Executive Session (as needed) ADJOURN: Agenda Posted: March 30th 2018 Board of Architectural Review Rules of Procedure Article I Organization Section 1. Rules. These rules of procedure are adopted pursuant to S.C. Code § 6-29-870 for the Town of Summerville Board of Architectural Review which consists of seven members appointed by Council. Section 2. Term of Office. The term of office is as stated in Town Code. Section 3. Officers. The officers of the Board shall be a chairman and vice-chairman elected for one year terms at the first meeting of the Board in each calendar year. A member of the staff shall serve as secretary of the Board. Section 4. Chairman. The chairman shall be a voting member of the Board and shall:  Call meetings of the Board;  Preside at meetings and hearings;  Act as spokesperson for the Board;  Sign documents for the Commission;  Perform other duties approved by the Board. Section 5. Vice-Chairman. The vice-chairman shall exercise the duties of the chairman in the absence, disability, or disqualification of the chairman. In the absence of the chairman and vice-chairman, an acting chairman shall be elected by the members present. Section 6. Secretary. The secretary shall:  Provide notice of meetings;  Assist the chairman in preparation of agenda;  Keep minutes of meetings and hearings;  Maintain Board records as public records;  Attend to Board correspondence in accordance with policies of the Town of Summerville and its Town Council; and  Perform other duties as applicable. Section 7. Training. All appointed members shall participate in required training per SC Code § 6-29-1310 in order to maintain membership on the Board for the appointed term. Article II Meetings Section 1. Time and Place. An annual schedule of regular meetings shall be adopted, published and posted at the planning office in December of each year. Special meetings may be called by the chairman upon 24 hours notice, posted, and delivered to all members and local news media. Meetings shall be held at the place stated in the notices, and shall be open to the public. Section 2. Agenda. A written agenda shall be furnished by the secretary to each member of the Board and as required by State and Town statute including being posted at least 24 hours prior to each regular meeting, and at least 24 hours prior to a special meeting. Items may be added to the agenda per State statute. Section 3. Quorum. A simple majority of the members of the Board shall constitute a quorum. A quorum shall be present before any business is conducted other than rescheduling the meeting. Section 4. Rules of Order. Robert's Rules of Order Newly Revised, latest edition, shall govern the conduct of meetings except as otherwise provided by these Rules of Procedure. Section 5. Voting. A member must be present to vote. Each member shall vote on every question unless disqualified by law. Disqualification shall also include recusal from the discussion of an item. The question of disqualification and / or recusal shall be decided by the member affected, who shall announce the reason for disqualification and / or recusal, give it to the chairman in writing, have it placed in the minutes, and refrain from deliberating or voting on the question. Section 6. Conduct. Except for public hearings, no person shall speak at a Board meeting unless invited to do so by the Board. Article III Records Section 1. Minutes. The secretary shall record all meetings and hearings of the Board on tape which shall be preserved until final action is taken on all matters presented. The secretary shall prepare minutes of each meeting for approval by the Board at the next regular meeting. Minutes shall be maintained as public records. Section 2. Reports. The secretary shall assist in the preparation and forwarding of all reports and recommendations of the Board in appropriate form. Copies of all notices, correspondence in accordance with policies of the Town of Summerville of its Town Council, reports and forms shall be maintained as public records. Section 3. Attendance. The minutes shall show the members in attendance at each meeting. The Commission may recommend to the governing body the removal for cause of any member who is absent from three consecutive meetings without adequate reason. Article VI Adoption and Amendment Section 1. Amendment. These rules may be amended at any regular meeting Of the Board by a majority vote of the members of the Board at least seven days after the written amendment is delivered to all members. Section 2. Attest _____________________________ ___________________________ Secretary Chairman or Vice Chairman 2 I. What is the Board of Architectural Review? The Board of Architectural Review (BAR) was established in 1974 as a mechanism to protect the Historic District of the Town of Summerville. The intent of the Historic District is to preserve, enhance the distinctive architecture and showcase the cultural heritage of the district. The BAR has seven members, each of which is appointed for a three year term. One member must be an architect, one a licensed real estate broker, one a member of the Summerville Preservation Society, and one a member of a recognized art association. The remaining three members are at-large. All members must be residents of the Town of Summerville. Town Council appoints individuals to serve on the BAR. The Board of Architectural Review has jurisdiction within the limits of the Historic District of the Town of Summerville. Within these boundaries, the BAR has the authority to grant approval to or to disapprove applications for the demolition or the exterior alteration of any existing structure. In addition, the BAR can approve or disapprove the exterior architectural features of any structure which has been reconstructed, restored or erected after October 15, 1974. In these instances, the BAR serves to ensure that the building conforms to the character of its neighborhood. II. What do I need to submit? 1. Completed Application Submit your completed application with eight copies (no larger than 11 x17) of proposed changes and a digital version 2. Building Materials/Paint Samples For example, roof materials, paint color samples, product literature for windows/siding, etc. 3. Before and After Elevations Scale drawings of the building as it presently exists and as it will look after the renovations are made. 4. Plot Plan-If footprint is changing A scaled survey of your property showing all existing structures (buildings, porches, screen rooms, sheds, garages, decks, pools, carports, etc.) and paved areas (driveways, patios, etc.) plus the proposed structure. All structures on the plot plan (existing and proposed) must have measurements or be to scale. Distances of structures to the property lines also must be noted. 5. Photograph of the property (Photographs of the existing structure) It is recommended that you stand back and aim your camera at the corner of the building in such a manner that the entire front plus one side will be visible in the photograph and the same procedure with the back of the structure. 6. Photograph of the surrounding area Photographs depicting the surrounding properties, i.e. a street scene, that will aid BAR in determining the character of the neighborhood. III. How does the application procedure work? Applications are available in the Planning Department at Summerville Town Hall or on the Town’s website www.summervillesc.gov. The application should be completed and turned in, along with all the materials listed in Number II, to the BAR secretary by the deadlines listed. The BAR meets the first Tuesday of each month at 6 PM at Summerville Town Hall Annex Building. If the application is disapproved, the BAR must give the applicant a written statement detailing the reasons for disapproval. The BAR may also make recommendations to the applicant about design, arrangement, materials, etc., that may help the applicant eventually win approval for his/her project. Any property owner aggrieved has the right to appeal the board's decision before the courts of the State of South Carolina, as provided in S.C. Code 1976 § 6-29-900 et. Seq., as amended, which provides for appeals from the Board of Architectural Review. IV. What factors does the BAR consider in making decisions? In reviewing applications to demolish or renovate existing structures or buildings in the Historic District, the BAR considers the use of the building and the nature and character of the area in which it is located to ensure compatibility. In addition, the historic, architectural and aesthetic features of the building are considered. These three attributes are determined in part through the use of the documents created during the Town of Summerville’s 1979 inventory of the Historic District. During this project, each building was visited by a team comprised of an architect and an historian and then photographed and evaluated in terms of its architectural value, historic significance and relationship and contribution to its surroundings. Individual surveys of these properties are held at Town Hall. V. Tips to smooth the process:  Submit a completed application on time to ensure you are on the agenda and speak with staff to ensure your application is complete  All drawings must be done to scale  Come to the meetings in person – owners should come with their contractor  Attend a meeting before you are ready to submit your application, it will help you know what to expect  Commercial buildings: o Come with your architect early on in the process and submit for conceptual review before finalizing your plans
