I. APPROVAL OF MINUTES: 1. Approval of minutes from meeting on February 26, 2018. II. ADJOURNMENT: ____________________________________ Chairman or Vice Chairman Posted March 15, 2018 The Town of Summerville Planning Commission Meeting Minutes February 26, 2018 This meeting of the Town of Summerville Planning Commission was attended by Commission Members, Jim Reaves, Chairman; Elaine Segelken, Vice Chairman; Charlie Cuzzell; Will Rogan; Margie Pizarro; and Sarah Bares. Staff in attendance included Jessi Shuler, AICP, Director of Planning, Tim Macholl, Zoning Administrator, Meredith Detsch, Town Planner, and Bonnie Miley, Assistant Town Engineer. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes: The Chairman called for a motion for the approval of the minutes from the meeting on January 22, 2018. Ms. Segelken made a motion to approve the minutes as presented with Dr. Bares making the second. Following no discussion the motion carried. Public Hearings: The first public hearing opened at 4:01 pm and was for the request to annex Dorchester Co. TMS#s 143- 04-00-012, Sam Lane; 143-04-00-013, Cone Lane; 143-04-00-018, Sam Lane; 143-04-00-019, Sam Lane; 143-04-00-020, Lazy Acres Loop; 143-04-00-021, Lazy Acres Loop; 144-01-00-004, 803 Orangeburg Road; 144-01-00-019, 809 Orangeburg Road; 136-13-00-005, 824 Orangeburg Road; 136-13-00-009, 810 Orangeburg Road; 136-13-00-008, 100 Claussen Street, 11 parcels approximately 76.43 acres. Currently zoned R-4, Multi-Family Residential, and R-1(M), Single-Family Residential Manufactured Housing in Dorchester County and will be zoned PUD, Planned Unit Development, B-2 Neighborhood Business Centers and R-5 Mixed Residential upon annexation into the Town of Summerville’s municipal limits. Mr. Reaves introduced the request. Chris Campeau with Seamon Whiteside and Associates, Inc. and Joshua Craig with Crescent Homes presented the application. Mr. Campeau provided copies of a revised PUD and exhibits to the Commission and described the revisions that had been made based on staff’s comments, including increasing the minimum lot size and decreasing the impervious surface allowance based on the actual footprint of proposed homes; converting the smallest single family lots to alley loaded; adding additional text regulating the architecture of the homes and providing examples of home elevations; defining street trees and providing a species list; further explaining the phased earthwork request; defining the interpretive pathway materials; more clearly defining the amenity center requirements; adding requested language to address the concerns about the construction routes; changing language to give staff the final determination on drainage easement requirements for Hurricane Branch; and providing street sections and adding alleys. Dr. Bares questioned if the trails would be open to the public, and Mr. Craig explained that they would be owned and maintained by the HOA, but it would be a public road, not a gated community, so the trail system could be utilized by anybody in the public. Mr. Rogan asked if the staff concerns about the timeframe of the road improvements had been addressed with the traffic consultant and if SCDOT had weighed in on the required improvements. Mr. Campeau expressed their desire to work out the timeframe of the road improvements with staff and SCDOT. He did state that the traffic consultant was working with SCDOT to finalize the traffic impact analysis. Mr. Rogan then noted that the percentage of uses shown on the conceptual plan did not appear to be correct and asked that the acreage of the wetlands be reviewed. In regards to the staff comment requiring a sidewalk or multi-use path along Orangeburg Road from the development to Knightsville Elementary School, Mr. Campeau stated that Crescent Homes agreed with the concept but was not comfortable committing to it at this time because they do not have any estimates of the cost. Dr. Bares noted that the BCD WalkBike Plan shows a multi-use path along Orangeburg Road. Mr. Campeau acknowledged that through the PUD, the applicant was asking for some things, but he also felt that they were giving a lot to the Town as well. Dr. Bares questioned the $250,000 price point that was included in the feasibility study, and Mr. Craig explained that it was based off of data from other subdivisions that they and others are building in the area. Mr. Rogan asked about the number of grand trees on the site, and Mr. Campeau responded that there were some scatterings of large trees, but not a huge number. Dr. Bares questioned if the Commission could consider the revised PUD document in their recommendation as it was not posted for public review, and Ms. Shuler explained that they could as the final determination on the PUD approval would be made by Council. Marie Nunn, whose mother owns 100 Claussen Street, stated that her family was surprised to see that the property was being annexed as they were not in support of annexation because it would add an additional financial burden. She requested an explanation of how her mother’s property could be annexed without her consent. Ms. Shuler explained how state law allowed for a 75/25 annexation, and that the chosen route for contiguity provided the least number (only one) of properties to be annexed adversely. Mr. Craig added that he had tried to speak to her mother multiple times, but she never gave him a chance to explain their plans. He mentioned that he would be happy to speak