The Town of Summerville Planning Commission Meeting
Minutes
March 20, 2023
This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and
was attended by Commission Members, Jim Reaves, Chairman; Charlie Stoudenmire; Betty Profit; and
Elaine Segelken. Kevin Carroll; Tom Hart; and Jim Bailey were unable to attend. Staff in attendance
included Jessi Shuler, AICP, Director of Planning. The public was invited to attend in person, or they
viewed the meeting via live-stream.
Jim Reaves, Chairman, called the meeting to order at 4:00 PM.
Approval of Minutes and Election of Officers:
The Chairman asked if there were any edits or additions to the minutes from the meeting on February 27,
2023. Hearing none the minutes were approved as submitted.
Public Hearings:
The first public hearing opened at 4:01 PM and was for the petition by CVEA Summerville III, LLC to
annex TMS#220-00-02-147, located on N. Maple Street and totaling approximately 10.34 acres.
Currently zoned PD – OP/IP, Planned Development – Office Park/Industrial Park, in Berkeley County
and will be zoned G-B, General Business, upon annexation into the Town of Summerville’s municipal
limits. (Council District 2) Mr. Reaves introduced the item and asked if the applicant was in attendance.
Hearing no public comment, this public hearing was closed at 4:01 PM.
The second public hearing opened at 4:02 PM and was for the request to rezone TMS#232-00-02-131,
located on Marymeade Drive and Angus Drive, approximately 12.983 acres, and owned by Invesco LP,
from L-I, Light Industrial, to G-B (General Business). (Council District 2) Mr. Reaves introduced the
item and asked if the applicant would like to present the request. Josh Lilly with Stantec, representing the
owner, stated that this was a straight-forward rezoning request, but he would answer questions if there
were any. Hearing no other public comment, this public hearing was closed at 4:02 PM.
The last public hearing opened at 4:03 PM and was for the ordinance to amend the Unified Development
Ordinance (UDO), 13.3.4, Tree Protection Board (TPB) by: more fully setting forth the authority under
which the TPB was created; clarify the section under which an administrative review is appropriate; and,
add a new section 13.3.4(C)(5), Appeals from Decisions of the TPB. Hearing no public comment this
public hearing was closed at 4:03 PM.
Old Business
There were no items under Old Business.
New Business:
The first item under New Business was New Street Names. Ms. Shuler stated that they had no street
names for consideration this month.
The second item under New Business was the petition by CVEA Summerville III, LLC to annex

UDO AMENDMENTS

Description:
Amendments to Chapter 5, Section 5.11.2 – Required Improvement for Final Plat Approval
Reason for request: The requested amendment is proposed by staff to address the chicken and egg
problem in relation to receiving a permit to operate (PTO) water and sewer. Per the current language
a PTO is required prior to recording a final plat; however, certain water and sewer providers will not
issue a PTO without TMS#s and addresses, which cannot be assigned until after a final plat is
recorded. This amendment addresses that issue.
Amendments to Chapter 13, Section 13.6.1 – Pre-application Conference
Reason for request: The requested amendment is proposed by staff to clarify that subdivisions
require a pre-application conference even if new streets are not created to ensure that all
planning/zoning, access, stormwater, and utility issues are addressed. As the ordinance already states,
this can be waived if it is not needed.
AN ORDINANCE
TO AMEND THE SUMMERVILLE UNIFIED DEVELOPMENT ORDINANCE,
CHAPTER 5, SECTION 5.11.2 REQUIRED IMPROVEMENTS FOR FINAL PLAT
APPROVAL, SUBSECTION (A) OF THE TOWN OF SUMMERVILLE CODE OF
ORDINANCES
BE IT ORDAINED by the Mayor and Council members of the Town of Summerville, in
Council assembled, that the Summerville Unified Development Ordinance, Section 5.11.2
Required Improvements for Final Plat Approval, subsection (A) is amended to read as follows:
5.11.2 REQUIRED IMPROVEMENTS FOR FINAL PLAT APPROVAL
A. All of the infrastructure improvements must be in place in accordance with this section
and shown on the approved construction plans prior to submission of the final plat. The
project engineer must submit a letter to Town Staff certifying the infrastructure is in
place. Infrastructure includes, but is not limited to;
1. A permit to operate (PTO) the water and sewer system for the entire phase of the
development must be in process with the water and sewer provider(s) prior to
submission of the final plat. The PTO must be submitted to Town Staff’s office prior to
any building permits being issued, final plat recorded or TMS numbers being issued.
2. The asphalt binder course must be in place prior to submission of the final plat. The
asphalt surface course shall not be installed until the end of the warranty period.
3. Proposed drainage improvements, street signage, and temporary pavement markings
must be in place prior to submission of the final plat.

(A) ENTITLED MANDATORY PRE-APPLICATION CONFERENCE, OF THE TOWN
OF SUMMERVILLE CODE OF ORDINANCES
BE IT ORDAINED by the Mayor and Council members of the Town of Summerville, in
Council assembled, that the Summerville Unified Development Ordinance, Section 13.6.1 Pre-
application Conference, subsection (A) entitled Mandatory Pre-application Conference is
amended to read as follows:
13.6.1 PRE-APPLICATION CONFERENCE
A. Mandatory Pre-application Conference: A pre-application conference with Town
Staff/TRC shall be required prior to fling an application for the following approvals:
1. Certificates of Appropriateness (Major)
2. Commercial/Multi-Family Design Review; Master Sign Plans
3. Site Plans
4. Subdivision Review involving the creation of new streets;
5. Planned Development (PUD);
6. Map Amendment (Rezoning); and
7. Text Amendment.
Town Staff shall have the authority to waive any mandatory pre-application
conference where such conference is deemed unnecessary.
