The Town of Summerville Planning Commission Meeting Minutes January 23, 2023 This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and was attended by Commission Members, Jim Reaves, Chairman; Kevin Carroll; Tom Hart; Jim Bailey; Charlie Stoudenmire; Betty Profit; and Elaine Segelken. Staff in attendance included Jessi Shuler, AICP, Director of Planning and Tim Macholl, Zoning Administrator. The public was invited to attend in person, or they viewed the meeting via live-stream. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes and Election of Officers: The Chairman asked if there were any edits or additions to the minutes from the meeting on December 19, 2022. Mr. Bailey made a motion to approve the minutes as presented, and Mr. Carroll made the second. The motion passed unanimously. Mr. Reaves then asked if there were any nominations for Chairman for 2023. Ms. Segelken moved to nominate Mr. Reaves again, and Mr. Carroll seconded. Mr. Reaves called for the vote, and the motion passed unanimously. Ms. Segelken then moved to nominate Mr. Bailey as Vice Chairman, and Mr. Carroll made the second. Mr. Reaves called for the vote, and the motion passed unanimously. Public Hearings: Ms. Shuler noted that the applicant for the first two items on the agenda for a public hearing (petition by Diana T. Davis to annex TMS#145-07-05-056, located at the corner of Miles-Jamison Road and Pebbles Lane and totaling approximately 0.55 acres. Currently zoned R-1, Single Family Residential, in Dorchester County and will be zoned GR-5, General Residential (5 units/acre), upon annexation into the Town of Summerville’s municipal limits. (Council District 3) and the request to rezone TMS#145-07-05- 057, located on Miles-Jamison Road, approximately 4.59 acres, and owned by Diana T. Davis, from PUD, Planned Development District, to GR-5, General Residential (5 units/acre). (Council District 3)) had requested that the applications be deferred until the February meeting. Mr. Carroll made a motion to defer the public hearings and any decisions on those two agenda items until the February meeting, and Ms. Segelken made the second. Mr. Reaves called for the vote, and the motion passed unanimously. The first public hearing opened at 4:03 PM and was for the request to rezone TMS#137-09-01-057, located on Central Avenue, approximately 2.98 acres, and owned by 725 Central LLC, from PUD, Planned Development District, to N-B, Neighborhood Business. (Council District 1) Mr. Reaves introduced the item and asked if the applicant would like to present the request. Marty Gunter with MAG Construction Services, LLC explained that he had the property under contract pending the rezoning. He is a general contractor and would like to be able to build a small office to run his business and then add self-storage to the property in the future. Hearing no public comment, this public hearing was closed at 4:04 PM. The second public hearing opened at 4:05 PM and was for the petition by Dorchester County Community Outreach to annex TMS#146-14-00-009, located on Jamison Road and totaling approximately 3.45 acres. Currently zoned CG, General Commercial, in Dorchester County and will be zoned G-B, General Business, upon annexation in the Town of Summerville’s municipal limits. (Council District 3). Mr. Reaves introduced the item and asked if the applicant would like to present the request. Joe Friday with Dorchester County Community Outreach (DCCO) explained that DCCO was a Christian-based nonprofit for homelessness. He noted that they used a voluntary, relationship-based model that required those living at the shelter to be capable of seeking employment and to follow certain rules of conduct. DCCO has helped over 700 men and women since 2015. The current plans for the property in question includes three phases: first would be to reestablish a men’s shelter to house 16 men (the current men’s shelter on Central Avenue is on leased property, and the owner no longer wants to allow an extended lease or to sell the property); second would be a women’s shelter to house 16 women (the current women’s shelter only holds eight women and there is no room to expand on the current property on Central Avenue); and third would be a building for their support services and that could serve as a warming and cooling shelter when needed (they have also been working with Dorchester County to provide a site for a warming/cooling shelter when necessary, as Dorchester County has no long-term location). He provided that extra security would be present when the warming/cooling shelter was in use. Mr. Friday stated that they currently had the proper zoning in Dorchester County, but they were required to request annexation into the Town in order to gain access to sewer service from Summerville CPW. He noted that they would like to be in the Town anyway, due to the enhanced services that the Town offers, particularly police and fire. They understand that the review process is more stringent in the Town, and they intend to try to exceed the required buffers and setbacks where at all possible and intend to be a good neighbor. Mr. Reaves then opened the floor to the public to comment. First, Ms. Shuler read a petition that had been submitted to stop the proposed homeless shelter and stated that at the time it was