Request to rezone TMS#130-14-13-009, located at 715 W. 5th North Street, approximately 0.22 acres, and owned by Thomas A. ADJOURNMENT: ____________________________________ Chairperson or Vice Chairperson Posted May 8, 2023 The Town of Summerville Planning Commission Meeting Minutes April 17, 2023 This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and was attended by Commission Members, Jim Reaves, Chairman; Charlie Stoudenmire; Betty Profit; Kevin Carroll; Jim Bailey; and Elaine Segelken. Tom Hart was unable to attend. Staff in attendance included Jessi Shuler, AICP, Director of Planning, and Bonnie Miley, Assistant Town Engineer. The public was invited to attend in person, or they were able to view the meeting via live-stream. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes: The Chairman asked if there were any edits or additions to the minutes from the meeting on March 20, 2023. Ms. Segelken made a motion to approve the minutes as presented, and Mr. Bailey made the second. The motion passed unanimously. Public Hearings: The first public hearing opened at 4:01 PM and was for the ordinance to amend the Unified Development Ordinance, Chapter 5, Section 5.11.2 Required Improvement for Final Plat Approval, Subsection (A) to clarify the process in relation to the permit to operate (PTO) the water and sewer system. Mr. Reaves introduced the item. Ms. Segelken questioned if this was in reference to subdivisions, and Ms. Shuler confirmed that it was. Hearing no public comment, this public hearing was closed at 4:01 PM. The second public hearing opened at 4:01 PM and was for the ordinance to amend the Unified Development Ordinance Chapter 13, Section 13.6.1 Pre-Application Conference, Subsection (A) Mandatory Pre-application Conference to include all subdivision review. Mr. Reaves introduced the item Hearing no public comment, this public hearing was closed at 4:02 PM. Old Business There were no items under Old Business. New Business: The first item under New Business was New Street Names. Ms. Shuler stated that they had multiple street names for approval. The first were for the N. Maple Mixed-Use PUD/Salisbury tract, and ten names were needed: Road 1: Whitman Way; Road 2: Armstrong Curve; Road 3: Slice Drive; Road 4: Trevino Drive; Road 5: Bellows Bend; Alley 1: Singer Court; Alley 2: Peale Court; Alley 3: Mantle Court; Alley 4: Niven Court; Alley 5: Trumbull Court. Ms. Segelken made a motion to approve the ten proposed names, and Mr. Bailey made the second. The motion passed unanimously. Ms. Shuler stated that an additional street name was also needed for Limehouse Village Phase 4, and two possible names were provided: Shallow Bottom Way or Forest Bottom Lane. Ms. Segelken made a motion to approve Forest Bottom Lane, and Mr. Bailey made the second. The motion passed unanimously. Ms. Shuler then explained that two names were needed for the roads within the Sawmill Centre development at Highway 78 and Berlin G. Myers Parkway, one for the short entry road and one for the main spine road. Three possible names were provided: Sawmill Centre Drive, Station Street, and Pine Branch Way. Mr. Bailey made a motion to approve Sawmill Centre Drive for the main spine road and Station Street for the entry road, and Ms. Segelken made the second. The motion passed unanimously. Limehouse TMS#: 130-14-013-009 Location: 715 W. 5th North Street Description: one parcel, approximately 0.22 acres Request: Rezoning to UC-MX, Urban Corridor Mixed-Use Owner and Applicant: Willie S. Limehouse TMS#s: 130-14-013-007 and -008 Location: 100 N. Hampton Street and 711 W. 5th North Street Description: two parcels, totaling approximately 1.1 acres Request: Rezoning to UC-MX, Urban Corridor Mixed-Use The properties are immediately adjacent to each other and owned by members of the same family, so this staff report is considering them together. The applicants are requesting the above referenced parcels to be rezoned to UC-MX from the current zoning of N-MX. These properties were rezoned to N-MX from the previous B-3 zoning when the UDO was adopted in October 2019. This property is included in the Town’s ‘Neighborhood Mixed-Use’ area as identified within the Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land Use Map, which “is intended to encourage the integration of commercial and a variety of residential land uses within easy walking distance of each other. Commercial uses should include residentially scaled businesses, such as sales of consumer goods, health and personal care, professional services, offices, restaurants, and religious institutions.” The Economic Development element of the Comp Plan also identifies this area as a “Downtown Transition Commercial Area” with commercial businesses and mixed-uses where “pedestrian mobility is still a priority.” The applicants’ state that the “current zoning is inconsistent with adjacent property uses, historic and current uses of the properties, and any realistic functional uses moving forward.” 715 W. 5th North Street was previously a tire and brake shop, which closed in March 2023. 711 W. 5th North Street is still operating as a used car lot, and 100 N. Hampton Street as a car repair business. Even without rezoning, the businesses at 711 W. 5th North Street and 100 N. Hampton Street will be allowed to continue operating as legal non-conforming businesses unless the businesses cease operating for more than 90 consecutive days per UDO Section 12.4. The nonconforming use at 715 W. 5th North Street has been discontinued for more than 90 days, so that use is no longer allowed. While both the UC-MX zoning and the N-MX zoning allow for a mix of uses, the N-MX district does not allow for vehicular uses as permitted uses, as they are generally not conducive to pedestrian mobility or within such close proximity to single-family residences. There are other more intensive commercial uses that are also not allowed within the N-MX district that are allowed in UC-MX, such as hotels, kennels, and bars/taverns/nightclubs. While the zoning in this area prior to the UDO allowed for these uses, due to the immediate adjacency of properties zoned to only allow single-family detached homes and the recognition that proximity to the schools created a need for a safer pedestrian environment, this area was specifically identified to be down-zoned to the new N-MX zoning district during the UDO adoption process. The property owners of these properties were made aware of this proposed zoning change and given the opportunity to provide feedback throughout the UDO process.
