Approval of minutes from October 10, 2017 (For below item, signs posted on property October 31, 2017 and ad on October 29, 2017 in Post & Courier) II. OLD BUSINESS: None III. NEW BUSINESS: A. TMS# 137-11-06-009, E. 5th South Street, zoned R-1, Single Family Residential, owned by James A. Bellaire – variance request to reduce the required front yard setback from 30 feet to 21 feet, and the rear setback from 25 feet to 17 feet, Ordinance Section 32-122(f)(3) and (5). (Council District 3) IV. MISCELLANEOUS: V. ADJOURN Posted November 7, 2017 MINUTES TOWN OF SUMMERVILLE BOARD OF ZONING APPEALS October 10, 2017 The Board of Zoning Appeals met in the Training Room at Town Hall on Tuesday, October 10, 2017 at 5:00 PM. Present were Denis Tsukalas, Chairman; Lionel Lawson; Elise Richardson and Don Nye. Staff present included Tim Macholl, Zoning Administrator; and Meredith Detsch, Town Planner. The meeting was called to order at 5:00 PM by the Chairman. He asked for any comments or edits for the minutes from the July 11, 2017 meeting as well as the August 8, 2017 meeting. There being no edits or comments the Chairman asked for a motion. A motion was made by Mr. Nye a second was given by Ms. Richardson. The motion to approve both sets of minutes passed unanimously. OLD BUSINESS: There were no items under Old Business. NEW BUSINESS: The first item under New Business was TMS #137-13-04-030, 120 Parkwood Lane, request to allow an accessory structure to be constructed in the front yard by Elizabeth and john Donehue. Mr. Macholl explained that due to the shape of the applicant’s lot and the orientation of the house on the lot the only location for the proposed structure was actually in the front yard of the property. Mr. Donehue, owner of the subject property explained that because the house is set back so far from the front property line the proposed location is the only place for the structure. He explained that the structure will be set back considerably from the front and side property lines and there will be no tree removal to accommodate the structure. Also, there is a heavy tree line along both front property lines and the structure will not be visible from the street. Mr. Adrian Kwist asked how tall the structure will be, and indicated that the Zoning Ordinance does not allow for accessory structures to be taller than the primary structure. Mr. Donehue explained that the structure will not exceed the height of the house. Mr. Nye made a motion to approve as requested. The motion was seconded by Ms. Richardson. The motion passed unanimously. The second item under New Business was TMS #137-07-07-001, 122 South Main Street, a variance request to allow a flag lot less than five acres, by Niketas Elaine Et Al. Mr. Macholl explained that the Church is expanding and adding a porch to that side of the building and for fire exiting purposes the lot line is required to be moved, requiring the approval of the expansion of the existing flag lot. Ernest Yatrelis explained that the Board of Architectural Review for the Town of Summerville had already reviewed and approved the expansion and porch addition. Mr. Nye made a motion to approve as requested. The motion was seconded by Ms. Richardson. The motion passed unanimously. The third item new business was TMS# 137-10-03-003, 126 West 5th South Street, a request for a side yard setback reduction for an accessory structure, by Clayton and Sandra Thornton. Mr. Macholl explained that the request is to reduce the required 10 foot accessory structure setback down to five feet to accommodate the construction of a new carport and storage building at the rear of the property. Mr. Tsukalis asked what the requirement is and Mr. Macholl explained that in R-1 zoning the required setback for an accessory structure is 10 feet. Mr. Thornton explained that the request had just been approved at the Board of architectural Review last week. He explained that the placement of the carport is to improve safety for pulling in and out of the property, eliminating the need to back out onto W. 5th South Street which is becoming busier. Mr. Tsukalis asked if there was anything to the right of the driveway on the other property, Mr. Thornton explained that there is a garage. Mr. Nye made a motion to approve as requested. The motion was seconded by Ms. Richardson. The motion passed unanimously. MISCELLANEOUS: There were no items under Miscellaneous. ADJOURN: Hearing no further business the meeting was adjourned at 5:16 PM with a motion by Mr. Nye and a second by Ms. Richardson.
