City Council

May 12, 2025 The City Council of the City of Sulphur, Louisiana, met in regular session at its temporary location located at 501 Willow Avenue in the Council Chambers, Sulphur, Louisiana, on May 12, 2025, at 5:30 p.m., after full compliance with the convening of said meeting with the following members present: DRU ELLENDER, Council Representative of District 1 NICK NEZAT, Council Representative of District 2 MELINDA HARDY, Council Representative of District 3 JOY ABSHIRE, Council Representative of District 4 MANDY THOMAS, Council Representative of District 5 After the meeting was called to order and the roll called with the above result, prayer was led by Mrs. Ellender, followed by the reciting of the Pledge of Allegiance led by Mrs. Ellender. The Chairman asked if there were any changes to the minutes of the previous meeting. With no changes made, motion was made by Mrs. Abshire seconded by Mrs. Hardy that the minutes stand as written. Motion carried unanimously. Motion was then made by Mrs. Hardy seconded by Mrs. Abshire that item #27A be added to the agenda: Introduction of ordinance authorizing Mayor Danahay to enter into a Cooperative Endeavor Agreement with Calcasieu Parish School Board for funding for STEM project. With no comments from the public, motion carried unanimously. Motion was then made by Mrs. Hardy seconded by Mrs. Thomas that item #20 be removed from the agenda: Public hearing on ordinance authorizing Mayor Mike Danahay to enter into an Agreement with AT&T for the purpose of constructing, maintaining and operating structures and facilities used in or incidental to the provisions of the telephone and telegraph services to the public. Motion carried unanimously. Motion was then made by Mrs. Thomas seconded by Mrs. Hardy that item #26 be removed from the agenda: Resolution granting a variance to Jimmy Wells and Sheree Tucker, 4790 Maplewood Drive, to allow them to keep the recently extended ½ brick wall and fence in city right of way. Motion carried unanimously.  Motion was then made by Mrs. Hardy seconded by Mrs. Thomas that the agenda stand as amended. Motion carried unanimously. The first item on the agenda is a resolution electing a new Chairman/Vice-Chairman for Sulphur City Council. Mrs. Abshire presented Mr. Nezat with a plaque and thanked him for his leadership for the past year. Motion was made by Mrs. Hardy seconded by Mrs. Ellender that the following resolution be adopted to-wit: RESOLUTION NO. 3642, M-C SERIES Resolution electing a Chairman and Vice-Chairman for City Council. BE IT RESOLVED by the City Council of the City of Sulphur, Louisiana, the governing authority thereof, that they do hereby elect Joy Abshire as Chairman and Mandy Thomas as Vice-Chairman for City Council. Mayor Danahay stated that Animal Control employees have been in a mobile home since Hurricane Rita, and they never complained about it. Hurricane Laura hit and it all had to be rebuilt. Motion was made by Mrs. Hardy seconded by Mr. Nezat that the following resolution be adopted to-wit: RESOLUTION NO. 3643, M-C SERIES Resolution accepting Substantial Completion for Sulphur Animal Control Reconstruction. BE IT RESOLVED by the City Council of the City of Sulphur, Louisiana, the governing authority thereof, that they do hereby accept Substantial Completion for Sulphur Animal Control Reconstruction. If withdrawn, any improvements constructed thereon shall be removed at the expenses of owner thereof. Sheila Broussard, Pecan Street, asked if the city will verify that the tree is overhanging prior to owner getting a citation. Mrs. Abshire stated that this is an existing ordinance and they’re just modifying it. Cindy Robertson, West Verdine, stated that there are many corners where stop signs are located that trees are blocking the view. (a) The owners of any property in the city, improved or unimproved, occupied or unoccupied, shall keep all trees and shrubbery growing on the property owned by them and overhanging any street, cut and trimmed to a height of not less than fifteen (15) feet above the street level for a distance of not less than one (1) foot back of the curb or edge of the street, and shall keep sidewalks clear of all trees and shrubbery growing on land owned or occupied by them to a height of not less than eight (8) feet above the sidewalk. (b) The owners of any property in the city, improved or unimproved, occupied or unoccupied, shall keep all trees and shrubbery growing on the property owned by them cut and trimmed for a distance of not less than seven and one-half (7.5) feet radius from any fire hydrant located on land owned or occupied by owner, owner's agents or assigns. (c) If the owner or occupant has not complied with paragraph (a) of this section within ten days after receipt of written notice from the director of public works so to do, the city may trim the trees or shrubs to comply with the requirements of paragraph (a) of this section. The costs of the work performed, whether by the city or by contract, shall be assessed to the owner or occupant of the property, which charges shall be due  and payable within ten days from completion of said work. Notwithstanding any provisions to the contrary, the minimum charge shall be $25.00 per hour for the actual time involved in performing such work or for the amount of the contract. This fee shall be in addition to any other fees or charges required by ordinance. (d) Any person who fails to comply with this section shall be punished as provided in Section 1.11 of this Code. Cindy Robertson, West Verdine, showed concern about meeting LA health requirements and the safety of our drinking water. Mrs. Thorn, Director of Finance, stated that the city has to abide by the state regulations. Mrs. Robertson stated that the city has to abide by the state minimum requirements, but the city can go above and beyond requirements. Austin Abrahams, Director of Public Works, stated that the city does meet the primary contaminant limits where we have been lacking, the secondary limits aren’t mandatory yet but as part of phase 3 at the Verdine Plant will be to install a clarifier that will remove the iron and manganese prior to getting to the filters. Once this project is complete, the water will be very, very good. Donna Clark, Garth Drive, brought her shower head to show all the corrosion on it. Lattie