with the family after the meeting. Shirley Murray, who lives at 803 Orangeburg Road, wanted to know when the whole annexation process will be completed. Mr. Reaves explained the annexation process and stated that the second Thursday in April would be the earliest that the process could be finalized if it goes straight through. Ms. Murray also agreed with the need for a sidewalk on the Cone Lane side of Orangeburg Road for safety reasons. With no further comment this public hearing was closed at 5:07 PM. The second public hearing opened at 5:08 PM and was for the petition by Greenwave Self Storage, LLC to annex Dorchester County TMS# 144-00-00-019 (approximately 2.37 acres) located at 434 Orangeburg Road, currently zoned CG General Commercial in Dorchester County and will be zoned B-3 General Business upon annexation into the Town of Summerville’s municipal limits. Ms. Shuler briefly described that the owners are purchasing a piece of property behind them from CPW to expand their existing storage facility. Since the CPW property is already in the Town, this property needed to be annexed to allow the properties to be combined. She also assured the Commission that CPW would be placing deed restrictions on the property to prohibit any residential uses given the immediate proximity to the waste treatment facility. With no further comment this public hearing was closed at 5:09 PM. The third public hearing opened at 5:09 PM and was for the petition by Town of Summerville to annex Dorchester County TMS# 153-00-00-141 (approximately 6.85 acres) located on Ridge Road, currently zoned R-4, Multi-Family Residential in Dorchester County and will be zoned PL, Public Land, upon annexation in the Town of Summerville’s municipal limits. Ms. Shuler acknowledged that this annexation could have been done by a resolution of Council, but in the interest of maintaining full transparency, staff sent it through the full public process. With no further comment this public hearing was closed at 5:10 PM. The fourth public hearing opened at 5:11 PM. Mr. Reaves requested to combine the public hearings for items 4-7 on the agenda for the following proposed amendments: Proposed amendments to the Town Code, Chapter 20, Planning and Development, Article II, Planning Commission, Section 20-32 entitled Composition. Proposed amendments to the Town Code, Chapter 20, Planning and Development, Article III, Development Standards, Section 20-72 Bicycle and pedestrian advisory committee, subsection (c) Organization, item (1) entitled Membership. Proposed amendments to the Town Code, Chapter 32, Zoning, Article III, Zoning District Regulations, Section 32-141 Commercial design review board, subsection (c) entitled Membership. Proposed amendments to the Town Code, Chapter 32, Zoning, Article III, Zoning District Regulations, Section 32-175 Board of architectural review, subsection (b) entitled Membership. The other members did not object, so the public hearings were combined, and Ms. Shuler noted that these were all related to providing consistency in how appointments are made to Citizen Boards and Commissions. With no further comment this public hearing was closed at 5:14 PM. The final public hearing opened at 5:15 PM and was for proposed amendments to the Town Code, Chapter 32, Zoning, Article V, Special Use Permits, Section 32-212 Conditional use permits for bed and breakfast establishments. Ms. Shuler noted that Town Council gave first reading to this amendment, and the purpose of the amendment as she understands it is to clearly define owner-occupied as it is not currently defined in the zoning ordinance, which creates a loophole. Dr. Bares pointed out that there was a couple of typos in the second sentence on the ordinance, and motor inn and boarding house should be changed to plural form. Lisa Hammerlee at 110 W. 2nd North Street and Sharon Wilson at 112 White Pine Way asked if this ordinance change would be enforced retroactively. Mr. Reaves responded that it would not be enforced retroactively as those Bed & Breakfasts that have already been approved met the ordinance requirements at the time of approval, and they would only have to meet these new requirements if they made a change. With no further comment this public hearing was closed at 5:21 PM. Old Business There were no items under Old Business. New Business: The first item under New Business was New Street Names (as applicable). Ms. Shuler stated that staff had one street name for approval, Bullman Lane, in the Limehouse Village subdivision off of Dorchester Road. Ms. Shuler explained that this was for an alley and all three counties had no conflicts. The Commission asked why the suffix wasn’t alley, and Ms. Shuler informed them that it appears that none of the alleys in this subdivision use the alley suffix, but all of them are named, even though no addresses are assigned off of alleys. Mr. Cuzzell made a motion for approval, and Ms. Segelken made the second. The motion passed unanimously. The second item under New Business was the request to annex Dorchester Co. TMS#s 143-04-00-012, Sam Lane; 143-04-00-013, Cone Lane; 143-04-00-018, Sam Lane; 143-04-00-019, Sam Lane; 143-04- 00-020, Lazy Acres Loop; 143-04-00-021, Lazy Acres Loop; 144-01-00-004, 803 Orangeburg Road; 144- 01-00-019, 809 Orangeburg Road; 136-13-00-005, 824 Orangeburg Road; 136-13-00-009, 810 Orangeburg Road; 136-13-00-008, 100 Claussen Street, 11 parcels approximately 76.43 acres. Currently zoned R-4, Multi-Family