submitted it had 676 signatures. Ms. Shuler then informed the Commission that she had additional comments that had been emailed to her and asked if they would like those read into the record. After a brief discussion, Mr. Bailey made a motion to make those emailed comments a part of the record by appending them to the meeting minutes, and Mr. Hart made the second. The motion passed unanimously. Candy Stokes of 600 Alwyn Blvd. – expressed concerns about the safety of the children at the bus stops in the area and the trash that would be left in the area. She stressed that she bought her house as her forever home, but she doesn’t want to live in fear. There are five neighborhoods with a large number of children and elderly that would be affected, so there has to be a better place somewhere else. Ron Meetze of 104 Quendon Ct. – stated that he also submitted emailed comments, which he stands by. He noted that this was a result of a poor decision of Dorchester County to amend their ordinance to allow homeless shelters. He admitted that the DCCO is a Christian organization, but added that Summerville Place is largely Christian, working people, and why should something else be put on their backs. Mr. Meetze also mentioned the widening of Miles-Jamison Road, which is going to happen, and stressed that there could not be a worse place for this. He pleaded for the Town not to repeat the County’s bad decision. Gwen Bobo of Buckshire – noted that the traffic on Miles-Jamison is already tremendous with hardly a shoulder and no sidewalk, and people have been killed on that road, so there has to be a better place. She added that she finally bought a home in Summerville and this will deplete her property values. Ms. Bobo stressed to the Commission that if they would live next to a homeless shelter, then put it there, but if not, then don’t. Jeff Becker of 254 Withers Ln. – explained that he was one of the engineers that worked on the roundabout on Miles-Jamison, and he appreciates the organization and its mission, but a shelter should be placed with in a more navigable setting, ideally within walking distance of community areas and employment or with available transit. This location will only act as a band-aid if there is no ability for those being helped to get to places for those services. Jason Cain of Buckshire – stated this proposal doesn’t seem to be in line with DCCO’s need to be able to expand in the future. He noted that there is no access to government or non-government services so they would be creating a transportation issue for those they are serving as there are no bus stops nearby; the safety of the residents and anyone traveling Miles-Jamison would be compromised. This area is on the fringes of the Town so this will strain emergency services as well. He believes that there is a better location and questioned why they were moving from their current location. Mr. Cain noted that the homeless are not necessarily rule followers in his experience. Wayne Hanna of 220 Withers Ln. – stated that the large proposed park going on the other side of the street was a big selling point when he moved into his neighborhood. He is concerned about the safety of the kids and feels that Oakbrook would be a better location because it is closer to services. Lori Kolczynski of 109 Upcerne Rd. – moved to Summerville Place in 2010. The mission of DCCO is wonderful and shelters are needed, but it is a nonprofit, so no money will come back into Summerville, and it will not benefit them as neighbors. The organization already received COVID money, but they keep wanting and wanting. Chris Vierra of 313 Savannah River Dr. – this location being in the middle of a residential community with school bus stops all along and adjacent to forested areas puts children at risk if this is allowed to go through. Shaun Kahn of 211 Granton Edge Ln. – stated that she wanted to serve as a voice for the homeless people. She noted that there are plenty of people who aren’t homeless that she doesn’t feel safe around. Her church cooks once a month at the shelter, and she has never seen litter around the building. Most have a job and likely no car, so traffic would be limited. Ms. Kahn explained that they need to move to be able to expand the women’s shelter, and the men’s needs to move because they have no long-term lease. She stressed that everybody wants them housed, but nobody wants them in their community. Paul Klutz of 409 Salterton St. – there is a whole tract behind Salterton and Sawtry that the developers say they have no plans to build on, and if you put a warming shelter in this area, all it does is invite the people living in the woods off Ladson to come right in behind our houses, and those people do not want help. They will take whatever they’re given, and then come live behind our houses and do whatever they want while we are at work. He stressed that his main concern was inviting all of that into the neighborhood. Mr. Reaves closed the public hearing at 4:42 PM. The last public hearing opened at 4:43 PM and was for the request to rezone TMS#136-12-04-112, 629 Parkwood Drive, approximately 0.38 acres, and owned by James C. and Tina J. Horne, from GR-5, General Residential (5 units/acre), to N-B, Neighborhood Business. (Council District 1) Nancy McKewen with Tupco, representing