moton carried unanimously. The first item on the agenda is Hunter Tyler, with Entergy, to introduce himself. Mr. Tyler addressed the Council and stated that they could call him anytime they needed. He just wanted to introduce himself since he was new to the company. The next item on the agenda is a presentation by Sulphur High School Lead Council on their newest community initiative. Each member of Lead Council introduced themselves. Lead is made up of Sophomores and Juniors and trusted with $20,000 from Woodside Energy. Their projects for this year are the new street signs in the Downtown Cultural District, mural on The Village, hanging baskets and flower boxes. Council and Administration thanked them for all their hard work. The next item on the agenda is a public hearing on ordinance authorizing Mayor Mike Danahay to sign Cooperative Endeavor Agreement with the Calcasieu Parish Police Jury for Summer Feeding Program. Motion was made by Mrs. Abshire seconded by Mrs. Hardy that the following ordinance be adopted to-wit: ORDINANCE NO. 1952, M-C SERIES ORDINANCE AUTHORIZING MAYOR DANAHAY TO ENTER INTO A COOPERATIVE ENDEAVOR AGREEMENT WITH CALCASIEU PARISH POLICE JURY FOR SUMMER FEEDING PROGRAM. BE IT ORDAINED by the City Council of the City of Sulphur, Louisiana, the governing authority thereof, that they do hereby authorize Mayor Mike Danahay to sign Cooperative Endeavor Agreement with the Calcasieu Parish Police Jury for Summer Feeding Program. BE IT FURTHER ORDAINED that this Ordinance shall become effective upon the Mayor's approval, or upon proper re-adoption by the Council pursuant to Section 2-13(C) of the Home Rule Charter of the City of Sulphur. WHEREAS, Vexus Fiber, LLC, dba Metronet, is a telecommunications company that desires to expand its fiber optics infrastructure to areas within the City of Sulphur; and WHEREAS, Vexus Fiber, LLC desires to access and utilize the public right-of way to accomplish said expansion by way of the installation, modification, relocation, repair, operation and maintenance of its fiber- optic infrastructure within said rights-of-way; and WHEREAS, the parties agree that the expansion of Vexus Fiber, LLC fiber-optic infrastructure to areas within the municipal boundaries of the City will provide a public benefit and assist in the economic development of the area, and the parties have a reasonable expectation of receiving benefits which are commensurate to the benefits respectively conferred. Mr. Badaar addressed the Council and stated that he’d like to make apartments in the rear and a strip mall in the front. Danny DiPetta, Bonin Drive, stated that the Council shouldn’t allow residential living in this area. Cities Service is for businesses. The Master Plan should be followed. After discussion, motion was made by Mrs. Ellender seconded by Mrs. Abshire that the following ordinance be adopted to-wit: ORDINANCE GRANTING AN EXCEPTION TO KHAN KHEL, LLC, 115 SOUTH CITIES SERVICE, TO ALLOW FOR APARTMENTS IN A BUSINESS DISTRICT. The next item on the agenda is an introduction of ordinance setting forth water fees charged by the City of Sulphur. Mayor Danahay stated that when raising rates several factors are considered (1) what are our operational costs of our water/wastewater systems (2) future operational costs and inflationary costs year to year. Expenses can’t exceed revenue since that’s not a sound policy. He then stated that he had a history book of the City of Sulphur, and it reads that in 1978 rates were not increased for 4 years. So, in 1982 the city was over $1 million in deficit as well as an increase from $8.00 to $18.00/month (24% increase in that year). Again, in 1990 the Council chose not to increase rates for several years. They then had to raise rates for 5 years a maximum of 10% each year (50% increase). If we don’t review our rates and act appropriately, we will end up further in debt. Mrs. Thorn, Director of Finance, stated that they are not presenting scare tactics. She then read a letter from 2023 which went over how the water sector grant worked. The Council wanted the rate study done. The study indicated that water rates increase 7.5 % for 2025-2026 and 2026-2027 years then 2.5 % for 3 years following OR if meters are in place rates can be reevaluated by the city once adequate data is gathered. We were approved for $5 million and have received $1.8 million so far. The city will be obligated to pay back this funding if the rates aren’t increased. Terminating the CEA will eliminate funding and funds will be lost. It could also put the city in jeopardy with the Office of Community Development for any future funding due to poor practices. If the increase isn’t approved the Council and Administration would need to work together on reworking the proposed budget. Mr. Abrahams, Director of Public Works, stated that since 2019 just in Capital Projects they’ve spent over $19 million. Future projects include the Driftwood water tower that needs to be rehabilitated, the Water Meter Program where they’re pursing the Drinking Water Revolving Loan fund to help pay for the $20 million project. The next project would be to address the transmission mains. The city has approx. 