ADJOURN Posted May 26, 2017 MINUTES TOWN OF SUMMERVILLE BOARD OF ZONING APPEALS May 9, 2017 The Board of Zoning Appeals met in the Training Room at Town Hall on Tuesday, May 9, 2017 at 5:00 PM. Present were Denis Tsukalas, Chairman; Lionel Lawson; and Don Nye. Staff present included Jessi Shuler, AICP, Director of Planning/Zoning Administrator and Meredith Detsch, Town Planner. The meeting was called to order at 5:00 PM by the Chairman. He asked for any comments or edits for the minutes from the March 14, 2017 meeting. Mr. Nye made the motion for approval with Mr. Lawson seconding the motion. The motion carried unanimously approving the minutes as presented. OLD BUSINESS: There were no items under Old Business. NEW BUSINESS: The first item under new business was a variance request for TMS# 137-15-08-012, 304 Black Oak Boulevard, zoned PUD, Planned Development District, owned by Micah G. and Bonnie C. Miley, for a reduction in the side setback of 3 feet for a total setback of 4.5 feet for an accessory structure from the ordinance minimum of 7.5 feet per Section 32-125. Ms. Shuler introduced the request. The owner Micah Miley presented the application and gave the Board members a letter from his neighbor stating that they had no objections to the request. Mr. Tsukalas asked if they had a swimming pool in their backyard, and Mr. Miley responded that they do not as the electrical line is buried outside of the easement in the background preventing them from putting a structure in the ground. Mr. Lawson asked how the shed would be built or if it would be prefabricated. Mr. Miley responded that he would build it himself on a floating foundation. Mr. Nye made a motion to approve the request as stated based on the information given, and Mr. Lawson made a second. The motion passed unanimously. MISCELLANEOUS: Ms. Shuler reminded the Board members about the upcoming training on May 18th being hosted at Town Hall that would fulfill their required yearly three hours of training. ADJOURN: Hearing no further business the meeting was adjourned at 5:04 PM with a motion by Mr. Nye and a second by Mr. Lawson. Magnolia Street, Summerville, SC STAFF REPORT BOARD OF ZONING APPEALS June 13, 2017 Appeal: Staff received written objections to the applicant’s application for a conditional use permit for a Bed & Breakfast at the property. The zoning ordinance requires the BZA to hear the appeal per Section 32-212. Background: The property owners originally submitted the application back in February of this year to become a Bed & Breakfast. The property is owned by Magnolia Bed & Breakfast, LLC, of which the Dungans are majority owners and live next door to the property at 111 S. Magnolia Street. The minority owner, Lauren Sheldon, lives in the house at 115 S. Magnolia Street on the second floor. Based on staff review and review by the Town’s attorney, GW Parker, the application appears to meet the intent and conditions of the ordinance. The property and home have passed the required inspection by the Fire Marshal, Building Official, and Zoning administrator.
