The Town of Summerville Planning Commission Meeting
Minutes
November 21, 2022
This meeting of the Town of Summerville Planning Commission was held virtually via the Zoom Cloud
Meeting Application and was attended by Commission Members, Jim Reaves, Chairman; Kevin Carroll;
Tom Hart; Jim Bailey and Betty Profit. Elaine Segelken and Charlie Stoudenmire were unable to attend.
Staff in attendance included Jessi Shuler, AICP, Director of Planning. The public viewed the meeting via
live-stream.
Jim Reaves, Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes:
The Chairman asked if there were any edits or additions to the minutes from the meeting on October 17,
2022. Mr. Bailey made a motion to approve the minutes as presented, and Mr. Hart made the second. The
motion passed unanimously.
Public Hearings:
There were no public hearings on the agenda.
Old Business
There were no items under Old Business.
New Business:
The first and only item under New Business was New Street Names. Ms. Shuler stated that they had one
street name to review this month. The proposed name of Southern Cove Lane is for a four lot subdivision
off Shepard Street. Mr. Hart made a motion to approve the street name of Southern Cove Lane, and Mr.
Carroll made the second. The motion passed unanimously.
Miscellaneous:
Ms. Shuler stated that the only item she had under Miscellaneous was to remind those that had not
completed their three hours of required training to get in done before the end of the year. Mr. Hart asked
if the December meeting would be on the 19th, and Ms. Shuler confirmed that it would be, she believed that
there would be at least a couple of items on the agenda.
Adjourn
With no further business for the Commission, Mr. Hart made a motion to adjourn with Mr. Carroll making
the second. The motion carried and the meeting was adjourned at 4:03 PM.

Applicant: Nexsen Pruet, LLC
TMS#s: 152-00-00-051 and 152-01-02-007
Location: Flood Heirs Road and 116 Flood Heirs Road
Description: two parcels, approximately 17 total acres
Request: Annexation and zoning to UC-MX
The property owners are requesting for the above referenced parcels to be annexed into the Town
from Dorchester County. The existing zonings in Dorchester County are MUC, Mixed Use
Community District and R-1, Single-Family Residential.
These properties are not within the Planning Area as identified within the Summerville: Our Town,
Our Future Comprehensive Plan as well as on the accompanying Future Land Use Map. The adjacent
Limehouse Village PUD does allow for apartments and commercial development in the portions of
the development adjacent to the future route of the Berlin G. Myers Parkway, although no apartments
will be built. Dorchester County’s Future Land Use Map within their 2018 Comprehensive Plan
identifies these properties as Medium Density Traditional Neighborhood. That land use designation
supports the integration of higher levels of density, a mix of uses, and a variety of housing types,
including apartments.
Staff cannot determine whether this request is in conformance with the Town’s Comprehensive Plan
Future Land Use Map, as it is outside that boundary; however, it does appear to be largely in
conformance with Dorchester County’s Future Land Use Map and the proposed UC-MX zoning is in
line with the uses in the approved Limehouse Village PUD on the adjacent property and with
Dorchester County’s MUC zoning district, which is the current zoning district for the smaller
property. Sewer availability/capacity and coordinating access and connectivity with SCDOT are
concerns that will need to be discussed further throughout the development process. The Traffic
Impact Analysis (TIA) and Fiscal Impact Analysis (FIA) have not yet been finalized for this proposed
development at this time.

Request: Rezoning to N-MX, Neighborhood Mixed-Use
The applicant is requesting for the above referenced parcel to be rezoned to N-MX from the current
zoning of GR-2.
This property is included in the Town’s ‘Single-Family Residential’ area as identified within the
Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future
Land Use Map, which includes detached single-family uses with a typical density of 2-5 units per
acre.
This property currently has a small retail frame shop. The property was built in the 1920s as a
commercial building prior to the Town’s adoption of modern zoning districts. While the property is
immediately adjacent to other single-family homes, it does front S. Main Street and is across from a
school and the District Two Administrative offices. The existing use is a legal non-conforming use,
and the UDO does not allow a change to any other nonconforming use. The applicant would like to
use the building for their law office; however, since physical changes to the building (mostly interior)
would be required, the change in use to another nonconforming use is not allowed without a rezoning.
The N-MX zoning district is the most restrictive zoning district that would allow for the use of a
professional office. If the rezoning is approved, any exterior changes would still require BAR
approval.
The proposed rezoning is not in line with the Town’s Future Land Use Plan; however, it is the
Planning Commission’s decision and then ultimately Council’s decision as to whether the rezoning to
Neighborhood Mixed-Use would detract from the character of the surrounding area, or if it would
better fit the existing structure and the context of this site.