125 miles of waterlines. He would say a conservative amount of $23 million just to replace all waterlines. Future projects are estimated at $43 million in unfunded projects. Lynette Chaisson, South Kent, stated that her water filter was supposed to last 3 months and it only lasted 3 weeks because the water was so bad. Sheila Broussard, Pecan Street, stated that she finds it abominable that the city is charging a penny for their water. She then stated that microbes have eaten through her faucets. She doesn’t think the city should charge citizens for drinking water until reverse osmosis is done. Wendy Wingate, Madison Crossing, stated that there’s no justification for all the water increases each year. She then questioned why the rate study said “no growth expected” for the next 10 years and don’t know why that was in there. Only south of the city is expected growth. You expect no revenue growth nor population growth, but the citizens will have to pay more money for utilities. After discussion, motion was made by Mrs. Ellender seconded by Mrs. Thomas that the following ordinance be introduced: ORDINANCE SETTING FORTH WATER FEES CHARGED BY THE CITY OF SULPHUR. Mrs. Thorn stated that per the Consumer Price Index the last few months have shown an increase between 4.89% and 5.19%. They won’t know where the price will actually be until around June. The proposed increase is 4.44% ($1.00/mo.) Wendy Wingate, Madison Crossing, stated that there’s a disclaimer that trash is in the General Fund. Why is it in the General Fund. Mrs. Thorn stated that since it’s not water/sewer it has to be in General Fund. She has to follow the Government Financial board which is a federal mandated government board, and it says that public utility only includes sewer/water and it does not include trash. Mrs. Wingate then asked if Mrs. Thorn had ever asked the federal government to make a change for this. This is her problem with the budget every year. Mrs. Thorn then stated that she has never asked the federal government to change their accounting standards. Cindy Robertson, West Verdine Street, stated that if you’re at the federal poverty level (A.L.I.C.E. – Asset Limited, Income Constrained, Employed households) that is a good chunk of their income going to water and sewer. Mrs. Young, Augusta Drive, asked how people on a fixed income afford this. She doesn’t even have a pool or sprinklers. She wants water meters. Mrs. Hardy stated that she’s been advocating for water meters for a few years now. This is the end goal. Mrs. Thorn went over some of the highlights in the budget, all which can be found on the city’s website. Sheila Broussard, Pecan Street, stated that if the Council votes no on this then the Director would have a whole month to get another budget together. Mrs. Thorn stated that she has a better idea and if the Council votes to introduce the ordinance tonight then the citizens can view the budget. If Council votes no, then the citizens don’t have the chance to view it. If Council sees that changes need to be made, those changes can be made in May at the public hearing. Mrs. Ellender stated that if someone has a concern after reviewing the budget, they can call their Council persons or Mrs. Thorn and she could sit down with them and explain it. Mrs. Broussard stated that that would be wonderful but in today’s world everyone is busy. She suggested the Council go on her Facebook page she created and find those people who are complaining about the city and the Council needs to reach out to those people rather than the citizens reaching out to their Council person. Maybe even hold a town hall meeting. Wendy Wingate, Madison Crossing, stated that she’s upset that the citizens can’t review the budget prior to the introduction that way they could ask questions at the introduction of the ordinance. Her complaints are how the city is managing the money. She also stated that she doesn’t know if the Council realizes that they amended a budget last year after the year-end for millions of dollars. How did the city miss that if they are really scrutinizing the budget. Why isn’t the Marshal’s office included in the budget among many other things. Mrs. Thorn stated that the budget has had to be amended every year since Hurricane Laura. It’s all been related to FEMA reimbursement. The first year she didn’t know how it worked since she’s never been through a disaster before. FEMA had given the city $20 million so she just thought well I’ll just put it in the budget but soon found out that’s not how it works. You spend the money first then they reimburse you when they choose and it could be in pieces. They tell you your’re about to get the money then you don’t see it for over 6 months or they tell you it’ll be 6 months and you’ll get it the next week. We never know when we’ll get the money. Since the hurricane, we’ve met with our FEMA PDMG every two weeks to discuss these matters. The only way to amend a budget after year end, per the Legislative Auditor’s office, is if it’s something completely out of our control, in which Federal reimbursements are. We can do one of two things: (1) We can take a budget finding for being under/over 5% of our revenue OR (2) amend the budget for unexpected variance. The Council will need to amend the budget soon again because we received $5.5 million and we only budgeted to receive $3 million in Federal reimbursements. She doesn’t know when the amendment will come because more money may come before the end of June. She doesn’t want to have a budget finding but if the Council is OK with a budget finding, then that’s what she’ll do. Mrs. Abshire stated that this increase will not be for the current Mayor but will take effect after the 2026 election. Many great things are coming to