BOARD OF ZONING APPEALS
October 9, 2018
The Board of Zoning Appeals met in the Training Room at Town Hall on Tuesday, October 9, 2018 at 5:00 PM. Present
were Denis Tsukalas, Chairman; Don Nye; and Lionel Lawson. Staff present included Tim Macholl, Zoning
Administrator, and Meredith Detsch, Town Planner.
The meeting was called to order at 5:00 PM by the Chairman. He asked for any comments or edits for the minutes from
the July 10, 2018 meeting. A motion was made by Mr. Nye to approve the minutes as submitted, and a second was given
by Mr. Lawson. The motion passed unanimously.
OLD BUSINESS:
There were no items under old business.
NEW BUSINESS:
The first item under New Business was TMS# 145-02-11-004, 114 Pine Grove Avenue, zoned R-1 Single Family
Residential District, owned by Randall and Donna Sands – variance request to allow 23 foot height for an accessory
structure and greater than 50% of the square footage of the principal structure, Ordinance Section 32-122(i)(1) and 32-
321(g)(5). Mr. Macholl introduced the request, and opened the floor to the property owner, Ms. Donna Sands, to present
their application. Ms. Sands explained that they were looking to build a two story detached garage to provide parking and
storage as well as a residence for her daughter on the second story. It was explained that the project had already been
reviewed and approved by the Town’s Board of Architectural Review at their September 4, 2018 meeting. The location of
the proposed accessory structure was discussed as well as some elements of the topography of the property. Ms. Sands
also indicated that the Tree Board had already reviewed and approved the removal of some trees and bamboo from the
property to accommodate the structure. The required height of the structure is to accommodate an appropriately sloped
roof, and the size variance will allow for adequate living and storage space.
Mr. Nye made a motion to approve the variances as requested. The motion was seconded by Mr. Lawson. The motion
passed unanimously.
The second item under New Business was TMS# 144-00-00-080, Greenwave Boulevard, Zoned B-3 General Business,
owned by Greenwave Self Storage, LLC – variance request to allow developer not to plant the required landscaping in the
rear use buffer, and allow construction activities to be conducted in the use buffer, Ordinance Section 32-322, Class 2
planting area. Mr. Macholl introduced the variance requests and explained that due to some modifications of the proposed
plan, the second variance request to allow construction activity in the required use buffer, is being withdrawn. They will
not be required to do any grading within the buffer. Mr. Josh Williams of Locklair Consulting was given the floor to
discuss the request. He presented the project, and that both SCE&G as well as SCPW were in support of the variance
request for no landscaping in the buffer to eliminate maintenance and tree trimming issues. Mr. Macholl addressed the
Commercial Design review Board’s Final Approval of the proposed project and their support of the requested variance to
relieve the planting requirement.
Mr. Nye made a motion to approve the variance to relieve the developer of the landscaping requirement for the rear use
buffer. The motion was seconded by Mr. Lawson. The motion passed unanimously.
The Third item under New Business was TMS# 137-14-08-006, 111 Sasportas Lane, Zoned R-2 Single Family
Residential, owned by Joe Johnson – variance request to reduce the required sideyard setback from 10 feet to six feet,
Ordinance Section 32-123(e)(4). Mr. Joe Johnson came to the table and presented that the house was built in the 1950’s or
60’s and that it was built at the shown offset from the property line. His intent is do a master bedroom and bathroom
addition on the back of the building, which lines up with the existing wall of the building. To offset the addition to meet
the required set back would not line up with the internal layout of the house. Mr. Nye asked if they were building closer to
the front setback. Mr. Johnson responded that no there will be no construction moving the house closer to the front
property line. Mr. Lawson said that he felt that this will be an improvement to the neighborhood.
Mr. Nye made a motion to approve the variances as requested. The motion was seconded by Mr. Lawson. The motion
passed unanimously.
The fourth item under New Business was TMS# 137-14-09-030, 101 Graham Lane, Zoned R-2 Single Family Residential,
owned by Deepwater Properties, LLC – variance request to reduce the required front yard setback from 25 feet to 20 feet
on both Graham Land and E Richland Avenue, and to reduce the required lot size requirement from 8,500 sf to 7,299 sf,
Ordinance Section 32-123(e)(3) and 32-123(e)(1). The property owner Mr. Allen Woods came to the table after Mr.
Macholl explained the request and turned the floor over to the applicant. Mr. Woods explained that because of the size of
the property, which is smaller than the minimum lot size requirement and the required 25 foot front yard setback that
apply to both the Graham Lane and E. Richland Avenue they were not able to find a house that fit. The home selected can
be fit on the property by reducing the both fronts down to 20 feet. He explained that the goal is to be able to move the
house away from the water tower property and also be able to leave room to the rear to be able to fit a detached garage on
the property. Mr. Tsukalas asked if this variance would be needed if the new UDO were in place. Mr. Macholl explained
that the lot size variance would be required, but the exterior side yard along E. Richland Av. Would not need a variance.
Mr. Nye made a motion to approve the variance to relieve the developer of the landscaping requirement for the rear use
buffer. The motion was seconded by Mr. Lawson. The motion passed unanimously.
MISCELLANEOUS:
There were no items under Miscellaneous.

Hearing no further business the meeting was adjourned at 5:22 PM with a motion by Mr. Nye and a second by Mr. Lawson. The

STAFF REPORT
BOARD OF ZONING APPEALS

Request: Variance request to allow an extra shopping center sign at the corner of Central
Avenue and Orangeburg Road.
Property Zoning: B-3 General Business
Surrounding Zoning: North: B-3 General Business and Out in Dorchester County
South: Out in Dorchester County
East: Out in Dorchester County
West: B-3 General Business and Out in Dorchester County
Ordinance requires: Ordinance Section 32-246(4).
Background: The applicant is requesting offsite shopping center signage to be located at
the corner of Central and Orangeburg. This is prohibited by the Town’s Ordinance.
Planning and zoning staff have concerns with establishing a precedent for additional
offsite signage for shopping centers. Currently, the site has a Piggly Wiggly sign on each
street frontage, and a multi-tenant shopping center sign at the corner. These anchor tenant
signs are not multi-tenant signs, the multi-tenant sign is located at the corner which was
owned by the shopping center at the time. Now there is a different property owner at the
corner and the existing shopping center signage is being displaced by the convenience
store. The proposed multi-tenant sign on the corner exceeds what is permitted based on
the total square footage of the shopping center in question and would need to be a
separate variance request for a sign that size in addition to the variance for offsite
signage.
Based on the size of the development the shopping center would be permitted two signs,
one at each entrance up to 10 feet in height and 80 square feet of sign face. The Parkers
Kitchen will have two signs of 8 feet in height and 50 square feet of sign face. The
developer also proposes a new outlot #2 on Orangeburg Road which would be permitted
its own sign at 8 feet tall and 50 square feet. This will result in two large monument signs
on Central Avenue and possibly three large monument signs on Orangeburg Road when
outlot #2 is developed. The additional “Shopping Center Signage” at the corner would
add to an already visually cluttered area and block the view of the building and
landscaping at the corner.