the applicant and property owners, explained that the tenant was already using this property behind Fish Camp for parking, and the house was being used as an office and for storage currently. Hearing no public comment this public hearing was closed at 4:43 PM. Old Business There were no items under Old Business. New Business: The first item under New Business was New Street Names. Ms. Shuler stated that they have street names in two different developments to review this month. The proposed names of Osprey Ridge Lane and Split Leaf Lane are for Phase 4 of Limehouse Village. The phase needs two street names. Ms. Segelken made a motion to approve the two proposed street names, and Mr. Bailey made the second. The motion passed unanimously. Ms. Shuler stated that an apartment complex off Limehouse Drive needed one street name and the following names were proposed: Marisco and Amato. Ms. Segelken made a motion to approve Marisco, and Mr. Bailey made the second. The motion passed unanimously. The second item under New Business was the request to rezone TMS#137-09-01-057, located on Central Avenue, approximately 2.98 acres, and owned by 725 Central LLC, from PUD, Planned Development District, to N-B, Neighborhood Business. (Council District 1) Mr. Carroll made a motion to recommend rezoning, and Ms. Segelken made the second. Mr. Reaves then called for the question and the motion passed unanimously. The third item under New Business was the petition by Dorchester County Community Outreach to annex TMS#146-14-00-009, located on Jamison Road and totaling approximately 3.45 acres. Currently zoned CG, General Commercial, in Dorchester County and will be zoned G-B, General Business, upon annexation in the Town of Summerville’s municipal limits. (Council District 3). A woman from the audience came to the podium questioning the commercial zoning. Mr. Reaves called for her to sit back down as the public hearing was over and explained that the existing zoning in the County is General Commercial, and the Town’s General Business is the closest matching zoning district. He clarified that under Dorchester County zoning the petitioner could legally build what they are proposing. Mr. Hart then made a motion to recommend approval, and Mr. Carroll made the second. Mr. Reaves asked if there was any discussion. Mr. Hart asked for confirmation from Ms. Shuler that under the terms of CPW the petitioner is required to seek annexation into the Town first. Ms. Shuler confirmed that Town Code requires that any property adjacent to the Town limits that is served by CPW must request annexation before they can serve them. Mr. Hart then questioned if sewer could still be provided if annexation was denied, and Ms. Shuler confirmed that it could. He then asked for confirmation that the Town’s denial of the annexation would not then stop the construction of the homeless shelter, and Ms. Shuler confirmed that as far as she was aware, it would not stop it. Mr. Hart then asked for Ms. Shuler to put the exhibit map back on the screen and noted that the map showed that there was already a buffer between the proposed annexation site and the lots in the neighborhood, that if the property came into Town, an additional 30 foot buffer filled with vegetation would be required. Ms. Shuler responded that there did appear to be an HOA area between the back of the neighborhood lots and the proposed annexation site, and she confirmed that a 30 foot vegetated buffer would be required if the property was developed in the Town limits. Mr. Reaves asked how that buffer requirement compared to Dorchester County’s. Ms. Shuler stated that she had not been able to confirm with Dorchester County, as one place in the ordinance appeared to have a 50 foot buffer requirement, but another place showed a different requirement. Mr. Hart then asked Mr. Friday with DCCO a number of questions regarding how the new shelters will operate, including if they perform background checks (yes); a SLED check (yes); allowed sex offenders (no, not in this location as it is too close to the school); have 24 hour video monitoring (yes); require a special card to access the facility (yes and a code to key in); require the residents to seek employment (yes); have any tolerance for drugs and alcohol (no, none); perform random drug and alcohol testing (yes); perform drug and alcohol testing if there is suspicion of use (yes); allow residents with mental health issues (no, they do not have the ability to help them, so they refer them elsewhere); require residents to sign a contract stating that they understand the rules (yes, and if it is violated, they are asked to leave); would the warming shelter be in a separate building (yes, with offices and a meeting room as well); how would the warming/cooling shelter be operated (no specific policies yet but will follow best practices and security will always be present if people who are not already vetted are present); understand that a 30-foot vegetated buffer is required along the property adjacent to any residential properties (yes and will also be willing to install a solid wood fence on the side and rear.) Ms. Segelken asked if the shelters were modeled after 180 Place, and Mr. Friday responded that DCCO used a different, more relationship-based model. She noted that