Approval of minutes from meeting on October 16, 2023. II. PUBLIC HEARINGS: (public hearing notice in Post & Courier on 11.05.23 and signs posted on the property on 11.1.23) 1. Petition by Shannon E. & Cameron M. Lines et. al. to annex TMS# 145-08-00-022, located at the end of W. Smith Street, and totaling approximately 13.5 acres. Currently zoned TRM, Transitional Residential, in Dorchester County and will be zoned MF-R, Multi-family Residential, upon annexation into the Town of Summerville’s municipal limits. ADJOURNMENT: ____________________________________ Chairperson or Vice Chairperson Posted November 13, 2023 The Town of Summerville Planning Commission Meeting Minutes October 16, 2023 This meeting of the Town of Summerville Planning Commission was held in the 3rd floor Council Chambers and was attended by Commission Members, Jim Reaves, Chairman; Charlie Stoudenmire; Elaine Segelken; and Kevin Carroll. Tom Hart; Jim Bailey; and Betty Profit were unable to attend. Staff in attendance included Jessi Shuler, Director of Planning. The public was invited to attend in person, or they viewed the meeting via live-stream. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes: The Chairman asked if there were any edits or additions to the minutes from the meeting on September 18, 2023. Hearing none the minutes were approved as submitted. Public Hearings: The first public hearing opened at 4:01 PM and was for the request to rezone TMS#137-09-01-010, located at 733 Central Avenue, totaling approximately 0.23 acres, and owned by Jeanne Clark Hagood, from GR-5, General Residential (5 units/acre), to N-B, Neighborhood Business. (Council District 1) Mr. Reaves introduced the item. The applicant was not in attendance. Denise Rock of 120 Parkwood Drive asked exactly what the applicant was requesting. Mr. Reaves briefly explained the rezoning request, and Ms. Rock further questioned what was planned for the property and what uses were allowed. Ms. Shuler explained that there were no specific plans for the property at this time as the request is only to rezone the property. When the property is proposed to be developed, it will have to go through the Design Review Board process. Ms. Shuler also stated that the Neighborhood Business zoning district allowed for a RA D FT number of residential and commercial uses, including professional offices, personal services, small retail establishments, restaurants, and other uses. Ms. Rock complained about the existing traffic on Central Avenue and believes that this rezoning will only make it worse. Linda Haynes Whetsell of 108 Atlantic Street agreed with Ms. Rock. She noted that Central Avenue is already a traffic jam. She lives across the street, and she feels that no additional businesses are needed in that location due to the proximity of adjacent residential properties across the street and behind this property. Both Ms. Rock and Ms. Whetsell expressed concern about an existing access to the residential properties on Germantown adjacent to this property and the impact that this rezoning could have on the adjacent existing residential properties. Ms. Shuler did note that a representative of the owners of three of the adjacent residential properties on Central Avenue also had inquired about rezoning their properties to Neighborhood Business. Hearing no further public comment, the public hearing was closed at 4:08 PM. The second public hearing opened at 4:08 PM and was for the proposed amendment to the Summerville Unified Development Ordinance (UDO) Chapter 13 – Administration & Procedures, Section 13.3.3 – Board of Zoning Appeals. Mr. Reaves introduced the item. Ms. Shuler briefly explained that this amendment was needed due to the change in the number of BZA members from five to seven. With the change to seven members, the BZA’s voting would now function the same as all the other boards and commissions, so the additional language is no longer necessary. Hearing no public comment, the public hearing was closed at 4:09 PM. The third public hearing opened at 4:09 PM and was for the proposed amendment to the Town of Summerville Code of Ordinances, Chapter 20, Planning and Development, Article III, Development Standards, Section 20-72, Bicycle and Pedestrian Advisory Committee. Mr. Reaves introduced the request. Ms. Shuler explained that this change to three years brought the term limits of the BPAC into line with the rest of the boards and commissions. Hearing no public comment, the public hearing was closed at 4:09 PM. Old Business There were no items under Old Business. New Business: The first item under New Business was New Street Names. Ms. Shuler stated that they did not have any street names for review. The second item under New Business was the request to rezone TMS#137-09-01-010, located at 733 Central Avenue, totaling approximately 0.23 acres, and owned by Jeanne Clark Hagood, from GR-5, General Residential (5 units/acre), to N-B, Neighborhood Business. (Council District 1) Mr. Carroll made a motion to recommend approval of the rezoning to Council, and Ms. Segelken made the second. Ms. Segelken explained that the traffic on Central Avenue already backs up all the way into Town at peak hours, so this small property should not have a significant additional impact. She noted that the redirection of traffic once the N. Maple Street project is completed should hopefully alleviate some of the traffic issues. Mr. Carroll concurred and noted that the traffic was a similar problem on Boone Hill Road during peak hours. Hearing no further discussion, Mr. Reaves called for the question and the motion passed on a 3-1 vote with Mr. Stoudenmire voting in opposition. The third item under New Business was the proposed amendment to the Summerville Unified Development Ordinance (UDO) Chapter 13 – Administration & Procedures, Section 13.3.3 – Board of Zoning Appeals. Ms. Segelken made a motion to recommend approval of the wording change to Council, and Mr. Carroll made the second. The motion passed unanimously. RA D FT The fourth item under New Business was the proposed amendment to the Town of Summerville Code of Ordinances, Chapter 20, Planning and Development, Article III, Development Standards, Section 20-72, Bicycle and Pedestrian Advisory Committee. Ms. Segelken made a motion to recommend approval to Council of the amendment to make the terms uniform with the other boards, and Mr. Stoudenmire made the second. The motion passed unanimously. Miscellaneous: Ms. Shuler reminded the Commission members about getting their required three hours of continuing education for the year. She noted that Remy recently sent out multiple options for webinars and encouraged those who had not completed the hours to take advantage of those. Adjourn With no further business for the Commission, Mr. Stoudenmire made a motion to adjourn with Mr. Carroll making the second. The motion carried and the meeting was adjourned at 4:16 PM. Lines et. al. Applicant: Brock Development Group TMS#: 145-08-00-022 Location: W. Smith Street Description: one parcel, approximately 13.5 acres Request: Annexation and zoning to MF-R The property owner is requesting for the above referenced parcel to be annexed into the Town with the zoning of MF-R, Multifamily Residential. The existing zoning in Dorchester County is TRM, Transitional Residential. This property is included in the Town’s ‘Single-Family Residential’ area as identified within the Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land Use Map, which includes detached single-family uses with a typical density of 2-5 units per acre. This property also falls in the Town Edges area in the growth strategy included in the Land & Development element of the Comp Plan. The Town Edges growth area “prioritizes development in areas within existing infrastructure service boundaries to sustainably manage their capacity while utilizing available space. Prioritization of growth in this area is also intended to incorporate existing pockets of development in unincorporated areas (i.e. donut holes) and prevent future developments like these. Prioritization should be given to areas that include commercial development over solely residential areas.” The applicant is proposing to build +/- 65 townhomes. The only access to the property is proposed through Lincolnville off W. Smith Street, which will have to be extended, meeting Town road standards, to access the site. Based on these findings the requested MF-R, Multifamily Residential, zoning district does not appear to be in conformance with the Town’s Comprehensive Plan, although the proposed use of townhomes with a density of approximately 4 units per acre is not entirely out of line with the Comp Plan and surrounding residential development. Staff has concerns with the single access point to the development, but the existing wetlands make additional access points difficult. The Town of Lincolnville expressed concerns about the increase in traffic to W. Smith Street, but the number of townhomes does not meet the Town’s threshold to require a traffic impact analysis.
