Fox, Stefan Colucci, William Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci to annex TMS# 152-00-00-026, located at 400 Murray Blvd., totaling approximately 12.81 acres. Currently zoned TRM, Transitional Residential District, in Dorchester County and will be zoned N-R, Neighborhood Residential, upon annexation into the Town of Summerville’s municipal limits. ADJOURNMENT: ____________________________________ Chairperson or Vice Chairperson Posted June 10, 2024 The Town of Summerville Planning Commission Meeting Minutes May 20, 2024 This meeting of the Town of Summerville Planning Commission was held in Town Council Chambers and was attended by Commission Members, Jim Reaves, Chairman; Kevin Carroll; Jim Bailey; and Elaine Segelken. Tom Hart, Charlie Stoudenmire, and Betty Profit were unable to attend. Staff in attendance included Jessi Shuler, AICP, Director of Planning. The public was invited to attend in person, or they viewed the meeting via live-stream. Jim Reaves, Chairman, called the meeting to order at 4:00 PM. Approval of Minutes: The Chairman asked if there were any edits or additions to the minutes from the meeting on April 15, 2024. Mr. Bailey made a motion for approval as presented, and Mr. Carroll made the second. The motion passed unanimously. Public Hearings: The first public hearing opened at 4:01 PM and was for the request to rezone TMS#s 130-14-13-001 and - 002, located at 110 and 112 Wylie Street, totaling approximately one acre, and owned by Wendy G. Taylor, from GR-5, General Residential (5 units/acre), to N-MX, Neighborhood Mixed-Use (Council District 1). Mr. Reaves introduced the item. Ms. Shuler asked the applicant to present the request, and Davis McNair with McNair Design & Development explained that they were requesting the N-MX zoning, which the adjacent property fronting W. 5th North Street. and the property across Iris Street already have. He noted that this area provided a transition from commercial to residential, and the proposed townhomes for the property would front Iris Street. Mr. McNair acknowledged that the RA D FT neighbors had concerns, and they are willing to listen to those concerns and try to address them. Troy and Sondra Long of 113 Wylie Street stated that Wylie Street has always been single-family detached residential, and they would like for it to stay that way. Mr. Long noted that the current zoning would allow for five single-family detached lots. Mrs. Long explained that with the access to the proposed townhomes coming off of Wylie Street, that would add additional traffic which they are already experiencing due to the N. Maple Street road work. Mr. Long questioned why they couldn’t consider the N-R zoning instead of N-MX, as the N-MX could be used for business if the townhomes fell through, and they have had negative experiences with the property across Iris Street before it was used as a church. David and Jabria Boccabella of 108 Wylie Street explained that they live right next door and are concerned about others uses that would be allowed with the mixed-use zoning. Mr. Boccabella stated that they have four kids; the school district is already full, and they are worried about traffic, safety, and the location of the pond for the proposed townhomes. Mrs. Boccabella mentioned the potential for a different commercial use if the townhomes don’t work out, and she stressed that even the townhomes would not be uniform with the rest of the neighborhood and would change the character of their street. She also noted that parking could be an issue with parking for the proposed townhomes extending along their front lawn, as they are trying to squeeze as much as they can out of the property. Additional comments were provided in writing prior to the meeting and are incorporated into these minutes as a part of the public hearing. Hearing no public comment, this public hearing was closed at 4:10 PM. Old Business There were no items under Old Business. New Business: The first item under New Business was New Street Names. Ms. Shuler stated that they did not have any street names for consideration. The second item under New Business was the request to rezone TMS#s 130-14-13-001 and -002, located at 110 and 112 Wylie Street, totaling approximately one acre, and owned by Wendy G. Taylor, from GR- 5, General Residential (5 units/acre), to N-MX, Neighborhood Mixed-Use (Council District 1). Ms. Segelken made a motion to recommend denial of the rezoning, and Mr. Bailey made the second. Mr. Carroll explained that he visited the site, and Wylie Street is currently a very quiet street, which doesn’t need extra density or cars. He believes that the rezoning would change the character of the neighborhood. Ms. Segelken stated that she was concerned about the N-MX request as it would allow uses other than townhomes that she would not want to see in that area. She asked that the applicant consider changing their request to N-R and access the proposed townhomes from Iris Street if possible. Mr. Bailey asked what requires the proposed townhome development to have a pond, and Ms. Shuler responded that she believes it is based on the total disturbed acreage, but that determination is handled by Engineering. Mr. Reaves then called for the question and the motion passed unanimously. Ms. Shuler then explained that this recommendation will now go to the Planning & Development Committee of Town Council for a recommendation at their June meeting and then to full Council. Miscellaneous: Mr. Reaves reminded the Commission members about their training responsibilities, and that staff would be sending out webinar training opportunities as available. Ms. Segelken asked if any training opportunities would be in-person, and Ms. Shuler stated that they could potentially try to do that, but very few are RA D FT available for free. Adjourn With no further business for the Commission, Mr. Bailey made a motion to adjourn with Mr. Carroll making the second. The motion carried and the meeting was adjourned at 4:17 PM. Fox, Stefan Colucci, William Colucci, Alice Norton, Kim Colucci Lizzi, and Robert Colucci Applicant: CPG Development, LLC TMS#: 152-00-00-026 Location: 400 Murray Blvd. Description: one parcel, approximately 12.81 acres Request: Annexation and zoning to N-R The property owners are requesting for the above referenced parcel to be annexed into the Town with the zoning of N-R, Neighborhood Residential. The existing zoning in Dorchester County is TRM, Transitional Residential District. This property is included in the Town’s ‘Single-Family Residential’ area as identified within the Summerville: Our Town, Our Future Comprehensive Plan as well as on the accompanying Future Land Use Map, which includes detached single-family uses with a typical density of 2-5 units per acre. However, this property does fall in the Town Edges area in the growth strategy included in the Land & Development element of the Comp Plan. The Town Edges growth area “prioritizes development in areas within existing infrastructure service boundaries to sustainably manage their capacity while utilizing available space. Prioritization of growth in this area is also intended to incorporate existing pockets of development in unincorporated areas (i.e. donut holes) and prevent future developments like these. Prioritization should be given to areas that include commercial development over solely residential areas.” The applicant is proposing to construct single-family detached homes with a minimum lot size of 5,000 square feet; however, the N-R zoning district does also allow for 2-4 unit dwellings and mobile homes. The Town does not have the ability to limit permitted uses within a zoning district if all the zoning requirements can be met. In addition, the N-R zoning district does not have a minimum lot size requirement. While the adjacent property within the Town is the Limehouse Village PUD, with a minimum single-family detached lot size of 4,000 square feet, almost all the other properties on Murray Blvd. in Dorchester County are zoned TRM, with a minimum lot size of one acre. The requested N-R, Neighborhood Residential, zoning district is not out of compliance with the single- family residential use specified in the Town’s Comprehensive Plan; however, the character of the development does not appear to be in line with the surrounding development on that street within the County. In addition, the Town cannot require contract zoning, so there is no mechanism in place to require that only detached single-family homes with a minimum lot size of 5,000 square feet are built if the property is successfully annexed and zoned to N-R, unless the property owner chooses to place deed restrictions on the property. The Planning Commission and ultimately Town Council must decide if the overall character of the area will be negatively impacted by the proposed zoning.