there are lots of people who are only several steps from homelessness, but she is also very aware that there are also many others that are in the woods and who are voluntarily committed to maintaining the lifestyle that they have and will probably never come to DCCO’s facility. Those people will unfortunately continue to camp out on anyone’s property that cannot successfully keep them off. Mr. Hart stated that he had some additional questions, including if there was a curfew at the facilities; if the residents eat at the facility; and if anyone else is allowed in for food? Mr. Friday responded that yes, there is an 8:00 PM curfew, but if a resident works nights, they will know and are allowed in after they get off work. The residents do eat at the facility and take turns cooking and cleaning as well. No one else if allowed in for meals. Ms. Segelken questioned the ability for growth given the size of the property, and Mr. Friday responded that they were only looking to reestablish the men’s shelter at its current capacity of 16 residents, expand the women’s shelter capacity from the current site to 16 residents on this site, and have the warming/cooling shelter and support center. They would not be looking for any other growth. Mr. Carroll commented that in his personal experience homeless shelters are always in commercial areas with sidewalks and connectivity. In this location, you can’t walk to anything, so he doesn’t think it will work in a residential area like this, and it will be more successful if the residents can travel independently. Mr. Bailey asked Mr. Friday about the accessibility of the shelter to the residents and how they would safely access. Mr. Friday responded that the existing shelters on Central Avenue have a very similar problem, and while the traffic might not be ideal, some of the existing residents ride 10-12 miles on bike to travel to and from work. He agreed that they would work with others to improve the situation. Mr. Stoudenmire stated that he worked for Dorchester District Two serving families and children for many years, and that children do not need any more fear in their lives, so he cannot support this. Mr. Hart explained that he’d been to the existing shelters and taken his children, parents, and grandchildren. Based on his experience the residents there are not who you need to be worried about. The organization provides hope and opportunity for people who seek to improve themselves and just need assistance, not the mentally ill or the sex offenders. Mr. Hart compared comments today to the arguments that were presented about Children in Crisis when they sought a rezoning on E. Richardson Ave. He lives a block from Children in Crisis, and he is proud to say that it is a good addition to the community. He stated that he understands the concerns and values the safety of his loved ones, but he is going to vote in support of this because it is the Christian thing to do. Following the discussion, Mr. Reaves then called for the question, and the motion passed 4-3 with Mr. Carroll, Mr. Stoudenmire, and Ms. Profit voting in opposition. The fourth and final item under New Business was the request to rezone TMS#136-12-04-112, 629 Parkwood Drive, approximately 0.38 acres, and owned by James C. and Tina J. Susan Smith signed this petition Shakita Walker Luersen started this petition Recently a gentleman named Joseph Friday from Dorchester County Community Outreach (DCCO), *not owned by Dorchester County, contacted Julie at our property management office and asked to be put in touch with a member of the HOA board. I spoke with Joseph on the phone December 16th and was asked to meet with him, as DCCO had just purchased property next to our neighborhood and they’re “looking to be good neighbors”. The only information I was provided with at that time was that they presently run the Home of Hope and Hope’s House, located at 821 Central Avenue, Summerville, and they are planning to build a shelter on the piece of property they purchased right outside of our neighborhood on Miles Jamison Road. A meeting was scheduled for December 20th and we all (Shakita Walker Luersen, Susan Sheldon, Kerry Consalvi, and myself) met with him, along with a lady by the name of Ginny Vicini. At this time we found out that they are planning to build a homeless shelter on the property to the right when you’re leaving our neighborhood. It’s the commercial property at the traffic light at Beverly Drive which backs up to Salterton and Sawtry. Their plan is to build 3 separate buildings…one for a men’s shelter, one for a women’s shelter, and one to be used as a warming shelter. They only accept people who are able to work and their mission is to give these folks somewhere to stay while they build up their finances by working until they can move out on their own. This is said to generally take around 6 months. They perform background checks on everyone and clear them for housing on a case to case basis. While maintaining transparency during our questioning, they stated that they have housed felons…burglary to be exact. Needless to say all of this is extremely unsettling. They might have a vision, but we do too…to ensure the safety of our children, to protect the people of Summerville Place from potential crime, to keep drugs away from our