Residential, and R-1(M), Single-Family Residential Manufactured Housing in Dorchester County and will be zoned PUD, Planned Unit Development, B-2 Neighborhood Business Centers and R-5 Mixed Residential upon annexation into the Town of Summerville’s municipal limits. Mr. Cuzzell made a motion to recommend annexation to Town Council, and Ms. Segelken made the second. Dr. Bares asked if staff could recommend approval of the revisions to the PUD, and Ms. Shuler noted that staff had not had a chance to do a full review of the PUD revisions, but confirmed that a full review would be done before the Planning & Development Committee of Council and that Committee would be given any remaining staff comments. Ms. Pizarro expressed her concern about adversely annexing the one property to provide contiguity. Mr. Craig assured the Commission that he would be speaking with the family further about the annexation. Mr. Cuzzell reminded the Commission that this method of annexation has been used in the past, most recently for Providence Place, which included more than one property that was annexed adversely. Following the discussion Mr. Reaves called for the question, and the motion passed with Ms. Pizarro the lone vote in opposition. The third item under New Business was the petition by Greenwave Self Storage, LLC to annex Dorchester County TMS# 144-00-00-019 (approximately 2.37 acres) located at 434 Orangeburg Road, currently zoned CG General Commercial in Dorchester County and will be zoned B-3 General Business upon annexation into the Town of Summerville’s municipal limits. Mr. Cuzzell recused himself from this agenda item because his employer has an economic interest in the property. Ms. Segelken made a motion to recommend annexation to Town Council, and Mr. Rogan made the second. The motion passed. The fourth item under New Business was the petition by Town of Summerville to annex Dorchester County TMS# 153-00-00-141 (approximately 6.85 acres) located on Ridge Road, currently zoned R-4, Multi-Family Residential in Dorchester County and will be zoned PL, Public Land, upon annexation in the Town of Summerville’s municipal limits. Ms. Segelken made a motion to recommend annexation to Town Council, and Dr. Bares made the second. The motion passed unanimously. The fifth and sixth items under New Business were the proposed amendments to the Town Code, Chapter 20, Planning and Development, Article II, Planning Commission, Section 20-32 entitled Composition and the proposed amendments to the Town Code, Chapter 20, Planning and Development, Article III, Development Standards, Section 20-72 Bicycle and pedestrian advisory committee, subsection (c) Organization, item (1) entitled Membership. Mr. Cuzzell made a motion to recommend approval of both proposed amendments, and Ms. Segelken made the second. The motion passed unanimously. The seventh and eighth items under New Business were the proposed amendments to the Town Code, Chapter 32, Zoning, Article III, Zoning District Regulations, Section 32-141 Commercial design review board, subsection (c) entitled Membership and the proposed amendments to the Town Code, Chapter 32, Zoning, Article III, Zoning District Regulations, Section 32-175 Board of architectural review, subsection (b) entitled Membership. Mr. Cuzzell made a motion to recommend approval of both proposed amendments, and Mr. Rogan made the second. Mr. Reaves asked why the ordinance for BZA was not also included for amendment. Ms. Shuler stated that it was her understanding that the BZA was not included because it only has five members, not seven. Mr. Reaves questioned why the membership of the BZA could not be increased to seven, after which, Ms. Shuler, after checking state law, informed the Commission that state law allowed for the membership of the BZA to be from three to nine members. The Commission noted that seven members would likely make it easier to maintain a quorum, and Mr. Reaves stated that as Chairman, he would speak to Council about the possibility of increasing the membership of the BZA to seven members. Following the discussion, Mr. Reaves called for the question, and the motion passed unanimously. The ninth and final item under New Business was the proposed amendments to the Town Code, Chapter 32, Zoning, Article V, Special Use Permits, Section 32-212 Conditional use permits for bed and breakfast establishments. Dr. Bares recused herself from this agenda item as she is an adjacent property owner and spoke out against the Bed & Breakfast application that prompted the amendment. Mr. Cuzzell asked if she would agree to explain why she was against the Bed & Breakfast, and Dr. Bares agreed, stating that she felt the Bed & Breakfast at 115 S. Magnolia St. with an LLC ownership would de-residentialize the area. Ms. Segelken made a motion to recommend approval of the proposed amendment, and Mr. Cuzzell made the second. The motion passed. Ms. Shuler stated that staff’s only concern was that the current ordinance allows for a Bed & Breakfast in any zoning district, and this amendment would limit the ownership even in a commercially zoned area. Miscellaneous: Dr. Bares provided an update on the issue of vaping that she had discussed at the previous UDO workshop. She noted that the state legislature was now looking at addressing the issue. Adjourn With no further business for the Commission, Mr. Cuzzell made a motion to adjourn with Mr. Rogan making the second, and Mr. Reaves adjourned the meeting at 5:50 PM.