Polk, Garden Street, stated that the city has spent lots of money for upgrades and the water still isn’t good. DEFINITIONS: (a) Household means parents, their minor children, grandparents and a grandchild who is a minor and whose legal custody has been granted to a grandparent, all of whom reside in a housing unit as a family unit and for whom utilities are customarily purchased in common, or who make payments for utilities included in the rent; (b) Income means all non-exempt gross income received by members of the household on a regular or predictable basis during three (3) calendar months or all annualized non-  exempt income received by members of a household on an irregular or fluctuating basis or moneys received into a home occupied by a household from any source whatsoever; (c) Housing Unit means a house, a stationary mobile home, an apartment or any unit used for billing purposes. SECTION 2. ELIGIBILITY (a) Determination of eligibility for this assistance program will be in accordance with Department of Social Services established by the Federal government and the State of Louisiana. Police Department decrease expenses by $214,287.00 (the prior year Police units all came in) 6. Increasing Streets and Maintenance for BFI Refuge Collection (garbage service expense) - $222,495.00 7. The adoption of the Capital Improvement Budget as submitted for a period of five years with the first year being for the budget year 2025-2026 shall be for the expenditures as appropriated therein. The amounts appropriated for all accounts shall not exceed the amounts fixed therefor in the Budget of Expenditures unless all terms and conditions of the Sulphur Home Rule Charter are complied with. In accordance with Section 5-04 € of the Sulphur Home Rule Charter (Transfer of Appropriations): At any time during the fiscal year the Mayor may transfer part or all of any unencumbered appropriation within programs or functions. Nothing contained in this section shall be construed to prohibit the governing authority from amending or making an appropriation to and for a contingent fund to be used in cases of emergency. Cindy Robertson, West Verdine, asked someone to explain the longevity term. Does it apply to an employee’s longevity, or does it apply to the position? Mrs. Thorn stated that there are two increases (1) annual longevity that’s given on the employee’s anniversary date beginning the first year. It’s 2% city wide and for every position in the city. It does not move with the position; it stays with the person. If the person moves to another position the longevity moves with the person. The other increase that employees usually get goes into effect July 1 of every year and that’s the across-the-board increase (i.e. cost of living increase). For non-Civil Service employees it does not stay with the position and it does not stay with the person. For Civil Service Fire and Police it does stay with the position due to Civil Service rules. Sheila Broussard, Pecan Street, stated that in 2017 an HR salary survey was done, and it showed that the average pay for Mayor’s was between $60,000-$95,000. Now that the boom is over, and more people have moved out of Sulphur, and it was stated that Sulphur doesn’t project any growth in the next ten years, it doesn’t make any sense to make any expenditures that isn’t absolutely necessary. Laddy Polk, Garden Street, stated that he sees language for increases in longevity. Just showing up to work doesn’t merit a raise. Mrs. Thorn, Director of Finance, stated that annual evaluations are done and if someone performs poorly then it’s addressed. HR does a great job encouraging the Department Heads on annual evaluations. We have lots of training to offer the employees. After discussion, motion was made by Mrs. Hardy seconded by Mrs. Ellender that the following ordinance be adopted to-wit: ORDINANCE NO. 1967, M-C SERIES ORDINANCE PROVIDING FOR THE ANNUAL SALARY FOR THE MAYOR OF THE CITY OF SULPHUR DURING THE NEXT TERM OF OFFICE. WHEREAS the salary of the Mayor of Sulphur was last adjusted on April 12, 2021; and WHEREAS the Home Rule Charter of the City of Sulphur provides the following: The council may, by ordinance, change the salary of the mayor provided that no ordinance changing such salary shall be passed during the last year of the term of the mayor and further provided that the salary change shall not become effective during the term of the mayor in office at the time the salary is changed. WHEREAS the City Council deems it proper to make an adjustment to the salary of the Mayor at a rate commensurate with the raises provided to all general employees of the City over the preceding term;  THEREFORE, BE IT ORDAINED by the City Council of the City of Sulphur, Louisiana, in regular session that: The annual salary for the Mayor of the City of Sulphur shall be set at $118,000 per year for the term beginning in 2026. All other employee benefits and expense reimbursements previously provided for by any ordinance shall remain unchanged. This ordinance shall be effective immediately upon approval or readoption, but the salary provided for herein shall be implemented only on the first day of the new term for the Mayor of Sulphur in 2026. Mr. Loftin stated that this is simply a ratification that should have been done by ordinance. Technically it was ratified by the budget, however in order to be transparent we decided to put it on the agenda and ratify it. If this isn’t adopted, we’ll have to give the $5 million back. Mr. Abrahams, Director of Public Works, stated that one of the projects with this money has already been completed and it was replacing the filters at the North Water Plant (1.8 million), the second project is at the Verdine Water Plant for the clarifier and the piping. Mrs. Thorn stated that all the projects were voted on by Council for their approval and noted that it was with water sector funding. Sheila Broussard, Pecan Street, stated that it was a resident that caught that the CEA wasn’t voted on and she appreciates Administration for doing this the right way to correct the oversight. Mrs. Thorn stated that when the city does a project with the state a CEA is normally required by the state that is uploaded through a portal but the state did not request a CEA this time. It was an oversight by the city, state and water sector program.
