ADJOURNMENT: ____________________________________ Chairman or Vice Chairman Posted December 13, 2021 The Town of Summerville Planning Commission Meeting Minutes November 15, 2021 This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and was attended by Commission Members, Jim Reaves, Chairman; Charlie Stoudenmire; Kevin Carroll; and Betty Profit. Jonathan Lee, Elaine Segelken, and Tom Hart were unable to attend. Staff in attendance included Jessi Shuler, Director of Planning. The public was invited to attend in person, or they viewed the meeting via live-stream. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes: The Chairman asked if there were any edits or additions to the minutes from the meeting on October 18, 2021. Hearing none, the minutes were accepted as presented. Public Hearings: The first public hearing opened at 4:00 PM and was for the petition by Marymeade Associates Limited Partnership to annex a portion of Berkeley County TMS# 232-00-02-052 (total of 2.54 acres) located off Marymeade Drive, currently zoned PD-MU, Planned Development Mixed Use in Berkeley County and will be zoned G-B, General Business upon annexation into the Town of Summerville’s municipal limits. (Council District 2). Mr. Reaves introduced the item. Hearing no public comment, this public hearing was closed at 4:01 PM. The second public hearing opened at 4:01 PM and was for the petition by the Town of Summerville to annex portions of: State Road S-18-59 (Parsons Road), Linning Road, TMS#137-01-00-007 (Tract #6 Leach) and TMS#137-01-00-006 (Tract #7 Miller). Mr. Reaves introduced the item. Hearing no public comment, this public hearing was closed at 4:02 PM. Old Business As both applicants requested postponement to continue to work through issues, item one for the petition by Nash-Nexton Holdings, LLC to annex a portion of Berkeley County TMS# 221-07-05-130 (total of 20.923 acres) located along Brighton Park Blvd., currently zoned PD-MU, Planned Development Mixed Use in Berkeley County and will be zoned PUD, Planned Development District upon annexation into the Town of Summerville’s municipal limits, and the existing Nexton PUD shall be amended to include this acreage and the additional land use intensities. (Council District 2) and item two for petitions to annex Berkeley County TMS#s 232-00-02-028, Bellwright Road, owned by I-26/78 Associates LLC; and 232- 00-02-043, Finucan Road, owned by William R. Heatley, Jr.; two parcels totaling approximately 107.75 acres, currently zoned HI, Heavy Industrial and R1, Single-Family Residential in Berkeley County and will be zoned PUD, Planned Development District upon annexation into the Town of Summerville’s municipal limits. (Council District 2) were taken up together. Mr. Carroll made a motion to postpone consideration on both items until the applicants requested to move forward, and Ms. Profit made the second. Mr. Carroll asked if there was a time limit on how long the applicant could postpone, and Mr. Reaves noted that the Planning Commission would generally work with applicants and give them a reasonable amount of time, usually not to exceed six months. Ms. Shuler confirmed that there was not a specific time limit if both parties agreed to the postponement, but six months was usually the max. Following the discussion Mr. Reaves called for the question, and the motion passed unanimously. New Business The first item under New Business was New Street Names. Ms. Shuler stated that she did not have any new street names for consideration this month. The second item under New Business was the petition by Marymeade Associates Limited Partnership to annex a portion of Berkeley County TMS# 232-00-02-052 (total of 2.54 acres) located off Marymeade Drive, currently zoned PD-MU, Planned Development Mixed Use in Berkeley County and will be zoned G-B, General Business upon annexation into the Town of Summerville’s municipal limits. (Council District 2). Mr. Carroll made a motion to recommend approval and Ms. Profit made the second. Mr. Carroll asked for clarification on how much of the property was taken up by the pond and why the request was for G-B zoning. Ms. Shuler explained that almost all of the property was taken up by the pond, but that there was room for a maintenance shelf and landscape screening. She noted that the zoning of G-B matched the zoning of the property for which the pond will serve and that the surrounding property would annex into Town when it develops and would likely also be zoned G-B at that time. Following the discussion Mr. Reaves called for the question, and the motion passed unanimously. The third item under New Business was the petition by the Town of Summerville to annex portions of: State Road S-18-59 (Parsons Road), Linning Road, TMS#137-01-00-007 (Tract #6 Leach) and TMS#137-01-00-006 (Tract #7 Miller). Mr. Carroll made a motion to recommend approval, and Mr. Stoudenmire made the second. Ms. Shuler briefly explained that the annexation was for portions of the right-of-way of Parsons Road and Linning Road and for small slivers from the two tracts. The two slivers have already been acquired by the Town and will become part of the right-of-way for the Maple Street project. Following the explanation, Mr. Reaves called for the question, and the motion passed unanimously. Miscellaneous: Ms. Shuler reminded the Commission about their required three hours of training before the end of the year, and also reminded them about their special meeting scheduled for December 1, 2021 at 4:00 PM to consider the Capital Improvements Plan and Impact Fee Study. Public Hearing: The public hearing opened at 4:03 PM and was for the Proposed 5 year Capital Improvements Plan (CIP) for FY 2021-2026. The