neighborhood, and to protect our investments from decreased property values. We are working to find out if it’s even possible to prevent them from moving forward with this. We will have a fight on our hands! The SCDOT is supposed to widen Miles Jamison at some point and this would definitely interfere with anything built on the plot of land the DCCO has purchased. The HOA also learned that there will be a cooling and warming center built at some point which will bring more people to an already congested area. While the DCCO stated that background checks were done on all residents, yet they house felons, I am unsure how background checks can be done for those coming to the cooling/warming center. Also, the National Association of Realtors has done extensive research on the impact the establishment of different types of businesses in or near a primarily residential neighborhood has on property values. One type of entity that the National Association of Realtors has examined is a homeless shelter. Through its research and analysis, the National Association of Realtors has concluded that a homeless shelter in a residential neighborhood has the potential for lowering property values by 12.7 percent. Please ask Dorchester County Community Outreach to reconsider their plan and find a more suitable location. We love the quiet, family atmosphere and have enjoyed being a part of this neighborhood. We live in the very back, so the building of the shelters will not directly affect us. What does affect us is the impact on our neighbors in the front and the increased travel along Miles Road. Honestly, I wanted to be behind this project in the beginning. I believe that our nation is in a crisis regarding affordable housing, so a shelter similar to the other two would have been much more acceptable. This is completely different and simply a huge project to try and create with no model(I asked DCCO for a similar project model in a residential area)....in the center of a residential area. The biggest issue is the warming/cooling shelter. If your child was sleeping less than 100 feet from 25-30 non-vetted people who may or may not have psychological or addiction issues, I'm sure it would concern you. Another major problem(for the county and city if this annex is allowed) is the liability. DCCO told us that they have partnered with the county and city for the building of these structures. If money was granted, that is true. I believe if something goes wrong that it will be a huge financial problem for everyone involved. Why claim to have partnered with the city before it's even annexed is interesting. The travel issue alone for the residents is a major liability; however, my mind can't help but go to the fact that if a current local resident is harmed(especially a child), every organization involved will and should be held accountable. The road is simply not safe for travel and a warming/cooling shelter is not acceptable in such a major residential hub. Please truly consider the impact this will have on this community. Due to the reasons I have listed below, I am strongly against the property being annexed. 1) Increased bike and foot travel on Miles Jamison. Miles Jamison is a busy road without any sidewalks, bike paths, and limited lighting. We are not heartless people as DCCO and many others are trying to make us sound. We do feel that there is 100% a need for these types of buildings but there are much better areas to put them in. I know that the property is already zoned and ready for them to build on but I believe that the buffers with the Town of Summerville are much smaller than they are with Dorchester County. While all of the residents in Summerville Place agree that there is a need for such a service, we have some safety concerns that were unable to be satisfied. The obvious first concern is the safety of the neighborhood residents, and even more so, the children of the neighborhood. We invited DCCO to our HOA meeting and they graciously agreed to come and answer questions for us. After dozens of questions were asked the same type of answers were given over and over again. DCCO has little or no security protocol in place to be able to handle even the smallest issue. The typical answer was "that almost never happens here" which is just not going to be sufficient when they are in my backyard separated by only a thin wooden fence. The one question that had me the most concerned was after they explained, any resident that broke their rules were evicted from the site immediately. I asked what that meant, and if a resident came home intoxicated were they simply released out their front door to stroll through our neighborhood. The answer again was "that almost never happens", again I say, if this shelter were planned to be in your backyard where your 2 and 4yr old play, would that be an acceptable answer to you and your family? Even more scary of a situation is the ease of the ability to get fentenol and the barrage of news stories that fill the 6 O'clock news nightly of children and even police officers ingesting this deadly substance and passing away. It is not hard to see where the concern of the residence if all the nearby neighborhoods is coming from. Above the safety of the residents in the nearby neighborhoods, there is also the huge safety