our area and we need someone in office, whether this Mayor or next Mayor, to handle the responsibilities of this job. Billy Loftin, City Attorney, stated that per Section 3-04 of the Home Rule Charter, it requires us to do the Mayor’s raises this way. Any adjustment to the Mayor’s salary must be done within 1 year prior to the end of the term and not become effective until the next term. This isn’t a pay raise for Mayor Danahay. It’s a pay raise for the Mayor of the City of Sulphur for the next term. It’s very prudent that we find qualified people for this position. The increase would be for longevity and across the board pay increases that all city employees get. Danny DiPetta, Bonin Drive, stated that this isn’t an indictment against the current Mayor or Council. He finds it sad that some of the self-proclaimed pundit’s in this room tonight and on-line, these are the people that scream the loudest about replacing the Council, Mayor and Administration. These are the same people that don’t want to offer a fair compensation package for someone to take their place. Government should be run like a business. You have to offer a good compensation for a Mayor to run a city with a large budget. Wendy Wingate, Madison Crossing, stated that she is for an increase in Mayor’s salary. What’s she’s not for is, is it a raise for the right party that wins the election or is it across the board. It wasn’t presented how this raise will really work. Is it percentages over the last years or what. These are important questions. Sheila Broussard, Pecan Street, stated that this salary is way too large for this size city. The pay scales for Louisiana Mayor’s are all over the place so you really can’t get an average median with that. In 2017 the Council raised the Mayor’s salary and Mayor Duncan vetoed that ordinance. Mrs. Ellender stated that he did not veto the ordinance, he just said he was against the raise. Mrs. Broussard stated that if you’re a public servant are you in this for the money? She does know people that would serve that are highly qualified and do not/would not except that high of a salary to serve. She told the Council to ask around and find those people that are willing to serve at a lower salary. Change is coming in 2026, and she hopes that the new Council would agree with us and we could come up with something more in line. Mrs. Abshire stated that she understands that people don’t think this position deserves a lot of pay but she wonders how many hours the Mayor puts in. The proof is in the pudding. Look how many people are willing to put their time, thoughts and energy into even running. You don’t see long lines of people running. It’s an honor to serve hoping to make a difference. Have I done it all correctly, no, but no one else has done their job 100% correct either. Because we’re all human and we do the best we can do. We need someone with adversity who will stand with us in good times and in bad. Cindy Robertson, West Verdine, stated that a government is not to be run like a corporation. Wendy Wingate, the state says that they allocated over $9 million for this project so she’ll be contacting them to see if the city ever got those funds. Mayor Danahay stated that this is part of the state legislative funding. Ms. Deville addressed the Council and stated that she wanted her kids to have the chance to experience how to raise chickens. The coop is completely enclosed. She gives the chickens dietary food to make sure they don’t stink. The enclosure is on the back property line. She asked all her neighbors before she even started and they all said they didn’t have a problem with the chickens. Mr. Schultz, Sherwood Drive, stated that all the neighbors said they wouldn’t mind the chickens because Ms. Deville was very intimidating when she approached all of them. We are all elderly people and were all intimidated so we said we didn’t mind the chickens. His kitchen window is 12 feet away from the chicken coop. His wife has COPD and heart condition. All the neighbors are sickly people. Chickens can get bird flu and they stink. She should be 50 feet from the residential property lines. Mrs. Hardy said she can’t support this since the ordinance says she has to be 50 feet. She understands the property owner wants her children to have a hands on experience but she can’t support it. She should have checked with Animal Control before she put the coop up. Cindy Robertson, West Verdine Street, stated that Earth Day festivities will be held this Saturday from 2:00 p.m.-7:30 p.m. at 1401 Argin Street. She encouraged everyone to attend. James LeDoux, North Claiborne Street, thanked everyone for the Easter Egg Hunt. It ran like a well- oiled machine. The Mayor stated that there were 16,000 eggs. Mrs. Hardy stated no pain, no gain. She does oppose the water increase however she voted yes to support the city’s effort in procuring and maintaining that financial stability because she sees the light at the end of the tunnel which is meters. That’s what she’s been advocating for. Yes, it’s painful right now but in order to reach the goal, which is to get meters, she will support it. Austin Abrahams, Director of Public Works, stated that Phase 1 for water replacement meters for commercial businesses has started. They completed their audit a few weeks ago. The 5/8 x 3/4 meters starting installation in July and everything 2” and above will be delivered in October. Hopefully they’ll be installed by the end of this year.