CIP for the Town of Summerville guides future funding, scheduling and construction of capital improvements. Projects included in the CIP reflect both short-term and long-term investments in local infrastructure. Mr. Reaves introduced the item. Hearing no public comment, this public hearing was closed at 4:04 PM. Old Business New Business The first and only item under New Business was the resolution for proposed amended Capital Improvements Plan (CIP) for FY 2021-2026 and revised Development Impact Fee Ordinance. Mr. Carroll made a motion to approve the resolution, and Ms. Segelken made the second for purposes of discussion. Ms. Segelken noted that she would like for Council to look at the 2019 numbers for the impact fee calculations and compare them with the 2020 numbers used, since 2020 was such an odd year. Mr. Reaves agreed. Mr. Carroll questioned whether inflation was taken into account in the CIP, and if not, he believes that an inflation rate should be added. Ms. Segelken agreed, stating that she did not know if the inflation rate would continue to climb, but she thinks it will remain higher for at least the next year. She also stated that she did not think that the impact fees should be discounted at all, but that the Town should charge the maximum allowable amount. Mr. Reaves also pointed out that the inputs in the CIP needed to be smoothed over, but he did not have a problem recommending it as he knows it will be reviewed more closely prior to final adoption. The Commission members all agreed with the comments noted. Mr. Reaves called for the question, and the motion passed unanimously with agreement that their additional recommendations to Council would be reflected in the meeting minutes. Respectfully Submitted, Date: __________________________ Jessi Shuler, AICP Director of Planning Approved: _________________________________________________ Jim Reaves, Chairman or Kevin Carroll, Vice Chairman ANNEXATION STAFF REPORT PLANNING COMMISSION December 20, 2021 TMS#s: 138-00-00-015 Location: E. 5th North St. and South Pointe Blvd. Description: one parcel, approximately 15.7 acres Request: Annexation and zoning to MF-R, Multi-Family Residential The property owner is requesting for the above referenced parcel to be annexed into the Town Dorchester County. The existing zoning in Dorchester County is TRM, Transitional Residential District. This property is included in the Town’s ‘Neighborhood Mixed Use’ District within the as identified within the Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land Use Map. The Neighborhood Mixed Use designation is intended to encourage the integration of commercial and a variety of residential land uses within easy walking distance of each other. Commercial uses should include residentially scaled businesses, such as sales of consumer goods, health and personal care, professional services, offices, restaurants, and religious institutions. Residential land uses such as, townhomes, rowhouses, duplexes, live-work units, single- family housing and accessory dwelling units are encouraged. This property is also included as a priority annexation area in the Community Facilities & Infrastructure Element of the Comprehensive Plan, and is along the proposed route for Lowcountry Rapid Transit. The applicant will most likely be required to do a Traffic Impact Analysis for the proposed use, but this will be dependent on the number of units proposed and other safety considerations. The fiscal impact analysis does show that the project will lead to a significant loss for the Town over 20 years. Based on these findings the requested MF-R, Multi-Family Residential, zoning district is interpreted by staff to be in conformance with the Town’s Comprehensive Plan; however, staff is somewhat hesitant to recommend approval given the calculated loss to the Town over a 20 year period per the Fiscal Impact Analysis. Older manufactured homes may not be built with a roof overhang, and it is not feasible to build a roof with an overhang on these homes. In addition, screening the tongue, axles, running lights, and removable towing apparatus should be sufficient, rather than requiring complete removal of all. AN ORDINANCE TO AMEND THE SUMMERVILLE UNIFIED DEVELOPMENT ORDINANCE, SECTION 3.4.2, RESIDENTIAL USE CATEGORIES, SUBSECTION (D.3) ENTITLED MANUFACTURED HOUSING DESIGN STANDARDS, OF THE TOWN OF SUMMERVILLE CODE OF ORDINANCES BE IT ORDAINED by the Mayor and Council members of the Town of Summerville, in Council assembled, that the Summerville Unified Development Ordinance, Section 3.4.2 Residential Use Categories, Subsection (D.3) entitled Manufactured Housing Design Standards is amended to read as follows: 3. Design Standards a. Permanent Installation i. A continuous foundation enclosure, unpierced except for required ventilation and access, shall be installed. The enclosure may consist of brick or concrete block, or other masonry, or wood, rigid vinyl or metal fabricated for this purpose. ii. Any wood framing for foundation skirting shall be constructed with treated lumber. The foundation or skirt shall be in compliance with all applicable codes and regulations iii. Any tongue, axles, running lights, and removable towing apparatus must be removed or screened prior to the issuance of a certificate of occupancy. b. Roofs i. Roofs must be covered with a material that is customarily used on site-built dwellings. c. Wall Materials i. Exterior siding shall be wood, vinyl, metal horizontal siding, brick, fiber cement board, stucco, or similar materials. Smooth, ribbed, or corrugated metal or plastic panels, exposed plywood, and materials with a high-gloss finish are not permitted. Ratified this day of , 2022 A.D.