issues with commuting to and from the proposed sight up and down Miles Rd. The road is thin, curvy, and dark with large drainage dishes on each side making it extremely dangerous to walk or bike down. Just outside of our entrance to the left is a very sharp curve that we typically see 1 to 2 cars in a month. With the drainage ditches on both sides there is no room to add sidewalks or bike lanes in it's current state. I have also heard that there is a plan to widen the road up to 5 lanes in the near future which would take up more of the slim sliver of property that the shelter is to be built on. For these reasons and I am sure several others I am asking the town to NOT annex this location. We believe the main reason they are asking for annexation is to have a less stringent vegetation barrier between the shelter and the existing neighborhood, allowing the shelter to be much closer to my backyard. I think this is very dangerous to have so close to an elementary school and in the middle of so many neighborhoods. We all have children and homes we are trying to protect! My question for DCCO, the town or anyone whom it may concern is, 1.) Why did they not accept the property that was already offered to them? This is a major question that seems to have no answer to. 2.) There were a lot of incidents that happened at the location of the Central Ave Building. A couple being; someone being beaten with a hammer and another with necrophilia and child pornography. It is very disturbing to know that those incidents could happen at this new shelter, as I have stated before, being so close to an elementary school and with lots of children that stand on that corner as the bus stop. Put those incidents together and that would be a terrible thing that could possibly happen to someone's family while that building would be in use. That would be on you guys! If you put that building at that spot, there would be so many opportunities for anyone staying there to carry out their acts. This building should not be in the middle of neighborhoods, should be further away so there would be less temptation from residents to make bad decisions and closer to transportation for residents to get to work, Dr appointments, court meetings etc. Last thing is, that it is MUCH easier for a company like DCCO to find another area for this building than it is for us homeowners to up and move. (DCCO gets plenty of funding to move elsewhere.) I've worked VERY hard to get to where I am today and feel it is wrong if this building does go up and puts all of my hard work out the door. If they need help finding a new location, I'm sure all of us would help out. Seems that they have probably had other locations to choose from. If you have children or had children, would you want this in your backyard? Would you want to constantly worry about the safety of your children? Constantly have to worry about the value of your home? Worry about your belongings possibly being broken into or stolen? Like I've always told my daughter, if I keep doing things for you, you're never going to learn. Why should it be any different for these fully grown adults? As a resident of the city of Summerville and the Summerville Place subdivision for over 31 years, my wife and I are adamantly opposed to this annexation. While we are certainly not unsympathetic to the homelessness that exists in our area, we do not believe that this location is appropriate or suitable for this purpose. The property should not be annexed due to the close proximity to the entrance of our neighborhood and over 400 residents of Summerville Place as well as several other residential communities. Summerville Place's current property manager recently forecasted that a facility of this nature adjacent to our neighborhood will make our homes less desirable in the current real estate marketplace thus reducing the value of our single greatest investment. Furthermore, it is our understanding that the setbacks allowed by the city would be less restrictive than Dorchester County thus reducing the buffer that would exists between our homes and DCCO's proposed structures. We can only assume this is the main reason for DCCO's annexation request. This is unacceptable. Additionally, it appears that the City of Summerville has nothing to gain from this annexation. In fact, it is obvious that a facility of this nature will require increased city services such as police, fire and EMS-departments that are already overburdened and will divert resources from the citizens of Summerville. Please keep in mind that those supporting this annexation and shelter most likely do not live in close proximately to the proposed location. In fact, as of today, over 769 citizens have signed a petition objecting to the building of this shelter in the current proposed location. Thank you for allowing the opportunity to comment on the proposal and the Planning Commission's consideration of our legitimate concerns. By all means, it is fine to have such a program that the Summerville Mayor supports. I am truly fine with that. I am just opposed to this location. There are several properties along Ladson Road, Dorchester Road, Trolley and Bacons Bridge that already have street lights, sidewalks and public transportation that would really be more ideal to build a facility on.
